C-23 PROPOSED AMENDMENT OF SCHOOL BOARD RULE: INITIAL READING 6Gx13-1C-1.06, POLITICS - PARTICIPATION OF STAFF

At its meeting of December 11, 2002, the School Board Attorney was directed to amend the aforementioned School Board rule in order to address the usage of district e-mail servers and individual accounts for the purpose of distributing political communication; employee behavior and/or conduct at schools serving as precincts on election days; implied or express use of school children in communicating political messages to parents and the community; and improper use by Union representatives of School Board property or e-mail for the purposes of influencing an election.

Miami Norland Senior High School’s football team is the premiere high school football team in Florida.

ACTION PROPOSED BY DR. ROBERT B. INGRAM: That The School Board of Miami-Dade County, Florida,
approve Resolution No. 03-05 of The School Board of Miami-Dade County, Florida, recognizing the Miami Norland Senior High School Vikings for winning the Class 6A State Football Championship.

D-10 REQUEST FOR APPROVAL OF RESOLUTION NO. 03-08 OF THE SCHOOL BOARD OF MIAMI-DADE COUNTY FLORIDA, HONORING THE MEMORY OF DR. MARTIN LUTHER KING, JR., A MAN WHO PLACES IN THE RANKS OF THE GREATEST AMERICANS

Dr. Martin Luther King, Jr. was a man of peace, vision and national stature whose work continues to have a positive and profound impact on the people of our great community and country.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

COMMITTEE: LEGISLATIVE RELATIONS AND.POLICY DEVELOPMENT


This item is submitted for consideration by the School Board to amend School Board rule 6Gx13-4C-1.021, Fingerprinting of All Employees Upon Application and Employment, which sets forth policy and procedures for ensuring that only individuals of good moral character are employed by the school system.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendentto initiate rulemaking proceedings in accordance with the Administrative Procedure Act to amend School Board Rule
6Gx13-4C-1.021, Fingerprinting of All Employees Upon Application and Employment.

D-5 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO AMEND THE FEDERAL LEGISLATIVE PROGRAM FOR THE FIRST YEAR OF THE 108TH CONGRESS

The Miami-Dade County School Board approved at its December 11, 2002 meeting the Federal Legislative Program for the first year of the 108th Congress.

ACTION PROPOSED BY MR. FRANK J. COBO: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to amend the Federal Legislative Program for the first year of the 108th Congress to include funding for building and sustaining the career academy model in Miami-Dade County Public Schools.

G-31 REFUNDING CERTIFICATES OF PARTICIPATION (COP) SERIES 2003

COMMITTEE: FINANCIAL AFFAIRS


Using a “Multi-Modal Advance Refunding” structure, the School Board can realize significant Present Value (PV) savings by refunding certain of its certificates of participation (COP) Series 1993, Series 1998B and Series 2001A issues. Recent PV savings estimates have been in the range of 4.0% to 7.0%.

RECOMMENDED: That The School Board of Miami-Dade County, Florida (l), Approve Resolution #2003-02 authorizing the issuance of the Refunding COPS series 2003.

G-60 REQUEST APPROVAL OF SUPPLEMENTAL AWARDS ON TERM BIDS

COMMITTEE: FINANCIAL AFFAIRS


The purpose of this request is to obtain prior approval of a supplemental award on the following term bids, inasmuch as the estimated requirements, previously awarded by the Board, will be exceeded before the bids term expires.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, APPROVE the supplemental award on the following term bids, inasmuch as the estimated requirements, previously awarded by the Board, will be exceeded before the bids term expires.

The purpose of this bid, opened on November 7, 2002, is to establish a contract, to purchase, at firm unit prices, quantities, as may be required, of air conditioners,for Maintenance Materials Management stock.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, AWARD Bid No. 003-CC06 - AIR CONDITIONERS, to purchase, at firm unit prices, quantities, as may be required, of air conditioners, for Maintenance Materials Management stock, during the term of the bid, effective January 15, 2003, through
January 14, 2004, as follows:

H-2 APPOINTMENTS AND LATERAL ASSIGNMENTS OF MANAGERIAL EXEMPT, PROFESSIONAL, AND TECHNICAL PERSONNEL FOR 2002-2003

The following recommendations are made in accordance with Board Rules 6Gx13-4A-1.16, 6Gx13-4A-1.161, and the Miami-Dade County Public Schools/Dade County Schools Administrators’ Association labor contract.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the recommendations as set forth above for appointments and lateral transfers, to be effective January 15, 2003, or as soon thereafter as can be facilitated, with the exception of the effective dates as noted throughout the item.

C-4 STATE LEGISLATIVE PROGRAM INITIATIVE-PROPOSALS FOR TAX RELIEF FOR SENIOR CITIZENS

COMMITTEE: LEGISLATIVE RELATIONS AND POLICY DEVELOPMENT


At the Board meeting of December 11, 2002, the School Board directed the Board Attorney to provide proposals for State legislative options to provide property tax relief for senior citizens that would apply to School District taxes.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize and direct the Superintendent of Schools, or his designee, and the School Board Attorney, to pursue initiatives on behalf of the School Board to effect tax relief for seniors as follows:

D-3 THAT THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA AUTHORIZE THE SUPERINTENDENT TO RESEARCH AND PRESENT A STATUS REPORT TO THE BOARD ON ELECTRONIC MEDIA ALTERNATIVES FOR BROADCASTING ALL REGULARLY SCHEDULED SCHOOL BOARD MEETINGS

On December 11, 2002, The School Board of Miami-Dade County, Florida held a conference session to discuss and determine Board policy directives for the broadcasting of School Board meetings on WLRN-FM 91.3 and WLRN-TV Channel 17.

ACTION PROPOSED BY PERLA TABARES HANTMAN: That The School Board of Miami-Dade County, Florida
authorize the Superintendent to research and present a status report to the Board within 90 days on electronic
media alternatives for broadcasting all regularly scheduled School Board meetings.

D-7 NON-UNION EMPLOYEE SALARY INCREASES

The School Board of Miami-Dade County recognizes the importance of appropriate compensation for all employees, who on a daily basis improve our community by helping educate our children.

D-8 RECOGNITION OF JOSE MARTI, CUBAN PATRIOT AND STATESMAN

The School Board of Miami-Dade County recognizes the significance of the life and work of Jose Marti for the people of Cuba and the Americas on the occasion of the 150th anniversary of his birth.

ACTION PROPOSED BY MR. FRANK J. BOLAÑOS: That The School Board of Miami-Dade County, Florida, pays tribute to Jose Marti on the occasion of the 150th anniversary of his birth and encourages all students, teachers, parents and staff to participate in a community celebration and parade in his honor on Friday, January 24th.

E-5 AUTHORIZATION TO EXECUTE A LEASE AGREEMENT FOR OFFICE SPACE FOUR THE OFFICE OF THE INSPECTOR GENERAL

COMMITTEE: FACILITIES PLANNING AND CONSTRUCTION


At its September 12, 2002 meeting, the School Board (Board) approved agenda item H-8, authorizing the establishment and classification of the contracted position of Miami-Dade County Public Schools Inspector General.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent or his designee to execute a lease agreement with Biscayne Management Corporation for 1,770 square feet of office space at the 1444 Biscayne Boulevard Building for use by the OftIce of Inspector General, at an annual rental rate of $23,895 for the first year of the three-year base term, and substantially in conformance with the terms and conditions set forth above.

G-46 REQUEST FOR AUTHORIZATION TO ISSUE REQUEST FOR PROPOSAL (RFP) #082-CC10, 403(b)/401(a) TERMINAL LEAVE RETIREMENT PLAN

COMMITTEE: FINANCIAL AFFAIRS


Various school districts within the State of Florida have implemented a terminal leave retirement plan consisting of an IRS qualified 401 (a) program that permits government employers to pay special forms of compensation, such as employee sick pay and annual leave, in a tax-advantaged manner in lieu of cash.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1 . authorize the Superintendent to issue Request For Proposal (RFP)# 082-CC10, 403(b)/401(a) Terminal Leave Retirement Plan;

G-47 REQUEST FOR AUTHORIZATION TO ISSUE REQUEST FOR INFORMATION (RFI) #084-CC10, BROKER SELECTION FOR OWNER’S PROTECTIVE PROFESSIONAL INDEMNITY INSURANCE

COMMITTEE: FINANCIAL AFFAIRS


The Board’s current specifications for insurance required of design,professionals, including architects and engineers, mandates project specific professional liability insurance coverage. As a result of the current insurance market conditions, this type of coverage is very costly and somewhat unavailable.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1 . authorize the Superintendent to issue Request For Proposal (RFP)# 084-CC10, Broker Selection For Owner’s Protective .Professional Indemnity Coverage (OPPI);

G-48 RECOMMENDATIONS REGARDING AVAILABLE TERRORISM COVERAGE FROM CURRENT PROPERTY INSURANCE CARRIERS, MADE AVAILABLE FOR ADDITIONAL PREMIUM AS A RESULT OF THE TERRORISM RISK INSURANCE ACT OF 2002

COMMITTEE: FINANCIAL AFFAIRS


As a result of the recently enacted legislation entitled The Terrorism Risk Insurance Act of 2002, (The Act), Board-purchased property insurance which contained exclusions for acts of terrorism must now provide that coverage, subject to restrictions approved by the Federal Government.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1 . reject the purchase of property coverage for terrorism offered on a mandatory basis pursuant to the provisions of The Terrorism Risk Insurance Act of 2002, due to the fact that the Board currently carries property insurance for terrorism losses with broader coverage than that offered as a result of the passage of The Terrorism Insurance Act of 2002;

G-78 EXTEND CONTRACT NO. 056-AA03 - FOOD ITEMS: FROZEN AND REFRIGERATED
