The purpose and intent of this item is to direct the Superintendent to encourage the local business community, such as the local Chambers of Commerce, to cooperate with the district in urging the State and Federal government to increase its funding of M-DCPS.

COORDINATOR II,
OPERATIONS AND TRAINING

The following recommendation is made in accordance with the Miami-Dade County Public Schools/Dade County Schools Administrators’ Association labor contract. The Coordinator II, under the supervision of the Executive Director, Transportation Operations, monitors, the Department of Transportation fleet operations and training program and; monitors and evaluates data from automated systems and programs in order to improve overall efficiency of fleet operations.

COORDINATOR I,
TRANSPORTATION OPERATIONS

The following recommendation is made in accordance with the Miami-Dade County Public Schools/Dade County Schools Administrators’ Association labor contract. The Coordinator I under the general direction of the Center Director, is responsible for administering the resources and staff to provide safe, efficient, and economical transportation for all pupils entitled to daily transportation to and from school, and to other educational activities.

E-22 DISMISSAL OF EMPLOYEE

This dismissal is due to, but not limited to, conduct unbecoming a School Board employee, immorality, misconduct in office, and conviction of crime involving moral turpitude.

There is good cause to vary from the published agenda to allow Board Members, who have very hectic schedules, time to schedule review sessions with the Superintendent of Schools and School Board Attorney.

ACTION PROPOSED BY DR. MARTA PEREZ:
That the School Board of Miami-Dade County, Florida, exercise its right to review the performance of duties of the Superintendent of Schools and the School Board Attorney and discuss their performance at the June 21, 2000 Board Meeting.

E-23 (1) ESTABLISH AND CLASSIFY MANAGERIAL EXEMPT POSITION
(2) LATERAL TRANSFER

In an effort to continue to ensure that all students of Miami-Dade County Public Schools are provided learning environments that are secure, healthy, safe, and supportive of the mission of this district, it is recommended that the position of Assistant Chief, Facilities Support Services, MEP pay grade 26, be established and classified. This position will report to Dr. Paul Phillips, Chief Facilities Officer, Facilities Planning and Construction. The following departments and divisions will be assigned to this newly established position: the Department of Safety, Environment, and Hazards Management; the Department of Plant Operations, which will initiate the Facilities Support Teams; the Department of Asbestos Management; and the Division of Governmental Affairs and Land Use Policy and Acquisition.

RECOMMENDED: That effective April 13, 2000, or as soon thereafter as can be facilitated, The School Board of Miami-Dade County, Florida:

1. Establish and classify the managerial exempt position of Assistant Chief, Facilities Support Services, MEP pay grade 26; and
2 . Laterally transfer Mr. Delio G. Diaz, Region Superintendent, Region, I, to the newly established and classified position of Assistant Chief, Facilities Support Services, MEP pay grade 26, and assigned to Facilities Planning and Construction.


K-4 J. RUIZ SCHOOL BUS SERVICE, INC. v. THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA and M & M SCHOOL BUS SERVICE CASE NO. 99-4021BID; A. OLIVEROS TRANSPORTATION, INC. v. THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA and M & M SCHOOL BUS SERVICE (Intervener), CASE NO. 99-4022BID

In August, 1999, the School Board Administration issued Bid No. 053-2207, school bus routes for approved private bus companies. Twenty-one (21) vendors responded to Bid No. 053-2207 and four (4) were rejected as non-responsive. On August 25,1999, the School Board took action to adopt the Administration’s recommendation, and thereby awarded Bid No. 053-2207 to the seventeen (17) bidders. Thereafter, Petitioners protested this award and an administrative hearing was held by a duly assigned Administrative Law Judge of the Division of Administrative Hearings.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, grant Respondent’s Unopposed Motion for Enlargement of Time to File Written Exceptions to the Recommended Order.

K-5 RETENTION OF THE LAW FIRM PYSZKA, BLACKMON, LEVY & MOWERS, P.A. TO HANDLE ASSIGNED LIABILITY DEFENSE CASES IN LITIGATION

Jeffrey A. Mowers, Esquire, has announced that he is leaving the law firm of Peters, Robertson, Parsons, Mowers & Passaro, P.A., one of the defense liability firms that handle litigation in the area of personal injury and other tort actions for the School Board, to accept a partnership in the Miami law firm of Pyszka, Blackman, Levy & Mowers, P.A.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, retain the law firm of Pyszka, Blackman, Levy & Mowers, P.A. to handle tort actions and other litigation, as assigned by and subject to the supervision of the Board Attorney, for fees to be billed at the rate of $90 per hour and with reimbursement of costs advanced.


AGENDA ITEMS REVISED AFTER PUBLICATION OF THE AGENDA:

C-21 REQUEST FOR AUTHORIZATION TO ISSUE A REQUEST FOR PROPOSALS, DESIGNED FOR OUTSIDE AGENCIES WISHING TO OPERATE ALTERNATIVE PROGRAMS FOR MIAMI-DADE COUNTY PUBLIC SCHOOLS STUDENTS AND TO APPROVE THE SELECTION COMMITTEE

Authorization is sought to issue a Request for Proposals (RFP), designed for outside agencies wishing to operate alternative programs for Miami-Dade County Public Schools (M-DCPS) students. The aim of this generic RFP is to ensure that each agency seeking funding from M-DCPS will conform to Board-approved standards for all contracted programs.

RECOMMENDED:
That The School Board of Miami-Dade County, Florida:

1. authorize the Superintendent to issue a Request for Proposals, designed for outside agencies wishing to operate alternative programs for Miami-Dade County Public Schools students; and
2. approve the establishment of a selection committee which will review the proposals.


G-69 RENEWAL OF BID #174-VVIO - CARPET AND FLOOR TILE, NORTH OF FLAGLER STREET (SUPPLY AND INSTALL)

The purpose of this bid, opened on March 12, 1998, was to establish a contract, to supply and install, at firm unit prices, quantities, as may be required, of carpet and floor tile, north of Flagler Street, for Maintenance and Operations. The terms of agreement, as contained in the subject bid, awarded by the Board on April 15, 1998, and renewed on April 14, 1999, provided, that by mutual agreement between the successful vendor and The School Board of Miami-Dade County, Florida, the contract may be renewed for one (1) additional one (1) year period and, if needed, ninety (90) days beyond the expiration date of the current contract period. The contract is currently in its final one (1) year renewal period. The awardee has agreed to renew for the final ninety (90) day renewal period, by letter, on file. It is considered to be in the best interest of the Board to renew this bid, for an additional ninety (90) day renewal period, at the current prices. Staff is in the process of developing a new bid. This ninety (90) day renewal is to provide continuity of services during this period.

RECOMMENDED:
That The School Board of Miami-Dade County, Florida, Bid #I 74-VV 10 - CARPET AND FLOOR TILE, NORTH OF FLAGLER STREET (SUPPLY AND INSTALL), to supply and install, at firm unit prices, quantities, as may be required, of carpet and floor tile, north of Flagler Street, for Maintenance and Operations, during the term of the bid, effective April 15, 2000, through July 14, 2000, as follows:

The purpose of this bid, opened on November 10, 1999, is to establish a contract, to administer, at a firm unit price, physical examinations of bus drivers, north of Flagler Street, for the Department of Transportation. This is a term bid which states that the Board may purchase quantities, as may be required, at the unit price bid, but is not obligated to purchase any guaranteed amount. Of 121 vendors sent bid forms or card notices of this advertised bid, 7 responded, with 2 bids meeting specifications, 2 non-responsible bids and 3 no bids.

AGENDA ITEMS REPLACED AFTER PUBLICATION OF THE AGENDA:

B-2 SAFETY AND SANITATION STANDARDS AND INSPECTION OF PROPERTY DEFICIENCIES - FIRE SAFETY VIOLATIONS

The school district is responsible for creating a climate in the schools that ensures the safety and welfare of all students and personnel. It is critical that every site administrator comply with Florida Statutes, Section 235.06 - Safety and Sanitation Standards and Inspection of Property and Section 231.085 -Duties of Principals, to ensure the safety and health of occupants of educational and ancillary plants. Therefore, it is proposed that the Superintendent direct administrators to include implementation of all safety procedures in the School Site Administrator Performance Planning and Assessment System.

ACTION PROPOSED BY DR. MARTA PEREZ: That the Superintendent of Schools direct school-site administrators to include and address Florida Statutes, Section 235.06 and 231.085 through the Sehool Site Administrator Performance Planning and Assessment System to ensure compliance with the Statutes.

B-3 ESTABLISH A TASKFORCE TO ANALYZE AND STUDY MODELS OF OFFICES OF THE INSPECTOR GENERAL (OIG) TO DETERMINE THE MERIT AND LEGAL AUTHORITY FOR CREATING AN OFFICE OF INSPECTOR GENERAL FOR MIAMI-DADE COUNTY PUBLIC SCHOOLS

The need for increased accountability of government institutions has led agencies throughout Federal, State and Local jurisdictions to establish OIGs. The purpose of an OIG, as outlined in the Inspector General Act of 1978, is to “promote economy, efficiency, and effectiveness and to prevent and detect fraud and abuse.” In Chicago, investigations by the state Inspector General’s office prompted the School Board to create its own Office of Investigations with full subpoena and investigative powers. On February 8, 2000 the’los Angeles Unified School District unanimously named its first’ independent OIG.

ACTION PROPOSED BY DR. MARTA PEREZ: That The School Board of Miami-Dade County, Florida, establish a Task Force, composed of School Board Members or their designees, to analyze and study Inspector General models to determine the merit and legal authority for creating an Office of Inspector General for Miami-Dade County Public Schools. The results of the Task Force study with recommendations shall be presented to the Board no later than the July 19, 2000 meeting.

B-4 REQUEST TO DIRECT THE SUPERINTENDENT TO REVISE SCHOOL BOARD RULE 6Gx13-4E-1.09, PROFESSIONAL LEAVE

Currently, School Board Rule 6Gx13-4E-1.09, Professional Leave, encourages employees’ participation in government and other civic affairs, and allows employees elected to serve in the state legislature or in any other local, state or national elected office to receive professional leave with pay when engaged in official meetings of the elected body.

ACTION PROPOSED BY DR. MARTA PEREZ: That The School Board of Miami-Dade County, Florida, direct the Superintendent of Schools to revise School Board Rule 6Gx13-4E-1.09, Professional Leave, to state that effective July 1, 2000, employees elected to serve in an elected body must use either accrued annual leave or authorized leave without pay when engaged in official meetings.

B-8 BURGER KING PROPERTY

In January 2000, Burger King announced its decision to relocate its world headquarters from property it has leased in South Dade since 1988. As a result of this relocation, which is to occur in September 2002, the property which has been leased by Burger King may become available.

ACTION PROPOSED BY MS. BETSY H. KAPLAN: That The School Board of Miami-Dade County, Florida direct the Superintendent to pursue and support the development of an educational facility at the former Burger King world headquarters, located at 17777 Old Cutler Road.

E-2 APPOINTMENTS AND LATERAL ASSIGNMENTS OF MANAGERIAL EXEMPT, PROFESSIONAL, AND TECHNICAL PERSONNEL FOR 1999-2000

The following recommendations are made in accordance with Board Rules 6Gxl3-4A-l.l6,6Gxl3-4A-1.161, and the Miami-Dade County Public Schools/Dade County Schools Administrators’ Association labor contract.

Considerations for reassignments of managerial exempt, professional, and technical personnel were predicated upon an intensive review of information by the appropriate administrators and the Superintendent of Schools.

The recommended managerial exempt, professional, and technical personnel appointments reflect the honoring of requests for lateral reassignments, where possible. Assignments of personnel and appointments of managerial exempt, professional, and technical staff are a direct result of the Board-approved advertisement and selection process.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the recommendations as set forth above for appointments and lateral transfers, to be effective April 13, 2000, or as soon thereafter as can be facilitated.

The following recommendation is made in accordance with Board Rule 6Gx13-4A-1.16:

This contracted position was authorized by the Board at its meeting of March 15, 2000, Agenda Item E-3.

The Public Information Officer reports directly to the Superintendent of Schools. This is a contracted position responsible for the administration and supervision of the Office of Public Information and Media Relations with concurrent management, supervisory, and budgetary responsibilities for all service and operational activities for News Media Relations, Information Services, Community Outreach (Hispanic Affairs and Haitian Affairs), Publications, Marketing and Special Projects, Public Relations, Translation Services, Public Information, and Citizen Information.

The following recommendation is made in accordance with the Miami-Dade County Public Schools/Dade County Schools Administrators’ Association labor contract.

This open budgeted position was approved by the Board July 14,1999, Agenda Item A-3.

Ms. Vivian H. Colon, currently a School Treasurer at Miami Northwestern Senior High School , is recommended for appointment to the open, budgeted position of Business Manager, Internal Funds, pay grade 37, Accounting Department. Ms. Colon is currently enrolled in a Bachelor of Science degree in Accounting at Nova Southeastern University, Fort Lauderdale, Florida. Since 1986 to the present, Ms. Colon has been employed by Miami-Dade County Public Schools as a Receptionist, an Attendance Clerk, a Data Input Specialist, a Secretary, a Secretary Ill, a Fiscal Assistant II, and a School Treasurer, her current position

