Under the Adult Education Act, the Workforce Development Division of the Florida Department of Education (FDOE) provides performance-based grants to all eligible educational agencies for programs that address one or more of the national or state adult education priorities. In conjunction with this initiative, the FDOE recommends that eligible agencies form a collaborative partnership or consortium to better tailor their service to the multiple needs of the community. The programs offered must be consistent with federal and state educational goals and must clearly demonstrate that funds will supplement, not supplant, local program efforts.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1) accept a grant award from the Florida Department of Education, Division of Workforce Development, in the amount of $3,200,000, for funding under the Adult Education Supplemental Program of the Adult Education and Family Literacy Act of 1998, in the amount of $3,200,000; and enter into individual contractual agreements with the Coalition of Florida Farm workers Organization, Inc., in the amount of $75,000; One Nation, Inc., in the amount of $59,500; the Greater Miami Service Corps, in the amount of $50,000; James E. Scott Community Association, in the amount of $85,000; ASPIRA of Florida, Inc., in the amount of $50,000; Miami-Dade Community College, in the amount of $800,000; and Learn-to-Read Volunteers of Miami, Inc., in the amount of $98,200, July 1, 1999 - September 30, 2000; and
2) Financial Affairs to establish appropriations in the amount approved by the granting agency; such appropriations to be reported periodically to the Board.

K-4 ACCEPTANCE OF RESIGNATION SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA v. KATHLEEN MIGON, DOAH CASE NO. 99-0755

At its regularly scheduled meeting of February 10, 1999, the School Board took action to suspend and dismiss teacher Kathleen Migon from all employment for just cause including, but not limited to, misconduct in office and willful neglect of duty. The employee requested a hearing which was scheduled for December 8, 1999. On October 12,1999, the teacher tendered her resignation from the Miami-Dade County Public Schools, effective October 12, 1999.

RECOMMENDED: That The School Board of Miami-Dade County, Florida accept the resignation of Kathleen Migon, teacher at Campbell Drive Middle School, effective October 12, 1999, at the close of the workday.

K-5 APPROVAL OF SETTLEMENT AGREEMENT SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA V. ANNIE G. GLOVER - CASE NO. DH 98-018 ALTER

At its regularly scheduled meeting of June 23, 1999, the School Board took action to suspend without pay and initiate dismissal proceedings against Annie G. Glover, a cafeteria manager at Earlington Heights Elementary School. Ms. Glover requested a hearing. The parties have reached an agreement, subject to School Board approval.

RECOMMENDED: That the School Board of Miami-Dade County, Florida, approve and authorize the School Board Attorney to execute the Agreement with Annie Glover, DH-98-018 ALTER

A-1 CLOSE SENIOR HIGH SCHOOL CAMPUSES

At the Board meeting of April 14, 1999, the Board directed the Superintendent of Schools to close all senior high school campuses for lunch by the fall of 2001.

Subsequently, at the June 23, 1999, School Board meeting, many logistical issues related to facilities, personnel, and security were raised.

RECOMMENDED:
That The School Board of Miami-Dade County, Florida, approve the plan of action to close all senior high school campuses by the opening of the school year 2004-2005.

A-3 2000 STATE AND FEDERAL LEGISLATIVE PROGRAMS

The attached 2000 State and Federal Legislative Programs have been compiled from responses and recommendations solicited by Legislative and Labor Relations from School Board Members, the Superintendent and staff, interested citizen groups and community agencies, and employee organizations.

The work papers form the nucleus of the School Board’s 2000 Legislative Programs. The October 20,1999 final adoption date will enable staff to move ahead in securing legislative sponsors, if necessary, for the proposed bills so they may be led and presented at legislative committee meetings.

RECOMMENDED:
That The School Board of Miami-Dade County, Florida:

1. establish as its number one priority for the 2000 Legislative Session the recommended core financial provisions of FEFP;
2. select no more than five additional proposals as priority items; and
3. authorize the Superintendent to formulate its final 2000 State and Federal Legislative Programs.

B-5 CLOSING OF HIGH SCHOOL CAMPUSES DURING LUNCH HOURS

At the Board Meeting of April 14, 1999, the Board directed the Superintendent of Schools to close all high school campuses for lunch by fall of 2001.

The problem of juvenile violence is a critical and growing problem. The citizens of our society are being jeopardized by crime and violence for no particular reason.

The parents of this community have entrusted their children to our schools and we, as elected officials, have the responsibility to ensure a safe learning environment. The massive response that we have obtained with the collection of signatures in which we overpassed our initial goal of 20,000 signatures as of October I”, has inspired me to transmit this appeal to my colleagues on this Board.

ACTION PROPOSED BY DEMETRIO PEREZ, JR.: That The School Board of Miami-Dade County, Florida, instruct the Superintendent to close all high school campuses during lunch hours.

E-2 APPOINTMENTS AND LATERAL ASSIGNMENTS OF MANAGERIAL EXEMPT, PROFESSIONAL, AND TECHNICAL PERSONNEL FOR 1999-2000

The following recommendations are made in accordance with Board Rules 6Gx134A_1.16.6Gx13-4A-1.161, and the Miami-Dade County Public Schools/Dade County Schools Administrators’ Association labor contract.

Considerations for reassignments of managerial exempt, professional, and technical personnel were predicated upon an intensive review of information by the appropriate administrators and the Superintendent of Schools.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the recommendations as set forth above for appointments and lateral transfers, to be effective, October 21, 1999, or as soon thereafter as can be facilitated.

E-12 APPOINT AND ASSIGN:
PROJECT MANAGER,

The following recommendation is made in accordance with the Miami-Dade County Public Schools/Dade County Schools Administrators’ Association labor contract.

This open budgeted position is due to the promotion of the incumbent.

Mr. Robert B. Keiser, currently a Project Supervisor I, Systems and Programming Services, pay grade 41, Office of Information Technology, is recommended for appointment to the open, budgeted position of Project Manager, Systems and Programs. Pay grade 43, Office of Information Technology. Mr. Keiser received a Bachelor of Science Degree from Florida State University, Tallahassee, Florida. Since 1984 to the present, Mr. Keiser has been employed by Miami-Dade County Public Schools as a Programmer/Analyst, a Senior Programmer/ Analyst, a Manager III, and a Project Supervisor I, his current position.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint Mr. Robert B. Keiser, currently a Project Supervisor I, pay grade 41, to the open, budgeted position of Project Manager, Systems and Programs, pay grade 43, 12 months, and assign to the Office of Information Technology, effective October 21,1999, or as soon thereafter as can be facilitated.

E-18 ACCEPTANCE OF RESIGNATION

Subsequent to the October 5, 1999, notification to Mr. Brett Hancock, from the Superintendent of Schools, that he would be recommended for dismissal on October 20, 1999, for just cause, including but not limited to gross insubordination, misconduct in office, violation of School Board Rule 6Gx13-5D-1.07, Corporal Punishment, and labor contract, Safe Physical Management Provisions, he has submitted a letter of resignation from the Miami-Dade County Public Schools, effective October 13, 1999.

RECOMMENDED:
That effective October 15, 1999, at the close of the workday, the School Board of Miami-Dade County, Florida accept the resignation of Mr. Brett Hancock, Teacher, at Robert Renick Educational Center

E-23 ACCEPTANCE OF RESIGNATION

Subsequent to the October 11, 1999, notification to Ms. Mary T. Murgo, from the Superintendent of Schools, that she would be recommended for dismissal on October 20, 1999, for just cause, including, but not limited to, failure to remediate deficiencies during the SO-Calendar Day Performance Probation on October 20,1999, she has submitted a letter of resignation from the Miami-Dade County Public Schools, effective October 20, 1999.

RECOMMENDED: That effective October 20, 1999, at the close of the workday, the School Board of Miami-Dade County, Florida accept the resignation of Ms. Mary T. Murgo, Teacher, at North Miami Senior High School.

G-64 REQUEST AUTHORIZATION TO UTILIZE OTHER ENTITY BIDS FOR PURCHASES OVER $100,000

Authorization is requested to utilize the State of Florida Contract #863-000-99-l -TIRES, which expires on March 14, 2002, to purchase tires, for the Department of Transportation. This contract includes a comprehensive list of tires, in various sizes. Manufacturers bid direct offering local dealers factory prices. There would not be any economic incentive for the district to develop its own bid. The amount of these purchases will be $550,000 and will be purchased from Martino Tire Company of Miami, Florida, and Miami Tiresoles, Inc., of Hialeah Gardens, Florida.

RECOMMENDED:
That The School Board of Miami-Dade County, Florida, AUTHORIZE the Bureau of Procurement and Materials Management, to utilize the following contracts:

1. State of Florida Contract #863-000-99-l - TIRES, to purchase tires, for the Department of Transportation, for a total amount of $550,000.
2. Prison Rehabilitation and Diversified Enterprises, Inc., (PRIDE), to purchase recapped tires, for the Department of Transportation, for a total mount of $275,000.
3. Prison Rehabilitation and Diversified Enterprises, Inc., (PRIDE), to purchase bus seat covers, for the Department of Transportation, for a total amount of $200,000.
4. State of Florida Contract #250-050-97-l - -Computers: Midrange and Mainframe, to purchase a Legacy Web Server, for the Office of Information Technology, for a total amount not to exceed $632,600.
5. State of Florida Contract #99-233s - Installed Surveillance Cameras and Accessories, to purchase CCTV security camera systems for Maintenance and Operations for Miami Norland Senior High School, for a total amount of $121,974.


G-100 AWARD OF BID #036-2204 - TELECONFERENCING BRIDGES, PROVIDE AND INSTALL (RE-BID)

The purpose of this bid, opened on August 24, 1999, is to establish a contract, to provide and install, at firm unit prices, quantities, as may be required, of teleconferencing bridges for Merrick Educational Center. This is a term bid which states that the Board may purchase quantities, as may be required, at the unit price bid, but is not obligated to purchase any guaranteed amount. Of 83 vendors sent bid forms or card notices of this advertised bid, 15 responded, with 3 bids meeting specifications and 12 no bids.

RECOMMEND:
That The School Board of Miami-Dade County, Florida, AWARD Bid #036-1204 - TELECONFERENCING BRIDGES, PROVIDE AND INSTALL (RE-BID), to provide and install, at firm unit prices, quantities, as may be required, of teleconferencing bridges, for Merrick Educational Center, effective October 20, 1999, through December 31, 2000, as follows:

H-1 SUBJECT: REQUEST AUTHORIZATION TO EXPAND THE DISTRICT’S GUARANTEED ENERGY
PERFORMANCE CONTRACTING (GEPC) PROGRAM AND ASSIGN ADDITIONAL. WORK TO
ENERGY-SERVICES COMPANIES

In September 1996, following the required evaluation and selection process, the School Board awarded contracts
to three energy services companies (ESCOs) to implement a pilot GEPC program. The purpose of the pilot program
was threefold: 1) to determine the actual cost-effectiveness of the GEPC concept 2) to build an empirical database for
future reference and 3) to select the best ESCO.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. incorporate Guaranteed Energy Performance Contracting (GEPC) into the district’s Utilities Cost Containment
Program;
2. assign additional GEPC work to FPL Energy Services, Inc. and Siemens Building Technologies, Inc. (formerly known as Landis & Staefa, Inc.);
3. negotiate GEPC scope of work, terms and conditions and servicing with the energy-services companies for
projects at 27 schools with a composite capital-recovery period not to exceed 10 years at a capital cost not to
exceed $18,000,000;
4. submit contracts for final School Board approval, upon conclusion of negotiations;
5. implement annual service agreements, as specified in the contracts submitted for final School Board approval;
6. modify, as necessary, the GEPC-program scope of work in order to enhance its benefits to the district;
7. develop a request for qualifications and proposals to select energy-services companies for subsequent GEPC
phases;
8. require that energy services companies provide letters of credit to guarantee the contractual savings; and
9. provide an annual status report to the School Board regarding the GEPC program.

I-1 PRE-QUALIFICATION OF CONTRACTORS FOR EDUCATIONAL FACILITIES CONSTRUCTION

On December 9,1998, The School Board of Miami-Dade County, Florida adopted School , Board Rule 6Gx13-7D-1.05,
Pre-Qualification of Contractors for Educational Facilities Construction. This rule was created pursuant to Section 235.31
of the Florida Statutes and State Requirements for Educational Facilities (1997) which require school districts to pre-qualify
contractors prior to their bidding on school work. This new law became effective July 1, 1998.

The following contractors have submitted all required information and are being recommended for pre-qualification.

J-1 ACCEPT THE CONVEYANCE OF CERTAIN REAL PROPERTY AND AUTHORIZE THE EXECUTION OF A LEASE AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION FOR THE EXPANSION OF THE BOOKER T. WASHINGTON SENIOR HIGH SCHOOL CAMPUS

Due to the ongoing expansion of the Booker T. Washington Senior High School campus, the Office of Capital Improvement Projects requested that the 25’ wide abandoned railroad right-of-way located between N.W. 1 I Terrace and N.W. 14 Street (see attached location map), be acquired to allow for the construction of necessary parking and recreational facilities. The land is currently owned by the State of Florida Department of Transportation (FDOT), which has indicated a willingness to make the entire parcel available to the District through a combination of long term lease (approximately 100 feet), and direct conveyance (the balance of the parcel), subject to the terms and conditions of existing telecommunication company tight-of-way and operating agreements. These right-of-way and operating agreements were granted prior to the ownership of the parcel by FDOT to allow MCI Telecommunications Corporation (MCI), World Corn Network Services, Inc. (World Corn), and U.S. Sprint (Sprint) to service and maintain their fiber-optic cables, which are buried within the parcel. As a result, the telecommunication company vendors may require access to the school site from time to time for cable maintenance purposes.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. accept the conveyance of the subject parcel from the State of Florida Department Of Transportation
for $1.00, and under the terms and conditions set forth above; and

2. authorize the Superintendent or his designee to execute a lease agreement with the State of Florida
Department of Transportation for the expansion of the Booker T. Washington Senior High School campus, at an
annual rental amount of $1.00, and under the terms and conditions set forth above.


AGENDA ITEMS REPLACED AFTER PUBLICATION OF THE AGENDA:

B-4 REQUEST FOR APPROVAL OF RESOLUTION NO. 99-45 OF THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, SUPPORTING BUCKLE UP AMERICA’S PRESIDENTIAL SEAT BELT INITIATIVE AND THE GOALS OF THE DEPARTMENT OF TRANSPORTATION’S NATIONAL HIGHWAY TRAFFIC SAFETY ADMINISTRATION TO MAKE OPERATING A VEHICLE WHILE UNRESTRAINED BY A SEAT BELT, OR WHILE HAVING UNRESTRAINED PASSENGERS, A PRIMARY OFFENSE

According to Buckle Up America’s First Report to Congress (BUAFRC), someone in America is injured in a traffic accident every 14 seconds and killed every 12 minutes. The report also states that these numbers are higher for Hispanics and African-Americans, a fact that is of great consequence to Miami-Dade County. Motor vehicle accidents are a leading cause of death among Hispanics through age 24 and the second leading cause of death for ages 24-44. Vehicular accidents are the leading cause of death for blacks through age 14 and the second leading cause of death for ages 15-25. (Monthly Vital Statistics Report for 1995, CDC, 1997)

ACTION PROPOSED BY DR. MARTA PEREZ:
That The School Board of Miami-Dade County, Florida approve Resolution No. 99-45 of The School Board of Miami-Dade County, Florida, supporting the efforts of Buckle Up America’s Presidential Seat Belt Initiative and the goals of the Department of Transportation’s National Highway Traffic Safety Administration to make operating a vehicle while unrestrained by a seat belt, or while having unrestrained passengers, a primary offense.

B-12 DEVELOP A MISSION AND VISION STATEMENT FOR THE MIAMI-DADE COUNTY SCHOOL BOARD

As the new millennium approaches, the Miami-Dade County School Board has the opportunity to be the most influential agency in making this county an excellent community in which to live and work. The first step in creating the blueprint for this goal is for the board to unite as policy makers under a distinct vision and mission statement. For this reason, it is proposed that we adopt a reminder to our community of the vision and mission of this school board.

ACTION PROPOSED BY DR. MARTA PEREZ:
That The School Board Of Miami-Dade County, Florida:

1.adopt the proposed vision and mission statement to serve the stated purpose; or
2.plan to develop a vision and mission statement during the District Strategic Planning Retreat; and

This open budgeted position is due to the conversion of an open authorized position.

Dr. Anthony Machado, currently a Supervisor, Communication Services, MEP pay grade 20, is recommended for appointment to the open, budgeted position of Director, Communications Services, MEP pay grade 21. Dr. Machado received a Bachelor of Arts Degree, a Master of Education Degree, and a Doctor of Education Degree from Florida International University, Miami, Florida. From 1988 to 1997, Dr. Machado was employed by BellSouth Telecommunications, Inc., Miami, Florida, as a Service Manager. Since 1997 to the present, Dr. Machado has been employed by Miami-Dade County Public Schools as a Supervisor, Communication Services, his current position.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint Dr. Anthony Machado, currently a Supervisor, Communication Services, MEP pay grade 20, to the open budgeted position of Director, Communication Services, MEP pay grade 21,12 months, and assign to the Office of Information Technology, effective October 21, 1999, or as soon thereafter as can be facilitated.

Ms. Jodi Ann Bolla, currently a teacher at Linda Lentin Elementary School, is recommended for appointment to the open, budgeted position of Instructional Support Specialist (Reading), MEP pay grade 20. Ms. Bolla received a Bachelor of Science Degree from Eastern Michigan University, Ypsilanti, Michigan; and Master’s of Science Degrees from Florida International University, Miami, Florida, and Nova Southeastern University, Fort Lauderdale, Florida. Since 1993 to the present, Ms. Bolla has been employed by Miami-Dade County Public Schools as a teacher, her current position.

RECOMMENDED:

E-26 REQUEST FOR AUTHORIZATION TO ENTER INTO A PERSONNEL ASSIGNMENT AGREEMENT WITH THE DADE PUBLIC EDUCATION FUND FOR THE FAMILY TECH PROGRAM

At the School Board Meeting of August 27, 1997, Agenda Item C-5, the Board authorized a contractual agreement with the Dade Public Education Fund for Family Tech, a program funded by the south Florida Annenberg Challenge, using matching funds from Miami-Dade County Public Schools. Additionally, at the School Board meeting of October 22,1997, the Board authorized Agenda Item E-3, A Personnel Assignment Agreement with the Dade Public Education Fund for the Family Tech Program. The Dade Public Education Fund is the fiscal agent for the Family Tech Program.

RECOMMENDED:
That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into a Personnel Assignment Agreement with the Dade Public Education Fund for:

During the October 1997 Special Session, the Florida Legislature created section 235.185, Florida Statutes, which requires each district to adopt a five-year facilities work program. The format of the work program has been promulgated by the Smart Schools Clearinghouse which was also established by the Legislature.

H-11 REQUEST SCHOOL BOARD INTERVENE IN LAWSUIT -- THE DADE COUNTY SCHOOL
ADMINISTRATORS’ ASSOCIATION (DCSAA) V. STATE OF FLORIDA PUBLIC EMPLOYEES
RELATIONS COMMISSION (PERC) --CASE NO. 90-2204

The Dade County School Administrators’ Association on June 4.1999 filed a complaint for declaratory judgement in
Leon County requesting that provisions of Florida Statutes, Chapter 447, which preclude principals and assistant
principals from engaging in collective bargaining, be declared unconstitutional.

In August 1993, a hearing was held before a circuit judge in Leon County, Florida regarding the complaint. Prior to
issuing a final order, the judge allowed the parties to continue the hearing. In June 1999, DCSAA filed a Notice of Hearing
requesting that the case be considered by the judge. A hearing was held before a new circuit judge in Leon County in August
1999. The judge has set a bench trial for the first two weeks in December 1999. Since principals and assistant principals are
essential to the operations of the school system, it is recommended that the School Board authorize the Superintendent to
instruct the Chief Officer of Legislative and Labor Relations to file a Motion to Intervene in the lawsuit to assist the State
Attorney General in his representation of the State and the School Boards interest in upholding the constitutionality of the
statutes which exclude principals and assistant principals from collective bargaining.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to instruct
the Chief Officer for Legislative and Labor Relations to file a Motion to Intervene in the lawsuit styled DCSAA v. State of
Florida PERC -- Case No. 90-2204 in Leon County, Florida. REPLACEMENT H-l 1 (formerly B-2)
