As per Section 228.056(9)16(c), Florida Statutes, a charter may be modified during its initial term or any renewal term upon the recommendation of the sponsor or the charter school governing board and the approval of both parties to the agreement.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the amended charter school contractual agreement to clarify language specific to Ryder Elementary Charter School.

The School Board of Miami-Dade County, Florida, announced on, May 16, 2001, its intention to amend School Board Rule 6Gx13- 2C-1.082, Construction Committees-Establishment and Responsibilities, to include therein the organization and responsibilities of the site selection committee, which will review and issue recommendations on school sites and related school construction planning issues; and to amend Board Rule 6Gx13- 7B-1.06, Site Selection Procedures, to incorporate a site selection process and milestones, at the meeting of June 20, 2001.

A-3  REQUEST FOR AUTHORIZATION TO ISSUE A REQUEST FOR PROPOSALS FROM AN ORGANIZATION FOR THE DEVELOPMENT OF AN ETHICS PROFESSIONAL DEVELOPMENT PROGRAM AND TO PROVIDE ETHICS TRAINING

Public schools have a special opportunity and responsibility to teach’ and model ethical behavior. To do so, requires a high level of sensitivity to issues such as integrity, responsibility, respect, and fairness. Such issues pervade all the various relationships between and among students, parents, teachers, support staff, and school and central administrators.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. authorize the Superintendent to issue a Request for Proposals from an organization for the development of an ethics professional development program and to provide ethics training to all employees; and 

2 . approve the selection committee that will review the proposals for subsequent submission to the School Board for approval.

The appropriations for this Request for Proposals will be included in the General Fund of the 2001-2002 Tentative Budget to be approved by the Board in July 2001.

B-5  REQUEST THAT THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA RECOGNIZE THE KIDS 4 KIDS CLUB FOR ITS CONTINUING COMMITMENT TO THE CHILDREN OF OUR COMMUNITY

The Kids 4 Kids Club, whose mission is is to engage children in community service, to instill a sense of civic responsibility and to increase self-esteem, was the brainstorm of teacher Beth Davis of Jack D. Gordon Elementary School.

ACTION PROPOSED BY MS. JACQUELINE V, PEPPER: That The School Board of Miami-Dade County, Florida, recognize the Kids 4 Kids Club for its continuing commitment to the children of our community.

C-14  REQUEST FOR SCHOOL BOARD APPROVAL TO EXTEND THE AMENDED CORAL REEF MONTESSORI ACADEMY CHARTER SCHOOL CONTRACTUAL AGREEMENT FOR SEVEN ADDITIONAL YEARS BEGINNING WITH THE 2001-2002 SCHOOL YEAR AND INCREASE THE STUDENT ENROLLMENT TO INCLUDE SIXTH GRADE

The following recommendations are made in accordance with Board Rules 6Gx13-4A-1 .I 6, 6Gx13-4A-1 .I 61, and the Miami-Dade County Public Schools/Dade County School Administrators’ Association labor contract.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the recommendations as set forth above for appointments and lateral transfers, to be effective June 21,2001, or as soon thereafter as can be facilitated.

 

E-15  TERMINATION OF EMPLOYMENT CONTRACT OF INSTRUCTIONAL EMPLOYEES FOR FAILURE TO SATISFACTORILY CORRECT PERFORMANCE DEFICIENCIES DURING THE 90-CALENDAR DAY PERFORMANCE PROBATION

The following instructional employee has been notified by the Superintendent of Schools that he has failed to satisfactorily correct identified performance deficiencies during his 90. Calendar Day Performance Probationary period:

RECOMMENDED: That The School Board of Miami-Dade County, Florida, terminate the employment contract of the above-referenced instructional employees, effective June 20, 2001, at the close of the workday, pending the outcome of a hearing, if requested.