Mr. Eduardo Hernandez, currently a Computer Specialist, Records Management, is recommended for appointment to the open, budgeted position of Programmer I, pay grade 33, Systems and Programming Services, Office of Information Technology. Mr. Hernandez received an Associate in Arts Degree in Computer Science from Miami Dade Community College, Miami, Florida. Since 1997 to the present, Mr. Hernandez has been employed by Miami-Dade County Public Schools as a Network Data Communications Specialist and a Computer Specialist, his current position.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint:

1. Mr. Eduardo Hernandez to the open, budgeted position of Programmer I, Systems and Programming Services, pay grade 33, 12 months, and assign to the Office of information Technology, effective April 13, 2000, or as soon thereafter as can be facilitated;

Mr. Thomas Hale, currently a Senior Programmer Analyst I, pay grade 37, Office of Information Technology, is recommended for appointment to the open, budgeted position of Senior Programmer Analyst II, pay grade 38, Office of Information Technology. Mr. Hale received a Bachelor of Science Degree from the University of Florida, Gainesville, Florida. Since 1986 to the present, Mr. Hale has been employed by Miami-Dade County Public Schools as a Programmer Analyst I and Senior Programmer Analyst I, his current position.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint Mr. Thomas Hale, currently a Senior Programmer Analyst I, pay grade 37, to the open, budgeted position of Senior Programmer Analyst II, pay grade 38, 12 months, and assign to the Office of Information Technology, effective April 13,2000, or as soon thereafter as can be facilitated.

The following recommendation is made in accordance with the Miami-Dade County Public Schools/Dade County Schools Administrators’ Association labor contract.

This open budgeted position is due to the promotion of the incumbent.

Mr. James M. Brako, currently a Zone Mechanic-Certified, is recommended for appointment to the open, budgeted position of Specialist, Real Property Development and Acquisition, pay grade 39, Office of Site Planning and Government Liaison. Mr. Jeffrey D. Swain, currently a Staff Specialist, Vocational Education, MEP pay grade 18, Office of Educational Planning, is recommended for appointment to the open, budgeted position of Supervisor II, Title I, Educational Planning, pay grade 44, Office of Educational Planning. Mr. Swain received a Bachelor of Arts Degree from Morehouse College, Atlanta, Georgia and a Juris Doctor Degree from the University of Miami School of Law, Coral Gables, Florida. From 1988 to 1994, Mr. Swain was self employed as an attorney. Since 1994 to the present, Mr. Swain has been employed by Miami-Dade County Public Schools as a teacher and a Staff Specialist, his current position.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint Mr. Jeffrev D. Mr. Kevin S. Davis, currently a Senior Programmer Analyst I, pay grade 37, Office of Information Technology, is recommended for appointment to the open, budgeted position of Systems Analyst I, pay grade 39, Office of Information Technology. Mr. Davis received a Bachelor of Science Degree from Auburn University, Auburn, Alabama and a Master of Science Degree from the University of Miami, Coral Gables, Florida. From 1990 to 1993, Mr. Davis was employed as a Programmer Analyst III, University of Miami, Sylvester Comprehensive Cancer Center, Miami, Florida; and from 1995 to 1997, he was employed by the University of Miami, Information Technology, as a Research Analyst IV, Coral Gables, Florida. In 1994, Mr. Davis was employed by Miami-Dade County Public Schools (M-DCPS) as a Senior Programmer Analyst I; and since 1997 to the present, Mr. Davis has been employed by M-DCPS as a Senior Programmer Analyst I, his current position.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint Mr. Kevin S. E-15 REQUEST FOR AUTHORIZATION TO DISTRIBUTE REQUEST FOR PROPOSAL (RFP# 220-ZZ-IO), GROUP HEALTHCARE PREFERRED PROVIDER (PPO) PROGRAM

The Board currently offers its employees, dependents and retirees, healthcare choices which include two preferred provider organizations (PPO) from HIP Health Plan of Florida (HIP) and Humana Inc. In order to obtain rates for calendar years 2001 and 2002, all companies were asked to provide rates and backup financial data for evaluation by staff and the Board’s consultant, William M. Mercer, Inc. in response to this rate request, Humana sent a letter notifying the Board that they will not be offering a renewal quotation for the PPO product for 2001 and beyond. As a result, the choices offered to employees and retirees for 2001 would include only one PPO from HIP.

RECOMMENDATION: That The School Board of Miami-Dade County, Florida:
1. release Humana Inc. from its current contractual obligation to offer a Preferred Provider Organization (PPO) option as part of their healthcare delivery system to School Board employees, dependents and retirees, effective January 1, 2001;
2 . authorize issuance of Request For Proposal (RFP) #220-ZZ-IO, Group Healthcare Preferred Provider (PPO) program.
