ET. AL. v. THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, UNITED STATES DISTRICT

In December, 1998, the School Board was sued in the above-referenced case. The federal court trial in this matter was scheduled to commence on September 25, 2000. On August 30, 2000, the School Board made an Offer of Judgment. The Plaintiffs accepted the Offer of Judgment.
RECOMMENDED: That
The School Board of Miami-Dade County, Florida, authorize the payment of the
School Boards Offer of Judgment in the amount of $200,000 to resolve in
its entirety the case of Johnson et. al. v. The School Board of Miami-Dade Countv,
Florida, U.S.D.C. Case No. 98-3017-CIV-JORDAN. This authorization of payment
releases the School Board from all claims made by all Plaintiffs including damages,
attorneys fees and costs.

FINANCE PROGRAM OR ANY NEWLY CREATED FUNDING FORMULA
The 2000 Legislature established the Task Force on Public School Funding to examine and make recommendations to the Governor and the Legislature on the funding of public schools. Final recommendations are due by February 1, 2002. Effective June 30, 2004, the Florida Educational Finance Program (FEFP) is repealed.

On December 9,1998, The School Board of Miami-Dade County, Florida adopted School Board Rule 6Gx13-7D-1.05, Pre-Qualification of Contractors for Educational Facilities Construction. This rule was created pursuant to Section 235.31 of the Florida Statutes and State Requirements for Educational Facilities (1997), which require school districts to pre-qualify contractors prior to their bidding on school work. This new law became effective July 1, 1998.
RECOMMENDED: That
The School Board of Miami-Dade County, Florida, approve the above list of contractors
for pre-qualification, and authorize staff to issue a certificate to each contractor,
certifying pre-qualification for a period of one (1) year.
J-4 AUTHORIZATION TO EXECUTE A LEASE
AGREEMENT WITH MIAMI-DADE COUNTY FOR THE USE OF RECREATIONAL FACILITIES AT WEST
LITTLE RIVER ELEMENTARY SCHOOL
Due to an increasing need to provide public recreational facilities, Miami-Dade County (County) has approached the District with a request to establish a lease agreement for a portion of the playfield area at West Little River Elementary School during non-school hours (see attached location map).
RECOMMENDED: That
The School Board of Miami-Dade County, Florida, authorize the Superintendent
or his designee to execute a lease agreement with Miami-Dade County, for the
use of recreational facilities at West Little River Elementary School, at an
annual rental rate of $1, and under the terms and conditions set forth above.

THE PURCHASE OF LAND FOR A FUTURE ELEMENTARY SCHOOL SITE
The District has identified a vacant site within Miami-Dade County that is available for purchase. The site is approximately 15 acres in size and is located at theoretical NW 201 Street and theoretical NW 79 Avenue (see attached location map). The Superintendent for Region I expects the site to be used in the near future as an elementary school to relieve Palm Springs North Elementary (PSNE). Based on the 2000-2001 opening of schools membership, PSNE is at 166% of permanent utilization. Information complied by Miami-Dade County Department of Planning and Zoning project a population increase of 29% over the next five years.
RECOMMENDED: That

A-6 ADOPTION OF FIVE-YEAR FACILITIES WORK PROGRAM REQUIRED BY S.235.185, FLORIDA STATUTES
During the October 1997 Special Session, the Florida Legislature created section 235.185, Florida Statutes, which requires each district to adopt a five-year facilities work program. The format of the work program has been promulgated by the Smart Schools Clearinghouse which was also established by the Legislature.
RECOMMENDED: That
The School Board of Miami-Dade County, Florida adopt the Five-Year Facilities
Work Program as required by s.235.185, Florida Statutes.
A-7 FINAL ADOPTION OF THE 2000-01 BUDGET
On July 24, 2000, the Board
tentatively adopted the 2000-01 budget following the first public hearing on
the budget as prescribed by Chapter 200, Florida Statutes. That tentative adopted
budget included proposed millage rates, projected revenues and recommended appropriations
for 2000-01 for the General Fund, Debt Service Funds, Capital Outlay Funds,
Special Revenue Funds and Trust & Agency Funds.
RECOMMENDED: That The School Board of Miami-Dade County, Florida, adopt
the 2000-01 Annual Budget which consists of the revenues and appropriations
delineated on the official state budget forms and including any amendments approved
by the Board following the public hearing on September 13, 2000.

The survey indicates that we are the only large school district located in a warm climate that does not provide transportation services to students in air conditioned buses. Additionally, recognizing that the South Florida climate, while enviable, can be uncomfortable due to excessive heat and humidity, the School Board at its July 1, 2000 meeting, directed the Superintendent to conduct a feasibility study of installing air conditioning in all school buses.
ACTION PROPOSED BY MR. DEMETRIO PEREZ, JR.: That The School Board of Miami-Dade County, Florida, authorize the Superintendent of Schools to purchase all future buses with air conditioning.

According to statistics from the University of Florida, Florida Traffic and Bicycle Safety Education Program, young children face the greatest likelihood of death or disability through traffic related injuries than from any other single cause. Students who learn safe traffic and pedestrian safety skills and concepts at an early age are more likely to apply these skills throughout their entire lives.
ACTION PROPOSED BY MS.
PERLA TABARES HANTMAN: That The School Board of Miami-Dade County, Florida,
direct the Superintendent to provide all kindergarten and first grade students
with a pedestrian/school bus safety education program. No additional funds are
required.

The Office of Budget Management has completed its review of actual receipts and expenditures through June 30, 2000, and updated entitlement notices from the Department of Education. Based on that review, the following changes to the budget, as amended through the last Board Meeting in June are recommended for approval.

CONTRACTED PROGRAMS FUND FINAL BUDGET REVIEW
The Special Revenue Funds include the Contracted Programs Fund and the School Food Service Fund. The purpose of this resolution is to make various technical budgeted amendments to the Contracted Programs Fund budget which are required to fully comply with grant terms and/or good accounting practices, as follows:

a. adopt Resolution No. 3, 1999-2000 Contracted Programs Fund Final Budget Review, increasing revenues and appropriations by $4,865,865.

BISHOP v. THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, UNITED STATES
DISTRICT COURT CASE NO. 99-1670-CIV-MIDDLEBROOKS
In June, 1999, the School Board was sued in the above-referenced case. The federal court trial in this matter was scheduled to commence on August 28, 2000. A Court ordered settlement conference was held on August 22, 2000 and, thereafter, a negotiated settlement was reached for Board consideration and approval.
RECOMMENDED: That
The School Board of Miami-Dade County, Florida, authorize settlement in the
case of Joseph Bishop v. The School Board of Miami-Dade Countv, Florida,
U.S.D.C. Case No. 99-1670-CIV-MIDDLEBROOKS, for the sum of $175,000. The settlement
will release the School Board from all claims including damages, attorneys
fees and costs.