F-15  REQUEST FOR AUTHORIZATION TO ACCEPT GRANT AWARDS FROM THE FLORIDA DEPARTMENT OF EDUCATION FOR FUNDING UNDER THE PUBLIC CHARTER SCHOOLS FEDERAL GRANT PROGRAM AND ENTER INTO SEPARATE - CONTRACTUAL AGREEMENTS WITH ASPIRA EUGENIO MARIA DE HOSTOS CHARTER SCHOOL; DORAL ACADEMY HIGH SCHOOL; NORTH COUNTY CHARTER SCHOOL; AND GARDENS ACADEMY OF EXCELLENCE CHARTER SCHOOL; PROJECT CYCLE: APRIL IO, 2001 THROUGH SEPTEMBER 30,200l

The Florida Department of Education (FDOE) issued a Request for Proposals under the Public Charter Schools Federal Grant Program for the purpose of awarding grants to charter schools partnering with local educational agencies in order to provide a high quality education for all students.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. accept grant awards from the Florida Department of Education, in the total amount of $280,000, for funding under the Public Charter Schools Federal Grant Program and enter into separate contractual agreements with ASPIRA Eugenio Maria de Hostos Charter School, in an amount not to exceed $67,496; Doral Academy High School, in an amount not to exceed $67,496; North County Charter School, in an amount not to exceed $67,496; and Gardens Academy of Excellence Charter School, in an amount not to exceed $9,642; Project Cycle: September 30,200l through April IO, 2001;

2. extend these grant awards and contractual agreements, at no additional cost, for up to one year, as authorized through official notification from the granting agency, if deemed necessary, in order to fully expend the grant awards and thus complete the scope of the projects; and

3. Financial Affairs to establish appropriations in the amounts approved by the granting agency; such appropriations to be reported periodically to the Board.

 

G-84  RENEW BID NO. 053-2207 - SCHOOL BUS ROUTES FOR APPROVED PRIVATE SCHOOL BUS COMPANIES

The purpose of this bid, opened on August 12, 1999, was to establish a contract, to purchase, at firm unit prices, quantities, as may be required, of school bus routes, for the Department of Transportation. The terms of agreement, as contained in the subject bid, awarded by the Board on August 25, 1999, and renewed on July 19, 2000, provided, that by mutual agreement between the successful vendors and The School Board of Miami-Dade County, Florida, the contract may be renewed for two (2) additional one (1) year periods. The contract is currently in its first renewal period.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, RENEW Bid No. 053-2207 - SCHOOL BUS ROUTES FOR APPROVED PRIVATE SCHOOL BUS COMPANIES, to purchase, at firm unit prices, quantities, as may be required, of school bus routes, for the Department of Transportation, during the term of the bid, effective August 25, 2001, through August 24, 2002, as follows:


G-103  REJECT BID NO. 065-AA07 - FURNISH AND INSTALL AIR-CONDITIONING SYSTEMS IN MIAMI-DADE COUNTY PUBLIC ‘EV"~ SCHOOLS BUSES I

The purpose of this bid, opened on January 16, 2001, was to establish a contract, to purchase, at firm unit prices, quantities, as may be required, of air-conditioning systems, including installation, for Miami-Dade County Public Schools buses, for the Department of Transportation, Vehicle Maintenance. This is a term bid which states that the Board may purchase quantities, as may be required, at the unit price bid, but is not obligated to purchase any guaranteed amount. Of 42 vendors sent bid forms or card notices of this advertised bid, 17 responded, with 5 bids meeting specifications, (Includes l vendor who submitted an alternate bid) 1 non-responsive bid (Davenport Vehicle A/C Specialist, Inc. submitted an alternate bid, however, does not have a service facility in Miami-Dade County) and 1 1 no bids.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, REJECT Bid No. 065-AA07 - FURNISH AND INSTALL AIR-CONDITIONING SYSTEMS IN MIAMI-DADE COUNTY PUBLIC SCHOOLS BUSES, to permit rebidding, using revised specifications.

J-9  AUTHORIZATION FOR THE SUPERINTENDENT TO EXECUTE A JOINT PARTICIPATION AGREEMENT WITH MIAMI-DADE COUNTY FOR THE INSTALLATION OF TRAFFIC SAFETY DEVICES TO COMPLY WITH OFF-SITE REQUIREMENTS FOR EUGENIA B. THOMAS ELEMENTARY SCHOOL (STATE SCHOOL "A")

Miami-Dade County Public Schools (School District), pursuant to Section 235.193, F.S., is required to provide site plans for review by the appropriate jurisdictional local government, in connection with proposed educational facilities.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1) authorize the Superintendent or his designee to execute a Joint Participation Agreement with Miami-Dade County for the design and installation of traffic safety devices, in the amount of $226,627.50, to meet the off-site requirements for Eugenia B. Thomas Elementary School (State School "A"), and;

The School Board approved the award of National Roofing /South Florida, Inc. for Roofing Term Contracting Services at its meeting of June 21,200O. Maintenance and Operations is requesting authorization to renew the contractual agreement for a one-year extension for a maximum of $1,500,000, whichever occurs first, as provided for in Article I of the original Term Bid Contract.

RECOMMENDED: That The School Board of Miami-Dade County, Florida authorize the Superintendent to renew the contractual agreement, Project No. BB0$05-1, Roofing Term Bid, for an additional period of one year or a maximum of  $1,500,000, whichever occurs first, as provided in the current contract with National Roofing / South Florida, Inc., commencing on June 21,200l.

A-4  REQUEST FOR ENDORSEMENT OF THE ESTABLISHMENT OF A CUSTOMER SERVICE HOTLINE FOR CITIZENS TO REPORT ALLEGED FRAUD AND WASTE IN THE MANAGEMENT OF MIAMI-DADE COUNTY PUBLIC SCHOOLS

To further open the school district to citizens and to enlist their involvement in promoting efficient and ethical district management, it is recommended that the Board endorse the establishment of a customer service hotline for citizens to report alleged fraud and waste in Miami-Dade County Public Schools. Guidelines will be established by the Superintendent with input from students, parents, teachers, administrators, citizens and other stakeholders in public education.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, endorse the establishment of a customer service hotline for citizens to report alleged fraud and waste in the management of Miami-Dade County Public Schools.

A-8  ENTER INTO A MEMORANDUM OF UNDERSTANDING BETWEEN MIAMI-DADE COUNTY PUBLIC SCHOOLS AND THE CONSULATE GENERAL OF GERMANY

The Federal Agency of Administration, "Bundesverwaltungsamt" (BVA) acting through the Consul General of the Federal Republic of Germany in Miami, Florida, represented by Mr. Fritz von Rottenburg, contacted Miami-Dade County Public Schools (M-DCPS) requesting support of the German Section of the International Studies (IS) program.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent or his designee to negotiate and enter into a Memorandum of Understanding between Miami-Dade County Public Schools and the Consulate General of the Federal Republic of Germany to provide German instruction from July 1, 2001 through June 30,2004.

A-9  REQUEST FOR AUTHORIZATION TO REDUCE THE DATES FOR EDUCATIONAL PROGRAMS FOR THE 2001 SUMMER SCHOOL SESSION FOR K-8 FROM JULY 9, 2001-AUGUST 3, 2001 TO JULY 9, 2001-JULY 31, 2001 AND FOR 9-12 FROM JULY 9, 2001-AUGUST 17, 2001 TO JULY 9, 2001-AUGUST 14, 2001. ADDITIONALLY, ALL PREVIOUSLY APPROVED SUMMER OUTREACH PROGRAMS WILL BE REDUCED BY THREE DAYS DISTRICT FUNDING FOR 2001 SUMMER SCHOOL PROGRAM 

The matrix developed by the Office of Budget Management reflects the funding reduction based on the scheduled 2001 Summer School calendar change.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to reduce the dates for educational programs for the 2001 Summer School Session for K-8 from July 9, 2001 -August 3,200l to July 9, 2001 -July 31, 2001 and for 9-12 from July 9, 2001-August 17, 2001 to July 9, 2001-August 14, 2001. Additionally, all previously approved Summer Outreach Programs will be reduced by three days.


