AGENDA ITEMS WITHDRAWN AFTER PUBLICATION OF THE AGENDA:

B-4 MIAMI NORTHWESTERN SENIOR HIGH SCHOOL AUTHORITY TO FILE SUIT AGAINST PROJECT ARCHITECT AND UNIFORM BUILDING CODE INSPECTOR

During the course of litigation with the Contractor for the Miami Northwestern Senior High School project, it was discovered that claims may exist against the Project Architect and the Uniform Building Code Inspector, for inadequate contract administration and failure to properly perform uniform building code inspections.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the filing of lawsuits against the Project Architect and the Uniform Building Code Inspector to recover costs incurred by the Board arising from inadequate contract administration and failure to properly perform building code inspections relating to the design and construction of Miami Northwestern Senior High School.

CASE NO: SM-31 (2001-2002) DOB: 06/23/85

The Superintendent of Schools has recommended that this student be expelled from the regular and adult programs of Miami-Dade County Public Schools for the maximum time permitted under law, which is the 2001-2002 school year, the 2002 summer session, and the 2002-2003 school year.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1.  expel the student specified in the supplemental material SM-31 (2001-2002), furnished under separate cover to Board members, from the regular and adult programs of Miami-Dade County Public Schools for the maximum time permitted under law, which is the 2001-2002 school year, the 2002 summer session, and the 2002- 2003 school year;

2.  provide educational services in the opportunity school or alternative program during the term of the expulsion; and

3.  following the term of the expulsion, permit the student to be returned to a regular school program in Miami-Dade County Public Schools if approved by the Bureau of Adult/Vocational, Alternative and Dropout Prevention Programs.

E-6 ADMINISTRATIVE ASSISTANT TO INDIVIDUAL SCHOOL BOARD MEMBER

The School Board Administrative Assistant serves under contract at the pleasure of the individual Board Member and provides assistance in the performance of official duties and responsibilities.

B-5 APPROVAL OF AGREEMENT BETWEEN THE CITY OF CORAL GABLES AND THE MIAMI-DADE COUNTY SCHOOL BOARD RESOLVING OVERCROWDING AND SEWER CONNECTION ISSUES AT CERTAIN PUBLIC SCHOOLS IN THE CITY OF C6RAL GABLES

The City of Coral Gables initiated conflict resolution procedures provided in Chapter 764, Florida Statutes, to address alleged overcrowding and sewer connection issues at various public schools within the City.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to execute the Agreement between the City of Coral Gables and the Miami-Dade County School Board, resolving all issues concerning overcrowding and connections of sewer lines for public schools located within the City of Coral Gables.

C-17 REQUEST FOR SCHOOL BOARD APPROVAL OF THE SECOND AMENDMENT TO THE AMENDED CHARTER SCHOOL CONTRACTUAL AGREEMENT WITH THE DORAL ACADEMY

As per Section 228.056(9)16(c), F.S., Charter Schools, a charter may be modified during its initial term or any renewal term upon the recommendation of the sponsor and the approval of both parties to the agreement.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the second amendment to the amended charter school contractual agreement with The Dora1 Academy, effective December 13,2001, to:

1.  increase the overall enrollment from up to 1,250 students to up to 1,350 students; and

2.  authorize the temporary subcontracting of Miami-Dade County Public Schools’ instructional personnel currently assigned to the Miami International Airport Satellite Learning Center, until June 14, 2002.

E-15 REQUEST TO AUTHORIZE PERSONNEL IN THE SENIOR MANAGEMENT SERVICE CLASS (SMSC) TO HAVE THEIR RETIREMENT CONTRIBUTIONS DIRECTED TO THE BOARD’S GOVERNMENTAL MONEY PURCHASE PLAN WITH ICMA RETIREMENT CORPORATION

At the Board meeting of May 12, 1999, the Board established the Miami-Dade County School Board’s Money Purchase Plan, in the form of the ICMA Retirement Corporation Governmental Money Purchase Plan and Trust, for eligible Board members, pursuant to the guidelines established for the Elected State and County Officers’ Class (ESCOC).

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1.  authorize the personnel who are eligible for membership in the Florida Retirement System (FRS) class Senior Management Service Class (SMSC) to have the amount which would be contributed on their behalf to FRS, directed to the Board’s Governmental Money Purchase Plan and Trust with ICMA Retirement Corporation;

2.  authorize the contribution amount for SMSC members to coincide with the amounts determined by the State of Florida, Division of Retirement plan and class HM-SMSC, currently 9.28%; and

3.  amend its documents with ICMA Retirement Corporation, including but not limited to the resolution and adoption agreements, to allow for SMSC members.

APPROVAL OF SETTLEMENT AGREEMENT A. OLIVEROS TRANSPORTATION, INC. and LIBIA TAPIERO v. THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA - DOAH CASE NO. 01-2096

Effective April 9, 2001, School Operations disqualified A. Oliveros Transportation Inc., a private school bus company, from transporting students on Bus Route # 7602, under Bid No. 053-2207, for a period of fourteen months.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, accept and approve the Settlement Agreement between A. Oliveros Transportation Inc., Libia Tapiero and The School Board of Miami-Dade County, Florida, DOAH Case No. 01-2096.

B-31 PROPOSED AMENDMENT OF BOARD RULE: INITIAL READING 6Gx13- 6A-1.26, INSTRUCTIONAL MATERIALS AND RESOURCES

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to initiate rulemaking proceedings in accordance with the Administrative Procedure Act to amend School Board Rule 6Gx13-6A-1.26, Instructional Materials and Resources.

D-4 AUTHORIZATION FOR CREDIT OF EDUCATIONAL FACILITIES IMPACT FEES FOR LENNAR HOMES, INC.

In 1991, Lennar Homes, Inc. (Lennar), a developer, proffered a Declaration of Restrictions (Declaration) to Miami-Dade County, in connection with an application for a zoning change of a 184.37 acre site. This Declaration restricted the property to a maximum density of 6 units per acre or a maximum of 1106 units and provided for a contribution to the Board to mitigate the impact of the proposed residential development.

RECOMMENDED: That the School Board of Miami-Dade County, Florida, authorize:

1.  ratification of the prior administrative approval of a credit of Educational Facilities Impact Fees for Lennar Homes, Inc., in the amount of $200,000 and

2.  a credit of Educational Facilities Impact Fees for Lennar Homes, Inc., in the amount of $210,400.

D-25 AGREEMENT BETWEEN MIAMI-DADE COUNTY AND THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, FOR THE CONSTRUCTION OF WATER AND WASTEWATER FACILITIES TO SERVICE THE PHlLLlS WHEATLEY ELEMENTARY SCHOOL SlTE 

In order to provide potable water, irrigation, wastewater and additional fire protection services to the Phillis Wheatley Elementary School site, the Board must install and connect a water transmission main, one fire hydrant, gravity sewer laterals and other appurtenances to the existing Miami-Dade County (County) infrastructure (see location map).

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent or his designee to execute an agreement with Miami-Dade County and the execution of relevant conveyance documents for the provision of water and wastewater services for planned improvements at the Phillis Wheatley Elementary sd10ol site, at an approximate cost of $289.500 which is included in the construction contract.

E-2 APPOINTMENTS AND LATERAL ASSIGNMENTS OF MANAGERIAL EXEMPT, PROFESSIONAL, AND TECHNICAL PERSONNEL FOR 2001-2002

The following recommendations are made in accordance with Board Rules 6Gxl3-4A-1.16, 6Gxl3-4A-1.161, and the Miami-Dade County Public Schools/Dade County School Administrators’ Association labor contract.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the recommendations as set forth above for appointments and lateral transfers, to be effective December 13, 2001, or as soon thereafter as can be facilitated.


