AGENDA ITEMS WITHDRAWN AFTER PUBLICATION OF THE AGENDA:

C-5 REQUEST FOR BOARD APPROVAL TO AMEND THE ROSA PARKS COMMUNITY SCHOOL CONTRACTUAL AGREEMENT BEGINNING WITH THE 2000-2001 SCHOOL YEAR

Rosa Parks Community School has requested to amend its initial charter. The Rosa Parks Community School contractual agreement was previously approved by the School Board on June 23, 1999. As per Section 228.056(9)16(c), Florida Statutes, a charter may be modified during its initial term or any renewal term upon the recommendation of the sponsor and the approval of both parties to the agreement.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the Rosa Parks Community School contractual agreement beginning with the 2000-2001 school year, as amended, to change the location of the charter school from 255 Northeast Second Drive, Homestead, Florida 33030 to 700 West Palm Drive, Florida City, Florida 33034.

C-6 REQUEST FOR BOARD APPROVAL TO AMEND THE ROSA PARKS COMMUNITY SCHOOL/OVERTOWN CONTRACTUAL AGREEMENT BEGINNING WITH THE 2000-2001 SCHOOL YEAR

Rosa Parks Community School/Overtown has requested to amend its initial charter. Rosa Parks Community School/Overtown contractual agreement was previously approved by the School Board on May 17, 2000. As per Section 228.056(9)16(c), Florida Statutes, a charter may be modified during its initial term or any renewal term upon the recommendation of the sponsor and the approval of both parties to the agreement.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the Rosa Parks Community School/Overtown contractual agreement beginning with the 2000-2001 school year, as amended, to change the location of the charter school from 900 Northwest Seventh Avenue, Miami, Florida 33136 to 430 Northwest Ninth Street, Miami, Florida 33136.


AGENDA ITEMS ADDED AFTER PUBLICATION OF THE AGENDA:

G-23 SELECTION COMMITTEE; CERTIFICATES OF PARTICIPATION UNDERWRITERS

At the School Board’s meeting of June 21, 2000 Agenda Item G-21 was approved, appointing the Selection Committee which would recommend the underwriting group for the Certificates of Participation, Series 2000A (“‘COPS”). A copy of the appointed Selection Committee is attached as Exhibit A.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Selection Committee members listed in Exhibit A to designate an alternate staff member that will participate in the selection of the underwriting group on their behalf if the member is unable to attend.


AGENDA ITEMS REVISED AFTER PUBLICATION OF THE AGENDA:

C-11 REQUEST AUTHORIZATION TO APPROVE THE 2000-2001 WORKFORCE DEVELOPMENT EDUCATION PROGRAM FEE SCHEDULE AND TO ESTABLISH A STANDARDIZED STUDENT PAYMENT POLICY

The General Appropriations Act was silent on fees for Workforce Development Education programs. Therefore, the following is based on the fee schedule approved by the State Board of Education in December 1999. The 2000-2001 fees comprise the required local effort for the adult vocational and adult general education programs that fall under the Workforce Development category.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. approve the 2000-2001 Workforce Development Education Program fee schedule; and
2. authorize the Superintendent to calculate and implement the 2000-2001 Workforce Development Education fee.

No local funds are required.

E-2 APPOINTMENTS AND LATERAL ASSIGNMENTS OF’.MANAGERIAL EXEMPT, PROFESSIONAL, AND TECHNICAL PERSONNEL FOR 2000-2001

The following recommendations are made in accordance with Board Rules 6Gxl3-4A-1.16, 6Gx13-4A-1.161, and the Miami-Dade County Public Schools/Dade County Schools Administrators’ Association labor contract.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the recommendations as set forth above for appointments and lateral transfers, to be effective July 20, 2000, or as soon thereafter as can be facilitated.

E-2 APPOINTMENTS AND LATERAL ASSIGNMENTS OF MANAGERIAL EXEMPT, PROFESSIONAL, AND TECHNICAL PERSONNEL FOR 2000-2001

The following recommendations are made in accordance with Board Rules 6Gx13-4A-1.16, 6Gxl3-4A-1.161, and the Miami-Dade County Public Schools/Dade County Schools Administrators’ Association labor contract.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the recommendations as set forth above for appointments and lateral transfers, to be effective July 20, 2000, or as soon thereafter as can be facilitated.

E-7 ACCEPTANCE OF RESIGNATION

Subsequent to the July 19, 2000, notification to Ms. Ella A. Kearse, from the Superintendent of Schools, that she would be recommended for dismissal on July 19, 2000, for misconduct in office, incompetency, gross insubordination, and violation of School Board Rules 6Gx13-4-1.08, Violence in the Workplace, and 6Gx13-4A-1.21, Responsibilities and Duties, she has submitted a letter of resignation from the Miami-Dade County Public Schools, effective July 12, 2000.

RECOMMENDED: That effective July 12, 2000, at the close of the workday, the School Board of Miami-Dade County, Florida accept the resignation of Ms. Ella A. Kearse, Teacher, at North County Elementary School.

E-8 ACCEPTANCE OF RESIGNATION

Subsequent to the July 5, 2000 notification to Mr. Ossie Randle, Jr., from the Superintendent of Schools, that he would be recommended for dismissal on July 19,2000, for just cause, including but not limited to, gross insubordination, and violation of the labor contract, he has submitted a resignation from the Miami-Dade County Public Schools effective July 17, 2000.

RECOMMENDED: That effective July 19, 2000, at the close of the workday, the School Board of Miami-Dade County, Florida accept the resignation of Mr. Ossie Randle, Jr., Teacher, at Van E. Blanton Elementary School.

E-10 ACCEPTANCE OF RESIGNATION

Subsequent to the July 17, 2000, notification to Ms. Linda M. Pugh, from the Superintendent of Schools, that she would be recommended for dismissal on July 19, 2000, for just cause, including, but not limited to, deficient performance of job responsibilities, violation of School Board Rules 6Gx13-4A-1.21, Responsibilities and Duties, and 6Gx13-3E-1.10, Transportation--Specific Procedures, Ms. Pugh has submitted a resignation from the Miami-Dade County Public Schools, effective July 17, 2000.

RECOMMENDED: That effective July 19, 2000, at the close of the workday, the School Board of Miami-Dade County, Florida accept the resignation of Ms. Linda M. Pugh, School Bus Driver, at North Transportation Center.

G-1 AUTHORIZATION TO ADVERTISE PROPOSED TENTATIVE BUDGET AND MILLAGE LEVIES FOR 2000-01

Florida Statutes require that the Superintendent submit a tentative budget and millage levy recommendation to the Board no later than 24 days after certification of the tax roll or by July 24, 2000.

RECOMMENDED: That The School Board of Miami-Dade County, Florida authorize the Superintendent to:

1) advertise a proposed operating millage levy of 6.702 mills, a proposed capital outlay millage levy of 2.000 mills, and a proposed debt service levy of .915 mills, subject to certification of the State Required Local Effort Millage Levy and the Supplemental Discretionary Millage Levy;

G-1 AUTHORIZATION TO ADVERTISE PROPOSED TENTATIVE BUDGET AND MILLAGE LEVIES FOR 2000-01

Florida Statutes require that the Superintendent submit a tentative budget and millage levy recommendation to the Board no later than 24 days after certification of the tax roll or by July 24, 2000.

G-21 AUTHORIZATION TO ISSUE A REQUEST FOR PROPOSAL FOR SPECIAL TAX AND BOND COUNSEL

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1) approve the Request for Proposal presented as Attachment "A"
2) approve the advertisement for the Request for Proposal presented as Attachment "B";
3) approve the Selection Committee presented as Attachment "C"; and
4) appoint a School Board member as a member of the Committee.

G-61 REQUEST FOR APPROVAL OF SUPPLEMENTAL AWARD ON TERM BID

The purpose of this request is to obtain prior approval of a supplemental award on 4 the following term bid, inasmuch as the estimated requirements, previously awarded by the Board, will be exceeded before the bid term expires.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, APPROVE the supplemental award on the following term bid, in as much as the estimated requirements, previously awarded by the Board, will be exceeded before the bid term expires.

H-11 REQUEST TO RESCHEDULE THE NOVEMBER 22, 2000 SCHOOL BOARD MEETING AND CANCEL THE LEGISLATIVE CONFERENCE SESSION SCHEDULED FOR OCTOBER 11, 2000

At the November 16, 1999 organization meeting, the Board established its 2000 meeting schedule as mandated by F. S. §230.15. There are two meetings set for November 2000: the Tuesday, November 21 organization meeting and the Wednesday, November 22 regular meeting.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, direct the Superintendent to reschedule the November 22, 2000 regular meeting to Wednesday, November 15, 2000, to begin at 1:00 p.m.; and cancel the Legislative Conference Session scheduled for October 11, 2000 and replace it with the Board’s legislative committee meeting on Monday, 2000, at 11:00 a.m.

J-26 COMMISSIONING OF PISTORINO AND ALAM CONSULTING ENGINEERS, INC. AS SPECIAL PROJECTS CONSULTANT (SPC) - STRUCTURAL ENGINEERING

RECOMMENDED: That The School Board of Miami-Dade County, Florida commission the firm of Pistorino and Alam Consulting Engineers, Inc. to provide Special Projects Consultant (SPC) services primarily structural in nature, for the Board, the term shall be a two (2) year period, commencing July 19, 2000 and expiring July 18, 2002, with the second year being at the Board's option for the above negoitated provisions.


AGENDA ITEMS REPLACED AFTER PUBLICATION OF THE AGENDA:

B-2 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO HAVE A STUDY CONDUCTED OF MIAMI-DADE COUNTY PUBLIC SCHOOLS BUSES TO DETERMINE THE FEASIBILITY OF INSTALLING AIR CONDITIONERS

All students must be afforded an adequate environment during the school day. The south Florida climate, while enviable, can be uncomfortable due to excessive heat and humidity. This discomfort is magnified when 20 or more students are confined within the limits of a school bus, easily leading to angry and disruptive behavior.

RECOMMENDED: That The Superintendent of Schools have a study conducted of the feasibility of installing air conditioning in all public school buses within this district. Such study should include a fiscal impact analysis and should be presented to The School Board of Miami-Dade County, Florida at its regularly scheduled meeting of September 13, 2000.

B-3 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO INCLUDE MANDATORY CHILD SAFETY LOCKS ON GUNS IN THE 2001 STATE AND FEDERAL LEGISLATIVE PROGRAMS.

Every day, firearms claim the lives of too many children. Every two hours a child is killed by a gun. Firearms cause 12 percent of fatalities among American children and teens, and one of every four deaths of teenagers ages 15 to 19. These numbers represent not only violent crimes, but also tragic gun accidents. Today, firearms are the fourth leading cause of accidental deaths among children ages 5 to 14. Moreover, firearms have become the primary method by which young people commit suicide. According to the New EnPland Journal of Medicine, the presence of a gun in the home increases the likelihood of a homicide by almost threefold and suicide fivefold.

ACTION PROPOSED BY BETSY H. KAPLAN: That the Superintendent of Schools include in the Board’s 2001 State and Federal Legislative Programs mandatory child-proof safety locks on all guns.

B-4 BEST PRACTICES FOR IMPROVING STUDENT PERFORMANCE ON THE FLORIDA COMPREHENSIVE ASSESSMENT TEST (FCAT)

One hundred and twelve schools in Miami-Dade County improved their performance on the Florida Comprehensive Assessment Test (FCAT) and therefore earned higher marks on the Governor’s A+ Plan. The Board should seize this opportunity and learn as much as possible from this great achievement, which illustrates the implementation of the three principles of the school district’s mission to “strengthen instructional leadership, launch innovative systemic initiatives, and disseminate resources that enhance curriculum and instruction.”

ACTION PROPOSED BY DR. MARTA PEREZ: That the School Board of Miami-Dade County, Florida direct the Superintendent to develop and conduct a survey of principals of schools that improved one or more grade levels in the Governor’s A+ Plan and produce a report that:

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint Ms. Arleen A. Rose-Stanek to the open, budgeted position of Staff Auditor, pay grade 38, 12 months, and assign to the Office of Management and Compliance Audits, effective July 20, 2000, or as soon thereafter as can be facilitated.

G-64 TERMINATE BID #234-VV06 - ADMINISTRATION OF HEPATITIS “B” VACCINE

This bid was awarded by the Board on April 15, 1998, and renewed on April 14, 1999, and April 12, 2000, to establish a contract, to purchase, at firm unit prices, services, as may be required, for the administration of Hepatitis “B” vaccine, for the Office of Professional Standards. Item 1 - Visit 1, Item 2 - Visit 2, Item 3 -Visit 3, Item 4 - Visit 4, Item 5 - Booster, and Item 6 - Titer test only, was awarded to Pentagon Healthcare Services, Inc., of Miami, Florida. Subsequent to the award, the vendor has failed to perform satisfactorily in accordance with the terms and conditions of the bid. Based on the failure of this vendor to perform satisfactorily, it is recommended that the award of these items be terminated, to permit rebidding, and that Pentagon Healthcare Services, Inc., of Miami, Florida, lose eligibility to transact new business with the Board for a period of fourteen (14) months, pursuant to Board Rule 6Gx13-3C-1.08 - Performance And Payment Security, Declining A Bid Award, And Bonding Company Qualifications.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. TERMINATE the award of items 1 through 6 on Bid #234-VV06 - ADMINISTRATION OF HEPATITIS “B” VACCINE, effective July 19, 2000, as follows:


G-82 AWARD OF BID #170-ZZ02 - PLUMBING: COPPER TUBING AND FITTINGS

The purpose of this bid, opened on June 6, 2000, is to establish a contract, to pre-qualify bidders to participate in spot market purchases of copper tubing and fittings, for Maintenance Materials Management stock. At the end of the initial period (September 1, 2000), in order to cope with fluctuating copper prices, the awarded bidders shall be invited to participate in spot market purchases. This is a term bid which states that the Board may purchase quantities, as may be required, at the unit price bid, but is not obligated to purchase any guaranteed amount. Of 83 vendors sent bid forms or card notices of this advertised bid, 15 responded, with 10 bids meeting specifications (not all vendors bid all items) and 5 no bids.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, AWARD Bid #170-ZZ02 - PLUMBING: COPPER TUBING AND FITTINGS, to pre-qualify bidders to participate in spot market purchases of copper tubing and fittings, for Maintenance Materials Management stock, during the term of the bid, effective July 19, 2000, through July 31, 2001, as follows:

G-89 RENEWAL OF BID #010-VV03 - FROZEN PIZZA AND PASTA PRODUCTS

The purpose of this bid, opened on August 7, 1997, was to establish a contract, to purchase, at firm unit prices, quantities, as may be required, of frozen pizza and pasta products, for the Food Service Program of the Department of Food and Nutrition. The terms of agreement, as contained in the subject bid, awarded by the Board on September 24, 1997, and renewed July 22, 1998, and June 23, 1999, provided, that by mutual agreement between the successful vendors and The School Board of Miami-Dade County, Florida, the contract may be renewed for two (2) additional one (1) year periods and, if needed, ninety (90) days beyond the expiration date of the current contract period. The contract is currently in its second one (1) year renewal period. The awardees have agreed to renew, for the final ninety (90) day renewal period, by letter, on file, with the exception of Allstate Food Marketing, of Orlando, Florida, who no longer represents the product awarded, and Ghaltchi Vending, d.b.a. Magic Vending, of Weston, Florida, who elected not to renew. It is considered to be in the best interest of the Board to renew this bid, for an additional ninety (90) day renewal period, at the current prices, to benefit from fixed prices during the final ninety (90) day period, inasmuch as the Consumer Price Index (CPI), as of May 2000, indicates an increase of 2.2% for food. This 90 day renewal is to provide continuity of services during this period.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, Bid #0l0-VV03-FROZEN PIZZA AND PASTA PRODUCTS, to purchase, at firm unit prices, quantities, as may be required, of frozen pizza and pasta products, for the Food Service Program of the Department of Food and Nutrition, during the term of the bid, effective August 25, 2000, through November 20, 2000, as follows:

The purpose of this bid, opened on July 6, 2000, is to establish a contract, to purchase, at firm prices, steel drums, for Herbert A. Ammons Middle School. Of 70 vendors sent bid forms or card notices of this advertised bid, 4 responded, with 3 bids meeting specifications and 1 no bid.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, AWARD Bid #249-ZZ06 - STEEL DRUMS, to purchase, at firm prices, steel drums, for Herbert A. Ammons Middle School, effective July 19, 2000, as follows:
