Members of the Miami-Dade County, Florida, School Board, governing one of the largest School Districts in the nation, are required to be prepared to discuss and vote on a myriad of issues at each regularly scheduled meeting that often involve complex and detailed matters. In order to be as fully prepared as possible to make public policy decisions on issues affecting the District’s administration, and the quality of education of our children, it is desirable to afford every opportunity available for the Members to obtain as much information as possible on which to base these decisions.

ACTION PROPOSED BY DR. MARTA PEREZ
That The School Board of Miami-Dade County, Florida, direct the Superintendent to:

1. Provide Board members with written notice of the time, date and place of professional senior staff meetings at which agenda items will be discussed, at least 72 hours prior to said meeting; and
2. That the Superintendent, or his/her designee, be authorized to convene meetings with less than 72 hours notice only upon written certification, immediately published to the Board Members, that the timing of the meeting was necessary for the proper administration of the District’s business. This certification should include relevant information on the time, date and place of the meeting.


B-6 NEWS MEDIA RELATIONS

On the first page of the Media List of Miami-Dade County Public Schools, September 1999, there is a message from the Deputy Superintendent of Schools on News Media Relations. It states: II . . . maintaining a good working relationship with the news media is important. Such a relationship can pay off in added opportunities to communicate the many good things happening in [our] schools and in times of crises, can give you a greater opportunity to have your side of the story told.”

ACTION PROPOSED BY DR. MICHAEL KROP: That the Superintendent return to the Board at the meeting of March 15, 2000 with a recommendation to establish the position of a facilitator for members of the press and others seeking valid information; and further, return to the Board with his recommendation of an individual to fill the position no later than the board meeting of May 17, 2000.

E-25 DEMUTUALIZATION OF METROPOLITAN LIFE INSURANCE COMPANY

On September 28, 1999, MetLife’s Board of Directors voted unanimously to adopt a plan to convert MetLife from a mutual insurance company to a stock insurance company. This process is often referred to as demutualization. This process will allocate 100 percent of the stock of the company at the time of demutualization to eligible policyholders to be paid in the form of stock, cash or policy credits. The School Board of Miami-Dade County, Florida was notified in January, 2000 that it is an eligible policyholder.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. vote for demutualization of Metropolitan Life Insurance Company (MetLife) to convert from a mutual company to a stock company; and
2 . approve the election to receive cash for 256,258 shares of common stock, valued at the price at which the common stock is sold to the public at the initial public offering (IPO).

RAQUEL C. CEASON - SCHOOL BUS DRIVER
SOUTHWEST TRANSPORTATION CENTER

On January 26,2000, the Superintendent of Schools sent the following letter to Ms. Raquel C. Ceason:

I am exercising my responsibility as Superintendent of Schools and recommending to The School Board of Miami-Dade County, Florida, at its scheduled meeting of February 9,2000, that the School Board suspend you and initiate dismissal proceedings against you from your current position as School Bus Driver at Southwest Transportation Center, effective at the close of the workday, February 9, 2000, for just cause, including, but not limited to, nonperformance and deficient performance of job responsibilities, violation of School Board Rules, 6Gx13-4A-1.21, Responsibilities and Duties, and 6Gx13-3E-1 .I 0, Transportation-Specific Procedures, specifically Zero Tolerance for failure to conduct post-trip inspections. This action is taken in accordance with Sections 230.03(2), 230.23(5)(f), 231.3605, and 447.209, Florida Statutes. Revise

RECOMMENDED: That effective February 9, 2000, at the close of the workday, that School Board suspend and initiate dismissal proceedings against Ms. Raquel C. Ceason, School Bus Driver, at Southwest Transportation Center, pending the outcome of a hearing, if requested.

E-15 ACCEPTANCE OF RESIGNATION

Subsequent to the January 26, 2000, notification to Ms. Raquel C. Ceason, from the Superintendent of Schools, that she would be recommended for dismissal on February 9, 2000, for just cause, including but not limited to, nonperformance and deficient performance of job responsibilities, violation of School Board Rule 6Gx13-4A-1.21,

Responsibilities and Duties. Ms. Ceason has submitted a resignation from the Miami-Dade County Public Schools, effective January 24, 2000. Upon consultation with the School Board Attorney, the Office of Professional Standards recommends that the resignation be accepted as achieving the objectives sought by the School Board in this case. Acceptance of the resignation does not alter the following effects of the employment termination:

RECOMMENDED: That effective February 9, 2000, at the close of the workday, the School Board of Miami-Dade County, Florida accept the resignation of Ms. Raquel C. Ceason, School Bus Driver, at Southwest Transportation Center.

J-1 AUTHORIZATION TO NEGOTIATE A DECLARATION OF RESTRICTIONS AND NECESSARY AGREEMENTS FOR APPLICATION NO. 99-3/LAND USE AMENDMENT NO. 6, SUCHMAN REAL ESTATE COMPANY, FOR THE PROVISION OF LAND FOR A FUTURE MIDDLE SCHOOL SITE WITH A PORTION AS A VOLUNTARY CONTRIBUTION IN ADDITION TO EDUCATIONAL FACILITIES IMPACT FEES

Suchman Real Estate Company, is requesting a land use change from agriculture to low density residential and industrial and office for 127.87 acres located west of S.W. 157 Avenue and south of S.W. 136 Street (see attached location map). The proposed 500-unit single family residential development is consistent with the Miami-Dade County Comprehensive Development Master Plan (CDMP) and is within the current Urban Development Boundary.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1) negotiate a Declaration of Restrictions for Application No. 99-3, Land Use Amendment No. 6, Suchman Real Estate Company, for the provision of a H-acre site within the proposed development, of which six acres will be a donation over and above impact fees; and
2) negotiate necessary agreements for the balance of the acreage (nine acres) to be purchased by the District at a purchase price equal to the average of the fair market values of the property in its “as is” condition at the time of property transfer, as established by two District-commissioned appraisals. Prior to property transfer, an agenda item for the purchase agreement will be presented to the Board for its consideration.


J-2 AUTHORIZATION TO EXECUTE A LEASE AGREEMENT WITH TEMPLE ISRAEL OF GREATER MIAMI, INC., FOR USE OF BOARD-OWNED LAND FOR EDUCATIONAL AND RECREATIONAL PURPOSES

The Board, at its meeting of December 8, 1999, authorized the Superintendent or his designee to negotiate a lease agreement with Temple Israel of Greater Miami, Inc. (Temple Israel), for use of the former Miramar Elementary School property. In addition, the Superintendent was directed to bring the fully negotiated lease agreement back to the Board for review and authorization. Based on this direction., this negotiated a lease agreement with Temple Israel that includes the following terms and conditions:

RECOMMENDED:
That The School Board of Miami-Dade County, Florida, authorize the Superintendent or his designee to execute a lease agreement with Temple Israel of Greater Miami, Inc., for the use of Board-owned land for educational and recreational purposes, at an annual rental amount of $1, and under the terms and conditions set forth above.

J-27 COMMISSIONING OF POST, BUCKLEY, SCHUH & JERNIGAN CONSTRUCTION SERVICES, INC. TO PERFORM COST ESTIMATING, SCHEDULING & DOCUMENT COORDINATION SERVICES

Staff has completed the selection process for consultants to perform Cost Estimating, Scheduling & Document Coordination Services.

Seven (7) firms applied and six (6) firms were interviewed by the A/E Service Committee. Of these six (6) firms, three (3) firms were selected as follows:

Post, Buckley, Schuh & Jernigan Construction Services, Inc.
Construction Estimating Services, Inc.
Construction Management Services, Inc.


RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1) commission the firm of Post, Buckley, Schuh & Jernigan Construction Services, Inc. to perform Cost Estimating, Scheduling & Document Coordination Services for a two
(2) year term, commencing February 18, 2000 and expiring February 17, 2002, for the negotiated provisions; 2) the agreement provides for cancellation by the Board with or without cause, upon thirty (30) days written notice to consultant. The consultant may terminate the agreement only with cause upon thirty (30) days written notice to the Board; and
3) the total billings under this contract are not to exceed $300,000 per year, without obligation by the Board to expend any specific amount


J-30 COMMISSIONING OF SPILLIS CANDELA & PARTNERS, INC. TO PROVIDE EDUCATIONAL FACILITIES COMPLIANCE OFFICER/UNIFORM BUILDING CODE INSPECTOR (EFCO/UBCI) SERVICES

Staff has completed the selection process for EFCO/UBCI consultant. Five (5) firms applied and five (5) firms were interviewed by the A/E Service Committee. Of these five (5) firms, four (4) were selected as follows:

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1) commission the firm of Spillis Candela & Partners, Inc. to provide Educational Facilities Compliance Officer/Uniform Building Code Inspector (EFCO/UBCI) services for the Board during the period of February 18, 2000 through February 17, 2002; and
2) the EFCO/UBCI will maintain at least a $1,000,000 Professional Liability Insurance Policy during the duration of the agreement, plus three (3) years after the acceptance any of the projects assigned to the EFCO/UBCI

J-32 APPROVAL OF AN EXCEPTION TO THE STANDARD SITE SIZE FOR LAWTON CHILES MIDDLE SCHOOL, SHADOWLAWN ELEMENTARY AND STATE SCHOOL GGG

Florida Statutes require that educational facilities be adequate in size to meet the educational needs of the students to be served. Pursuant to s.235.19 Florida Statute, as amended by the 1995 Legislature, the Florida Department of Education recommends standard site sizes for educational plants. Exceptions to recommended site sizes are allowed, provided the Board, by a two-thirds majority, recommends the site and finds that it can provide an appropriate and equitable educational program on such site.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

(1) approve the exception to the existing site size for the educational facilities referenced herein; and
(2) authorize the Superintendent to submit to the Commissioner of Education at the Florida Department of Education, the Board-approved site exceptions for the educational facilities referenced herein.

This request for change in the construction contract includes one item for the School Board’s confirmation. Attachment A presents a description of the item, the cause for the change, the effect upon the contract, and the action recommended to the Board. This item is presented to the Board for confirmation as required by State Statute.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, confirm Change Order No. 2 on Project No. A-0534, Addition, Remodeling And Renovation, Hialeah Elementary School for a credit of $346,626 and a time decrease of 71 days. This work will be performed by a different contractor.

J-44 AMENDMENT TO AGREEMENT WITH PEACOCK/COURTNEY ARCHITECTS, P.A. TO DECREASE THEIR ROLE DURING BIDDING AND CONSTRUCTION ADMINISTRATION FOR THE ADDITIONS, REV’S’ 1 REMODELING AND RENOVATIONS PROJECT AT MIAMI LAKES 4 MIDDLE SCHOOL PROJECT # A-0530

The firm of Peacock/Courtney Architects, P.A. are the original A/E’s commissioned by the Board to perform architectural/engineering services for the additions, remodeling and renovations project at Miami Lakes Middle School. The project is presently bidding via a Construction Management At-Risk method.

RECOMMENDED: That The School Board of Miami-Dade County, Florida approve the amendment to the agreement with Peacock/Courtney Architects, P.A. to decrease their role during bidding and II construction administration for the additions, remodeling and renovations project at Miami Lakes Middle School, for the following considerations:

1) negotiated fees as stated above;
2) all other terms and conditions of the Agreement remain the same; and
3) authorize the Superintendent to provide written notification of this action to Peacock/Courtney Architects, P.A.


K-20 PROPOSED AMENDMENT OF BOARD RULE: INITIAL READING 6Gx13-64.02, PHILOSOPHY AND GOALS

This item is submitted for consideration by the School Board as a result of recommendations by the Task Force on Career Education/School-to-Work. Revisions reflect the belief that all students should develop saleable skills and be life-long learners. Attached are the Notice of Intended Action and the rule proposed for amendment. Changes from the current rule are indicated by underscoring words to be added and . . v words to be deleted.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to initiate rulemaking proceedings in accordance with the Administrative Procedure Act to amend Board Rule 6Gx13-6-I .02, Philosophy and Goals.

K-21 PROPOSED AMENDMENT OF SCHOOL BOARD RULE: INITIAL READING 6Gx13- 3D-1.021, INTERNAL FUNDS-SPECIFIC PROCEDURES
This item is submitted for consideration by the Board to amend School Board Rule 6Gx13-Accounting for Elementary Schools and the Manual of Internal Accounting for Secondary Schools, which are incorporated by reference and are a part of this rule, to modify established policies and procedures, and to authorize principals to reallocate unspent Internal Funds balances to school-related projects not funded through tax funds.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint Ms. Euqenia Sanchez de Fuentes to the open, budgeted position of Budget Analyst, pay grade 43, 12 months, and assign to the Office of Budget Management, effective February 10, 2000, or as soon thereafter as can be facilitated.

SUPERVISOR, TELECOMMUNICATIONS

The following recommendation is made in accordance with Board Rule 6Gx13-4A-1.16.

This open budgeted position is open due to the promotion of the incumbent.

Mr. Michael Knost , currently a Senior Telecommunications Analyst, pay grade 41, Office of Information Technology, is recommended for appointment to the open, budgeted position of Supervisor, Telecommunications, MEP pay grade 20, Office of Information Technology. Mr. Knost received an Associate of Science Degree in Electrical Engineering from Miami Dade Community College, Miami, Florida. From 1987 to 1996, Mr. Knost was employed by BellSouth Telecommunications, Inc., Miami, Florida. From 1996 to 1998, Mr. Knost was the owner of MiRo Industries, Inc., Miami, Florida. Since 1998 to the present, Mr. Knost has been employed by Miami-Dade County Public Schools as a Senior Telecommunications Analyst, his current position.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint Mr. Michael Knost, currently a Senior Telecommunications Analyst, pay grade 41, to the open budgeted position of Supervisor, Telecommunications, MEP pay grade 20, 12 months, and assign to the Office of Information Technology, effective February 10,2000, or as soon thereafter as can be facilitated.

BUDGET ANALYST

The following recommendation is made in accordance with the Miami-Dade County Public Schools/Dade County Schools Administrators’ Association labor contract.

This open budgeted position is due to the lateral reassignment of the incumbent.

Ms. Eugenia Sanchez de Fuentes is recommended for appointment to the open, budgeted position of Budget Analyst, pay grade 43, Office of Budget Management. Ms. Sanchez de Fuentes received a Bachelor of Arts Degree in Accounting and a Master of Arts Degree in Accounting from St. Thomas University, Miami, Florida. From 1986 to 1993, Ms. Sanchez de Fuentes was employed by Storer Cable Communications, Inc., Miami, Florida, as a Senior Tax Accountant. Since 1993 to the present, Ms. Sanchez de Fuentes has been employed by American Bankers Insurance Group, Miami, Florida, as a Senior Tax Accountant, her current position.

RECOMMENDED:
That The School Board of Miami-Dade County, Florida, appoint Ms. Euqenia Sanchez de Fuentes to the open, budgeted position of Budget Analyst, pay grade 43, 12 months, and assign to the Office of Budget Management, effective February 10, 2000, or as soon thereafter as can be facilitated.

Ms. Aileen Ramirez-Boucle, currently a Coordinator II, Site Planning, pay grade 41, is recommended for appointment to the open, budgeted position of Coordinator, Construction Management, pay grade 40, Office of Capital Improvement Projects. Ms. Ramirez-Boucle received a Bachelor of Business Administration Degree and a Master of Science Degree from Florida International University, Miami, Florida. From 1997 to 1999, Ms. Ramirez-Boucle was employed by the Florida Department of Transportation, Miami, Florida. Since 1999 to the present, Ms. Ramirez-Boucle has been employed by Miami-Dade County Public Schools as a Coordinator II, Site Planning, her current position.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint Ms. Aileen Ramirez-Boucle, currently a Coordinator II, Site Planning, pay grade 41, to the open, budgeted position of Coordinator, Construction Management, pay grade 40 (career redirection), 12 months, and assign to the Office of Capital Improvement Projects, effective February 10, 2000, or as soon thereafter as can be facilitated.

E-9 RECOMMENDATION FOR INCREASE IN HOURLY FEE FOR CONTRACTED WORKERS’ COMPENSATION DEFENSE COUNSEL

The School Board of Miami-Dade County, Florida, moved from being fully insured, including defense costs for workers’ compensation claims, to becoming a State of Florida approved self-insured employer in 1974. Since then, the Board has paid claims, including wage replacement, medical care and defense costs out of its general fund, while purchasing excess coverage to respond in the event of a catastrophic claim.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. increase the hourly fee for Workers’ Compensation legal defense from its present rate for law services of $75/hour to $90/hour, effective March 1,2000, with all other fees for workers’ compensation defense, including paraprofessionals and law clerks to remain at $50/hour; and
2 . authorize staff to develop new legal services contracts, reflective of this rate for current and future firms who provide workers’ compensation defense, subject to a cancellation provision whereby the Board can cancel the contract at any time.


E-10 REQUEST FOR AUTHORIZATION TO ISSUE A REQUEST FOR INFORMATION (RFI) TO SEEK PROPOSALS FOR A TERMINAL LEAVE RETIREMENT PLAN

Miami-Dade County Public Schools has been made aware of various school districts within the State of Florida who have implemented a “terminal leave retirement plan”, consisting of an Internal Revenue Service (IRS) qualified 401(a) program that permits government employers to pay special forms of compensation, such as employee sick pay and annual leave, in a tax-advantaged manner. Staff would like to explore its ability to establish a similar program by seeking information from companies which could offer such a program through the construction of an IRS qualified 401 (a) program, as well as utilizing the Board’s existing 403(b) program.
RECOMMENDED: That The School Board of Miami-Dade County, Florida approve the issuance of a Request For Information (RFI) regarding the possible implementation of a Terminal Leave Retirement Plan by utilizing IRS qualified 401(a) and 403(b) investment programs.

The Florida Department of Education (FDOE) and the Ministry of Education and Culture of Spain (MECS) have invited selected teachers from Miami-Dade County Public Schools (M-DCPS) to participate in language and culture educational study programs in July 2000, at La Universidad Complutense de Madrid and La Universidad de Santiago de Compostela, in Spain. Fifteen teachers throughout the State will be awarded full scholarships to participate in these programs at highly recognized universities in Spain. However, because of Miami-Dade County Public Schools’ commitment to quality bilingual and multicultural education, the FDOE and MECS have approved the allocation of 20 full scholarships for M-DCPS teachers.