AGENDA ITEMS REPLACED AFTER PUBLICATION OF THE AGENDA:

A-2 ESTABLISH AN OFFICE OF PERFORMANCE IMPROVEMENT AND RESEARCH THE ESTABLISHMENT OF AN EFFICIENCY AND COMPETITION COMMISSION

At its September 12, 200l meeting, the School Board earmarked $500,000 in its 2001-2002 budget for an Office of Planning and Budgeting to advise the Board on resource allocation and program decisions and to verify information presented by the Superintendent.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1.  establish an Office of Performance Improvement, headed by a staff member reporting directly to the Superintendent of Schools, to generate cost savings, more effective operations and better service delivery throughout the district; and

2.  direct the Superintendent to review the structure of Miami-Dade County’s Efficiency and Competition Commission and return to the Board in January 2002 with a recommendation for a similar commission.

A-3 REQUEST FOR AUTHORIZATION TO ISSUE A REQUEST FOR QUALIFICATIONS PROPOSALS FOR AN EXECUTIVE SEARCH FIRM FOR THE SELECTION OF THE PERMANENT SUPERINTENDENT OF SCHOOLS

At the School Board meeting of October 24, 2001, Agenda Item Replacement K-3, the Board authorized the Superintendent to initiate the selection process for the position of Superintendent of Schools.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1.  authorize the Superintendent to issue a Request for Qualifications Proposals for an executive search firm for the selection of the permanent Superintendent of Schools; and 

2.  approve the screening committee that will review the proposals for subsequent submission to the School Board, who will make the final selection of the executive search firm.

The appropriations for the Request for Qualifications Proposals are included in the General Fund of the 2001-2002 Adopted Budget.

A-7 RESULTS OF THE SECOND SPECIAL LEGISLATIVE SESSION AND RESOLUTION NO. 1, 2001-92 GENERAL FUND

The first special legislative session was adjourned by both chambers on October 30, 2001. On that date, the House on third reading adopted the Senate’s version of a revised appropriations bill cutting state expenses by $800 million and using $500 million from the Budget Stabilization Fund to make up the difference in projected lower state revenue.

RECOMMENDED: That The School Board of Miami-Dade County, Florida,

1.  adopt Resolution No. 1, 2001-02 General Fund Budget Review by reducing revenues and appropriations by $73,224,204.

2.  resolve that there is an urgent need to transfer unused funds from Public School Technology and Teacher Recruitment/Retention to maintain existing class-size in academic classroom instruction.

Miami-Dade County Public Schools originally developed the magnet program/school concept into an effective tool for balancing racial-ratios. Board Rule 6Gx13-6A-1.46, Magnet Programs/Schools, specifically delineates policy and procedures for magnet student enrollment to include administrative procedures that further the district’s previously Court-ordered desegregation goals.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to initiate rulemaking proceedings in accordance with the Administrative Procedure Act to amend Board Rule 6Gx13- 6A-1.46, Magnet Programs/Schools.

C-3 AUTHORIZATION FOR THE SUPERINTENDENT TO ACCEPT THE REQUEST FOR TERMINATION OF THE COOPERATIVE AGREEMENT BETWEEN THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, AND MIAMI-DADE COUNTY FOR THE OPERATION OF THE MIAMI INTERNATIONAL AIRPORT SATELLITE LEARNING CENTER

A cooperative agreement between The School Board of Miami-Dade County, Florida, and Miami-Dade County to operate the Miami international Airport Satellite Learning Center was initially approved on October 4, 1988, with the most current amendment approved on June 30, 2001, for the 2001-2002 school year.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1.  authorize the Superintendent to accept the request for termination of the cooperative agreement between The School Board of Miami-Dade County, Florida, and Miami-Dade County for the operation of the Miami International Airport Satellite Learning Center as of December 31,200l; and

2.  authorize the Superintendent to facilitate the transition of the Miami International Airport Satellite Learning Center students to either their home school, Melrose Elementary School or The Doral Academy, effective January 1, 2002.

C-15 SUBMISSION OF A CHARTER SCHOOL APPLICATION FOR SNAPPER CREEK ELEMENTARY SCHOOL WITH RECOMMENDATlON FOR DENIAL

As established in School Board Rule 6Gx13-6A-1.47, Charter Schools, Miami-Dade County Public Schools received charter school applications from individuals and/or organizations from the community.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, deny the charter school application submitted for Snapper Creek Elementary School.

C-16 SUBMISSION OF UTD-EDISON CHARTER SCHOOLS’ LOCATIONS

On December 13, 2000, The School Board of Miami-Dade County, Florida, approved two charter school applications for the establishment of nine UTD-Edison Charter Schools and authorized the Superintendent to negotiate the charter school contractual agreements with the applicant.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1.  approve the charter school locations recommended for approval by the Superintendent; and

2.  deny the charter school locations recommended for denial by the Superintendent.

G-64 AWARD REQUEST FOR PROPOSALS NO. 023-BB10 - COUNSELING SERVICES FOR REFUGEE STUDENTS AND THEIR FAMILIES

The purpose of this Request For Proposals, opened on November 27, 2001, is to establish a contract, to provide weekly group and/or individual counseling to refugee students and their families, who have been affected by trauma, for the Division of Student Services.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, AWARD Request For Proposals No. 023-BB10 - COUNSELING SERVICES FOR REFUGEE STUDENTS AND THEIR FAMILIES, to provide weekly group and/or individual counseling to refugee students and their families, who have been affected by trauma, for the Division of Student Services, during the term of the proposal, effective December 12, 2001, through December 11, 2002, as follows:

J-2 DISCUSSION OF PROCEDURES PERTAINING TO SCHOOL BOARD RULE 6GX13-8C-1.23, SCHOOL BOARD COMMITTEE STRUCTURE

On December 10, 1997, The School Board of Miami-Dade County, Florida, promulgated School Board Rule 6Gx13-8C-1.23, School Board Committee Structure. Since that time, the Board has utilized the committee structure and procedures outlined in the Board Rule.

ACTION PROPOSED BY MS. PERLA TABARES HANTMAN: That The School Board of Miami-Dade County, Florida:

1)  discuss procedures to be included in School Board Rule 6Gxl3-8C-1.23, School Board Committee Structure prior to amending the Rule; and

2)  authorize the Superintendent to amend School Board Rule 6Gx13-8C-1.23, School Board Committee Structure to be brought back to the January 16, 2002 meeting for initial reading.

J-6 REQUEST FOR APPROVAL OF RESOLUTION NO. 0142 OF THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, HONORING DR. MODESTO A. MAIDIQUE, FOR HIS FIFTEEN YEARS AS PRESIDENT OF FLORIDA INTERNATIONAL UNIVERSITY AND FOR HIS MANY CONTRIBUTIONS TO OUR COMMUNITY AND TO PUBLIC EDUCATION IN SOUTH FLORIDA

Dr. Modesto A. Maidique, has served as the president of Florida International University (FIU) for the past fifteen years and has made outstanding contributions to this community in general, but to Miami-Dade County Public Schools in particular.

ACTION PROPOSED BY FRANK J. BOLAÑOS: That The School Board of Miami-Dade County, Florida, approve Resolution No. 01-52 of the School Board of Miami-Dade County, Florida, honoring Dr. Modesto A. Maidique, for his fifteen years as president of Florida International University and for his many contributions to our community and to public education in South Florida.

J-9 DISCUSSION OF PROVISIONS SET FORTH IN THE MANUAL OF PROCEDURES FOR MANAGERIAL EXEMPT PERSONNEL (MEP), SCHOOL BOARD RULE 6GX13-4D-1.022, COMPENSATION AND RELATED BENEFITS

As provided in School Board Rule 6Gx13-4D-1.022, Compensation and Related Benefits, as specifically set forth in the Manual of Procedures for Managerial Exempt Personnel (MEP), the Superintendent has the authority to reorganize administrative staff.

ACTION PROPOSED BY MS. PERLA TABARES HANTMAN: That The School Board of Miami-Dade County, Florida:

1)  review and discuss procedures in Section B Compensation System of the document, Manual of Procedures for Managerial Exempt Personnel (MEP), which is incorporated by reference and is a part of School Board Rule 6Gx13-4D-1.022; and 

2)  authorize the Superintendent, if appropriate, to amend Section B Compensation System of the aforementioned document, Agenda Item A-6, which is presented for Initial Reading at today’s meeting, in order to reflect the amended language at its Final Reading on January 16, 2002.