B-10  TO DIRECT THE SUPERINTENDENT TO INCLUDE AS PART OF OUR LEGISLATIVE PRIORITY PACKAGE FOR THE 2002 FLORIDA LEGISLATIVE SESSION SUPPORT FOR LEGISLATION BEING PROPOSED BY SENATOR RUDY GARCIA AND REPRESENTATIVE MARIO DIAZ BALART ALLOWING SCHOOL BOARDS FROM ALL ACROSS OUR STATE THE OPPORTUNITY OF CREATING THE OFFICE OF INSPECTOR GENERAL.

The Miami Dade County Public School System is the fourth largest in the nation. Employing more than 35,000 teachers, with a student population of more than 350,000 in more than 300 locations, and an annual budget of more than $3.4 billion, M-DCPS is a major public institution functioning under the greatest scrutiny of any other public or private enterprise.

ACTION PROPOSED BY MRS. SABATES MORSE: That the School Superintendent include in our Legislative Priority Package for the 2002 Legislative Session support of proposed legislation by State Senator Rudy Garcia and State Representative Mario Diaz-Balart allowing local school hoards the option of establishing an office of Inspector General reporting to the Board in the same manner as the Superintendent and the Board Attorney.

D-1  AUTHORIZATION TO CHANGE THE OPENING AND CLOSING TIMES AND REQUEST A WAIVER FROM THE COMMISSIONER OF EDUCATION TO ESTABLISH DOUBLE SESSIONS AT MIAMI SPRINGS SENIOR HIGH SCHOOL

Severe overcrowded conditions at Miami Springs Senior High School have prompted staff to explore the option of double sessions. To effect the proposed alternative, changes in the opening and closing hours of schools are required. Pursuant to Board Rule 6Gx13- 6A-1.03, Instruction - Elementary and Secondary, the Superintendent of Schools is required to report changes in opening and closing hours of schools to the Board in open session sixty (60) days prior to the effective date, except in unusual circumstances.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize:

1. changing of opening and closing times,

2 . instituting double sessions at Miami Springs Senior High School, and

3 . requesting a waiver from the Commissioner of Education to establish double sessions.

The following recommendations are made in accordance with Article XI, Section 8, of the Miami-Dade County Public Schools (M-DCPS/Dade County School Administrators’ Association (DCSSA) labor contract.


RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into contractual agreements with selected contracted project employees, effective July I,2001 through June 30,2002.

E-7  APPOINT AND ASSIGN: SENIOR PROJECT MANAGER, TELECOMMUNICATIONS

The Senior Project Manager, Telecommunications, is responsible for administrative and technical planning, installing, and implementing voice and data communication services for new facilities and additions to existing facilities.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint Rodolfo E. Rodriguez, currently a Manager, Network Services, pay grade 42, to the open budgeted position of Senior Project Manager, Telecommunications, pay grade 43, 12 months, and assign to the Office of Information Technology, effective June 21,2001, or as soon thereafter as can be facilitated.

 

E-17  DISMISSAL OF EMPLOYEE MARY ANN LEE -TEACHER PINE VILLA ELEMENTARY SCHOOL

On June 7, 2001, the Superintendent of Schools sent the following letter to Ms. Mary Ann Lee:

RECOMMENDED: That effective June 20,2OOl, at the close of the workday, the School Board suspend and initiate dismissal proceedings against Ms. Mary Ann Lee, Teacher at Pine Villa Elementary School, pending the outcome of a hearing, if requested.

 

G-2  RESOLUTION NO. 2, THE 2000-01 GENERAL FUND SPRING BUDGET REVIEW

The Office of Budget Management has completed its review of actual receipts and expenditures through April 27, 2001, and updated entitlement \ notices from the Department of Education. Based on that review, the following changes to the budget as previously amended on February 14,200l are recommended for approval.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

a. Adopt Resolution No. 2, 2000-01 General Fund Spring Budget Review increasing revenues and appropriations and reserves by $4,694,759.

b. Adopt the Summary of Revenues and Appropriations and the Summary of Appropriations by Function.

 

G-98  PARTIAL AWARD BID NO. 079-AA03 - CAFETERIA PAPER AND PLASTIC SUPPLIES

The purpose of this bid, opened on March 8, 2001, is to establish a contract, to purchase, at firm unit prices, quantities, as may be required, of‘ various items of cafeteria paper and plastic supplies, for Stores and Mail Distribution stock. This is a term bid which states that the Board may purchase quantities, as may be required, at the unit price bid, but is not obligated to purchase any guaranteed amount. Of 53 vendors sent bid forms or card notices of this advertised bid, 19 responded, with 17 regular bids (not all vendors bid all items) and 2 no bids.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, AWARD Bid No. 079-AA03 - CAFETERIA PAPER AND PLASTIC SUPPLIES, to purchase, at firm unit prices, quantities, as may be required, of various items of cafeteria paper and plastic supplies, for Stores and Mail Distribution stock, during the term of the bid, effective June 20, 2001, through June 19, 2002, as follows:

 

G-102  AWARD REQUEST FOR PROPOSALS NO. 199-AA10 - TITLE 1 EDUCATIONAL SERVICES FOR PARTICIPATION OF STUDENTS ENROLLED IN PRIVATE SCHOOLS

The purpose of this Request For Proposals, opened on June 7,. 2001, is to establish a contract, to deliver, at a firm price, instructional services in the areas of reading, writing and mathematics, to students enrolled in private schools who generate Title I funding, for Federal Programs and Grants Administration, Title I.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, AWARD Request For Proposals No. 199-AA10 - TITLE I EDUCATIONAL SERVICES FOR PARTICIPATION OF STUDENTS ENROLLED IN PRIVATE SCHOOLS, to establish a contract, to deliver, at a firm price, instructional services in the areas of reading, writing and mathematics, to students enrolled in private schools who generate Title I funding, for Federal Programs and Grants Administration, Title I, during the term of the proposal, effective June 20, 2001, through June 19, 2002, as follows:

J-8  AUTHORIZATION TO EXECUTE A PURCHASE AND SALE AGREEMENT FOR THE NORTHEAST TRANSPORTATION CENTER

At its meeting of May 16, 2001, the School Board (Board) directed staff to pursue an extension of the present lease agreement with Miami-Dade County (County), while continuing efforts to renegotiate the terms and conditions of the purchase of the Northeast Transportation Center.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent or his designee(s) to execute a purchase and sale agreement with Miami-Dade County for the purchase of the Northeast Transportation Center at a purchase price of $3,100,000, in as is condition, under the terms and conditions set forth above.

 

K-1 PROPOSED CONTRACTS FOR ASSISTANT BOARD ATTORNEYS

The contracts for the current in-house Assistant Board Attorneys expire June 30,200l. The Board Attorney recommends that the in-house assistant attorneys be awarded new contracts with appropriate salary adjustments.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. Authorize contracts with Patricia D. Bass, as Deputy School Board Attorney; Madelyn P. Schere, Luis M. Garcia, Ana I. Segura and Twila H. Payne, as Senior Assistant School Board Attorneys; Timothy A. Pease, Pamela Young Chance and John A. Greco, as Assistant School Board Attorneys, for the 200 l-2002 fiscal year;

2 . Authorize the School Board Attorney to negotiate the contracts of the in-house School Board Attorneys within the additional $50,000; and 

3 . Direct the Superintendent to include the amount of $50,000, plus the existing salary amounts for the eight current in-house Assistant Board Attorneys in the tentative budget to be submitted in July, 2001.
