C-1 FELIX VARELA SENIOR HIGH SCHOOL AND JANE ROBERTS ELEMENTARY AUTHORITY FOR LEGAL ACTION

COMMITTEE: FACILITIES MANAGEMENT

During the course of the forensic examination of Felix Varela Senior High School and Jane Roberts Elementary School conducted in connection with the District's mold, mildew and water intrusion pilot program, Holland & Knight LLP (outside counsel) and their consultants have discovered that claims may exist against the General Contractors or Design Builders, Surety, Project Architects, Design Criteria Professionals, and Uniform Building Code Inspectors for construction and design defects and failure to properly perform inspections that have caused significant water intrusion, mold, mildew and other damages to Felix Varela Senior High School and Jane Roberts Elementary School.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Board Attorney to direct outside counsel to proceed with legal action, including the filing of lawsuits against responsible parties, to recover damages incurred by the Board and other appropriate claims related to the design and construction of Felix Varela Senior High School and Jane Roberts Elementary School, subject to negotiation of legal and consultant fees acceptable to the Superintendent and Board Attorney.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the GMP for James B. Pirtle Construction Co., Inc., Project No. A0825W7151 CM, Portable Classrooms Replacement, to construct 22 classroom units in the total amount of $2,472,781 which includes building cost, site cost and a contingency in the amount of $117,751.

E-61 CONFIRMATION OF REQUEST TO STAGE FIREWORKS AT MIAMI SENIOR HIGH SCHOOL ON SUNDAY, MARCH 14, 2004.

COMMITTEE: FACILITIES MANAGEMENT COMMITTEE

The Kiwanis Club of Little Havana, is a service organization with projects that greatly impact the youth of the community.

ACTION PROPOSED BY MR. AGUSTIN J. BARRERA: That The School Board of Miami-Dade County, Florida, confirm authorization for the Kiwanis Club of Little Havana to stage fireworks at Miami Senior High School on Sunday, March 14, 2004.

F-10 ACCEPTANCE OF RESIGNATION ANGEL M. MARTINEZ

March 12, 2004 On March 3, 2004, the Superintendent of Schools sent Mr. Angel M. Martinez a letter advising him of the School Board's initiation of dismissal proceedings against him at its scheduled meeting of March 17, 2004.

RECOMMENDED: That The School Board of Miami-Dade County, Florida accept the resignation of Mr. Angel M. Martinez, Custodian at Dr. Michael M. Krop Senior High School, effective as of the close of the workday on March 12, 2004.

COMMITTEE: LEGISLATIVE RELATIONS, PUBLIC RELATIONS, AND PERSONNEL SERVICES

On February 3, 2003, President Bush ordered that the flag of the United States be flown at half-staff at the White House and all public buildings and grounds, at all military posts and naval stations, and on all naval vessels of the of the Federal Government in the District of Columbia and throughout the United states and its Territories and possessions, including all United States embassies, legations. consular offices, and other facilities abroad, including all military facilities, and naval vessels and stations, as a mark of respect for the astronauts aboard the Space Shuttle Columbia who gave their lives during the mission of STS-107.

ACTION PROPOSED BY DR. MARTA PÉREZ: That The School Board of Miami-Dade County, Florida, direct the Superintendent to initiate rulemaking in accordance with the Administrative Procedure Act to amend Board Rule 6Gx13-1C-1.16, Observance of Death of Staff and Students, to include a district wide mourning period of 4 days that will commence the morning afler the death has occurred when the death of the staff member or student has occurred on district grounds.

C-30 PROPOSED AMENDMENT OF SCHOOL BOARD RULE 6Gx13-2C-1.083, EDUCATIONAL FACILITIES PLANNING, SITE SELECTION AND ACQUISITION, AND CONSTRUCTION

COMMITTEE: EDUCATION AND SCHOOL OPERATIONS

I am proposing that the School Board amend Board Rule 6Gx13-2C-1.083, Educational Facilities Planning, Site Selection and Acquisition, and Construction, as a means of clarifying and improving the process to be used by the School Site Planning and Construction (SSPC) Committee in recommending sites to the School Board and the Superintendent of Schools for use as public educational facilities.

ACTION PROPOSED BY MR. FRANK J. COBO: That The School Board of Miami-Dade County, Florida, direct the Superintendent to initiate rulemaking accordance with the Administrative Procedure Act to amend School Board Rule 6Gx13-2C-1.083, Educational Facilities Planning, Site Selection and Acquisition, and Construction, as noted above.

The City of Sunny lsles Beach, Florida (City), has approached the District with an offer to donate an approximate 2.5-acre parcel of land within the City at N.E. 182" Drive and North Bay Road for the future construction of a K-8 educational facility.

That The School Board of Miami-Dade County, Florida:

1) support the donation by the City of Sunny lsles Beach to the School Board, of an approximate 2.5- acre site located at N.E. 182nd Drive and North Bay Road; and

Authorization of the Board is requested to establish and classify new administrative position classifications in accordance with School Board Rule 6Gx13-4-1.022 Manual of Procedures for Managerial Exempt Personnel (MEP) and the labor contract with the Dade County Schools Administrator's Association (DCSAA).

RECOMMENDED: I. That The School Board of Miami-Dade County, Florida, establish and classify the following administrative position classifications:
