Procedures for the reclassification of managerial exempt employees are outlined in Board Rule 6Gx13-4D-1.022, Manual of Procedures for Managerial Exempt Personnel (MEP). Reclassification may result from a reorganization and/or redistribution of work assignment which significantly alters the duties and responsibilities of a position. Wage and Salary Administration in Personnel Management and Services is responsible for examining the requests for reclassification.

I-4 REQUEST FOR AUTHORIZATION TO ENTER INTO A CONTRACTUAL AGREEMENT WITH ARTHUR ANDERSON LLP TO PERFORM A COMPREHENSIVE ORGANIZATIONAL STRUCTURE REVIEW FOR THE DEPARTMENT OF FOOD AND NUTRITION

Staff is currently in the process of negotiating a contract with Arthur Anderson LLP to conduct a comprehensive review of the current organizational structure of the Department of Food and Nutrition to determine if it is the “best structure” to meet the needs and the increasing demands of Miami-Dade County Public Schools, with an emphasis on improving operations, increasing performance, and improving customer satisfaction.

F-12 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO EXTEND A CONTRACTUAL AGREEMENT WITH THE MIAMI-DADE/MONROE WAGES COALITION TO PROVIDE INTENSIVE SERVICES TO WAGES CUSTOMERS, JULY 1, 2000 - SEPTEMBER 30, 2000

The Miami-Dade/Monroe Work and Gain Economic Self-sufficiency (WAGES) Coalition awarded a contractual agreement, in an amount not to exceed $750,000, to the Miami-Dade County Public Schools to provide intensive services to WAGES customers. At the Board Meeting of June 23, 1999, Agenda Item, C-28, the contractual agreement was approved by the Board for the period July 1, 1999 through June 30, 2000. Authorization is requested to extend the contractual agreement through September 30, 2000.

F-13 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO EXTEND A MEMORANDUM OF AGREEMENT WITH MIAMI-DADE COMMUNITY COLLEGE FOR FUNDING TO OPERATE WAGES CAREER SERVICES CENTERS, JULY 1, 2000 SEPTEMBER 30, 2000

The Miami-Dade/Monroe Work and Gain Economic Self-sufficiency (WAGES) Coalition awarded funding in the amount of $12,850,589 to Miami-Dade Community College (M-DCC) in collaboration with Miami-Dade County Public Schools (M-DCPS) to operate 12 Career Services Centers (CSCs). M-DCC is the lead organization assuming overall legal, fiscal, managerial, and reporting responsibilities for the program. Services provided include basic services and baseline assessment for WAGES customers. M-DCPS, through a Memorandum of Agreement, operates six of the 12 CSCs. The Memorandum of Agreement was approved at the Board Meeting of May 12, 1999, Agenda Item, F-l-4. Authorization is requested to extend the Memorandum of Agreement with M-DCC until September 30, 2000.

K-9 SETTLEMENT OF CLAIM FILED BY IDOLIA HERNANDEZ, EEOC CHARGE NO. 150 99 4033

The School Board of Miami-Dade County, Florida participated in a mediation of the above-referenced Equal Educational Opportunity Commission (EEOC) claim filed by Idolia Hernandez against the School Board and Principal Stacey Jones.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize settlement of the above-referenced EEOC claim, Charge No. 150 99 4033, for the sum of $125,000.

K-10 ACCEPTANCE OF RESIGNATION SCHOOL BOARD OF MIAMI-DADE COUNTY v. EDDY JEAN-LOUIS DOAH CASE NO. 00-2325

On May 12, 2000, the Superintendent notified teacher, Eddy Jean-Louis, of his intention to recommend to the School Board the termination of Mr. Jean-Louis’ employment for failure to correct performance deficiencies during the 90-Calendar Day Performance Probation. On May 31, 2000, Mr. Jean-Louis submitted his request for a hearing before the Division of Administrative Hearings. Subsequent to his request for a hearing, on June 6, 2000, Mr. Jean-Louis tendered his resignation from the Miami-Dade County Public Schools, effective June 16, 2000.

RECOMMENDED: That The School Board of Miami-Dade County, Florida accept the resignation of Eddy Jean-Louis, teacher at Miami Killian Senior High School, effective as of the close of the workday on June 16, 2000.


AGENDA ITEMS REVISED AFTER PUBLICATION OF THE AGENDA:

A-1 FUNDING FOR SAFETY-TO-LIFE DEFICIENCIES

At the May 17, 2000 Board Conference Session, staff presented a report which indicated that an expenditure of at least $30,000,000 would be necessary for the corrections of safety-to-life deficiencies. Funds for these corrective measures will be forthcoming from a five year loan, utilizing a revenue anticipation note, which will be allocated to the Maintenance and Operations ($10 million) and Capital Improvement Projects ($20 million) budgets. The funds are to be expended on repairs and capital items, i.e., the provision of additional means of egress, fire sprinkler systems, fire alarm systems, exit lights and emergency lighting. These are the major cost items.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize expenditures by Maintenance and Operations and by Capital Improvement Projects totaling $30,000,000, for the correction of safety-to-life deficiencies. These funds are to be allocated in FY2000-2001 maintenance and capital budgets.

C-30 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO A CONTRACTUAL AGREEMENT WITH HOME BUILDERS INSTITUTE, IN AN AMOUNT NOT TO EXCEED $436,000, TO SERVE WAGES CLIENTS AND OTHER ECONOMICALLY DISADVANTAGED CLIENTS, FROM JULY 1, 2000 THROUGH JUNE 30, 200l

Miami-Dade County Public Schools (M-DCPS) has been involved in the Housing Renovation Partnership Program through the South Dade Adult Education Center, in collaboration with Home Builders Institute (HBI), the Work and Gain Employment Self-Sufficiency (WAGES) Coalition, the U.S. Housing and Urban Development (HUD) agency, and the Miami-Dade Housing and Urban Development (Miami-Dade HUD) agency. These organizations have joined together to provide vocational training and job placement for Welfare/WAGES clients. In addition, HBI is providing vocational training through workforce development funds to adjudicated youths at ICare Bay Point Schools.

E-2 APPOINTMENTS AND LATERAL ASSIGNMENTS OF MANAGERIAL EXEMPT, PROFESSIONAL, AND TECHNICAL PERSONNEL FOR 1999 - 2000

The following recommendations are made in accordance with Board Rules 6Gx13-4A-m6Gx13- 4A-1.161, and the Miami-Dade County Public Schools/Dade County Schools Administrators’ Association labor contract.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the recommendations as set forth above for appointments and lateral transfers, to be effective June 22, 2000, or as soon thereafter as can be facilitated.

F-6 REQUEST FOR AUTHORIZATION TO ACCEPT A GRANT AWARD FROM THE FLORIDA DEPARTMENT OF EDUCATION FOR FUNDING IDEA, PART B; AND IDEA, PART B, PRESCHOOL, UNDER THE INDIVIDUALS WITH DISABILITIES EDUCATION ACT (IDEA), JULY 1, 2000 - JUNE 30, 200l

The Florida Department of Education (FDOE) has allocated funds to the Miami-Dade County Public Schools (M-DCPS) under the individuals with Disabilities Education Act (IDEA). The continuation application for funding under IDEA represents two programs consolidated into one application: IDEA, Part B; and IDEA, Part B, Preschool (PreWESE).

RECOMMENDED: That The School Board of Miami- Dade County, Florida, authorize the Superintendent to:

1. accept a grant award from the Florida Department of Education for funding IDEA, Part B, in the amount of $26,841,569; and IDEA, Part B, Preschool, in the amount of $1,478,465, under the Individuals with Disabilities Education Act (IDEA), July 1, 2000 - June 30, 200l; and

F-10 REQUEST FOR AUTHORlZATlON TO ACCEPT A -GRANT. AWARD FROM MEDIA ONE GROUP TO IMPROVE STUDENT ACHIEVEMENT AT ERNEST R GRAHAM ELEMENTARY SCHOOL, JULY 1, 2000 - JUNE 30, 200l

Ernest R Graham Elementary School has been awarded a grant- from Media One Group. The goal of the project is to create an interactive mathematics Internet website to promote uses of technology in education.

RECOMMENDED:
That The School Board of Miami-Dade County Florida, authorize the Superintendent to:

1. accept a grant award from Media One Group, in the amount of $10,000, to improve student achievement at Ernest R Graham Elementary School, July 1, 2000 - June 30, 2001; and

G-61 REQUEST FOR APPROVAL OF SUPPLEMENTAL AWARDS ON TERM BIDS

The purpose of this request is to obtain prior approval of supplemental awards on the following term bids, inasmuch as the estimated requirements, previously awarded by the Board, will be exceeded before the bid terms expire.

G-62 REPORT OF PURCHASES MADE UTIlLlZlNG OTHER GOVERNMENT BIDS

The following “Superintendent Authorized Requisitions” (SAR) have had a purchase order issued within guidelines of Board Rule 6Gx13-3C-1.10 - Purchase Approval, which allows purchases to be made from contracts established by Miami-Dade County, Florida, public agencies within the State, other city or county governmental agencies, other school boards, community colleges or state university system cooperative bid agreements, when such purchases are in the best interest of the School Board due to safety-to-life issues, federally funded requisitions with closing dates out of the established bid cycle, or to maximize economies of scale.
G-74 APPROVAL OF PAYMENTS

The Board is requested to approve payment of outstanding invoices as follows:

FOOD FANTASIES, INC., D.B.A. FROZEN TREATS

The Board is requested to approve payment of outstanding invoices to Food Fantasies, Inc., d.b.a. Frozen Treats, in the amount of $364,000.96, for the purchase of frozen desserts (low fat ice cream, ice cream, etc.). These products are used for a la carte sales and the Food Service Program of the Department of Food and Nutrition. Food Fantasies, Inc., exceeded its authorized purchase order amount, by shipping products at the verbal request of the Department of Food and Nutrition. A requisition was generated on December 7, 1999, to supplement the vendor’s purchase order, but was incorrectly electronically routed for approval. The pending requisition remained unapproved until it was routed to the appropriate administrator for final approval, and completed on May 8, 2000. The Department of Food and Nutrition has been requested to periodically review the computerized report listing pending requisitions, to prevent such an incident from recurring. Moreover, the department has been reminded that vendors are not authorized to ship products that will exceed its purchase order amount, inasmuch as supplements to purchase orders must have prior approval. The vendor has been advised not to ship products that will exceed the purchase order amount authorized by the Bureau of Procurement and Materials Management.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, APPROVE payment to the following vendors:

1. Food Fantasies, Inc., d.b.a. Frozen Treats, Inc., in the amount of $364,000.96, for the purchase of frozen desserts (low fat ice cream, ice cream, etc.) for the Food Service Program of the Department of Food and Nutrition.

G-95 AWARD OF REQUEST FOR PROPOSALS #191-2210 - COUNSELING SERVICES IN NINETEEN (19) PROGRAMS WITH FULL-TIME CLASSES FOR EMOTIONALLY HANDICAPPED STUDENTS

The purpose of this Request For Proposals, opened on April 27, 2000, is to establish a contract, at firm prices, to obtain the professional services of qualified individuals or agencies, in the field of mental health, to provide weekly group and/or individual counseling to students assigned to full-time classes for the emotionally handicapped, for the Division of Exceptional Student Education. This is a term bid which states that the Board may purchase quantities, as may be required, at the unit price bid, but is not obligated to purchase any guaranteed amount. Of 78 vendors sent proposal forms or card notices of this advertised proposal, 13 responded, with 10 proposals meeting specifications and 3 no proposals.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, AWARD Bid #191-2210 - COUNSELING SERVICES IN NINETEEN (19) PROGRAMS WITH FULL-TIME CLASSES FOR EMOTIONALLY HANDICAPPED STUDENTS, to establish a contract, at firm prices, to obtain the professional services of qualified individuals or agencies,, in the field of mental health, to provide weekly group and/or individual counseling to students assigned to full-time classes for the emotionally handicapped, for the Division of Exceptional Student Education, during the term of the bid, effective July 1, 2000, through June 30, 2001, as follows:

J-29 COMMISSIONING OF MIA CONSULTANTS TO PERFORM CONSTRUCTION CLAIMS CONSULTING SERVICES

Staff has completed the selection process for consultants to perform Construction Claims Consulting Services.

Nine (9) firms applied and five (5) firms were interviewed by the Selection Committee. Of these five (5) firms, MIA Consultants was selected.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1) commission the firm of MIA Consultants to perform Construction Claims Consulting Services for a two (2) year term, commencing June 21, 2000 and expiring June 20, 2002, with the second year being at the Board’s option, for the above 7 negotiated provisions. Since the second year is at the Board’s option, the one year extension must be approved and ratified by the Board prior to its commencement;

The School Board approved the original award to M.A.C. Construction, Inc. for Job Order Contracting Services at its meeting of June 23, 1999. Maintenance and Operations after evaluating the services rendered by M.A.C. Construction, Inc. is requesting authorization to renew the contractual agreement for an additional period of one year. This renewal provides for project continuity in accordance with the current contract.

RECOMMENDED: That The School Board of Miami-Dade County, Florida authorize the Superintendent to renew the contractual agreement with M.A.C. Construction, Inc., Contract No. JOC99A-North-M/WBE, with revised Adjustment Factors, commencing on the date that the current contract meets the maximum value or on June 22, 2000, whichever occurs first.


AGENDA ITEMS REPLACED AFTER PUBLICATION OF THE AGENDA:

A-3 EMPLOYEE BENEFITS PROGRAM FOR YEAR 2001

Subsequent to the information provided to the Board at its meeting of April 12, 2000 regarding employee benefit programs, staff has finalized negotiations for rates to be effective January 1, 2001 through December 31,2001. At the Board meeting of June 23, 1999, most rates for the flexible benefit options were approved for 2000,2001, and 2002. Therefore, the only approvals sought from the Board at this time, other than health insurance rates, are from Metropolitan Life Insurance Company for dental coverage, Oral Health Services, Optix Vision and U.S. Care for long term care coverage.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. approve the following monthly rates, inclusive of identified benefit changes, based upon a monthly Board contribution of $329 for benefit-eligible employees, effective January 1, 2001 through December 31, 200l:

A-4 RETIREMENT INCENTIVE PLANS FOR M-DCPS EXEMPT PERSONNEL (MANAGERIAL AND CONFIDENTIAL), PROFESSIONAL AND TECHNICAL PERSONNEL (DCSAA), AND CERTIFICATED INSTRUCTIONAL PERSONNEL (UTD) FOR 2001 AND 2002

In response to the uncertainty regarding the projected staff needs in Miami-Dade County Public Schools (M-DCPS) due to the State’s Deferred Retirement Option Program (DROP), staff is recommending that The Miami-Dade County School Board agree to offer enhanced Retirement Benefits to current exempt personnel (Managerial and Confidential), Professional and Technical Personnel (DCSAA). and certificated instructional personnel (UTD). Employees on a prescriptive status or re-employed retirees are not eligible.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. Authorize the Retirement Incentive Plans for M-DCPS Exempt Personnel (Managerial and Confidential), Professional and Technical Personnel (DCSAA), and Certificated Instructional Personnel (UTD) for 2001 and 2002; and


B-2 THAT THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA DIRECT THE SUPERINTENDENT OF SCHOOLS TO RECOMMEND LANGUAGE FOR A SCHOOL BOARD RULE CODIFYING THE DISTRICT’S POLlCY ON ETHNIC MODIFICATION

Miami-Dade County is home to persons originating from at least 164 countries. The multicultural nature of this community coupled with legal requirements for stating one race and/or ethnic group on offkial documents, including employment applications, has forced individuals to decide between two or more ethnic groups of which they are legitimately members.

ACTION PROPOSED BY DR MARTA PEREZ: That The School Board of Miami-Dade County, Florida direct the Superintendent of Schools to recommend language for a School Board Rule codifying the district’s policy on ethnic modification, by the August 23,2000 meeting.

B-4 REQUEST APPROVAL OF RESOLUTION NO. 00-22 OF THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, REAFFIRMING ITS COMMITMENT TO ACCOUNTABLE AND ETHICAL GOVERNMENT ACCORDING TO THE SUNSHINE AMENDMENT AND CODE OF ETHICS FOR PUBLIC OFFICERS AND EMPLOYEES, AND ADOPTING THE FLORIDA SCHOOL BOARDS ASSOCIATION’S STANDARDS FOR SCHOOL BOARD MEMBER BOARDSMANSHIP

Recent events in Miami-Dade County have eroded public confidence in government institutions. The Board has a unique opportunity to provide leadership by reaffirming its commitment to accountable and ethical government. Approval of Resolution No. 00-22 sends a strong and clear message to the community that the School Board serves its community diligently and responsibly.

ACTION PROPOSED BY DR MARTA PEREZ: That The School Board of Miami-Dade County, Florida, approve Resolution No. 00-22, of The School Board of Miami-Dade County, Florida, reaffirming its commitment to accountable and ethical government according to the Sunshine Amendment and Code of Ethics for Public Officers and Employees, and adopting the Florida School Boards Association’s Standards for School Board Member Boardsmanship.

At the School Board meeting of March 15, 2000, the Board authorized the contracted position of Public Information Officer. The position was advertised, following the Board-approved advertisement and selection process, and a candidate was selected and appointed at the April 12, 2000 School Board meeting. Unfortunately, the individual resigned because of personal reasons. The position was re-advertised, interviews were held and the Final Review Committee did not recommend a candidate to fill the position.

RECOMMENDED: That effective June 22, 2000, or as soon thereafter as can be facilitated, The School Board of Miami-Dade County, Florida:

1. Delete the contracted position of Public Information Officer.

Rodriouez to the open, budgeted position of Coordinator, Construction Management, pay grade 40, 12 months, and assign to Capital Improvement Projects, effective June 22, 2000, or as soon thereafter as can be facilitated.

G-100 AWARD OF REQUEST FOR PROPOSAiLS #221-2210 - APPLICANT -OUTSIDE AGENCIES QUALIFIED TO OPERATE ALTERNATIVE PROGRAMS FOR M-DCPS AT-RISK STUDENTS

The purpose of this Request For Proposals, opened on May 16, 2000, is to establish a contract, at firm prices, to provide services for children in at-risk alternative education programs, for the Bureau of Adult/Vocational, Alternative and Dropout Prevention Programs. This is a term proposal which states that the Board may purchase quantities, as may be required, at the unit price proposed, but is not obligated to purchase any guaranteed amount. Of 42 vendors sent proposal forms or card notices of this advertised proposal, 15 responded, with 15 proposals meeting specifications.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. AWARD Request For Proposals #221-2210 - APPLICANT -OUTSIDE AGENCIES QUALIFIED TO OPERATE ALTERNATIVE PROGRAMS FOR M-DCPS AT-RISK STUDENTS, to establish a contract, at firm prices, to provide services for children in at-risk alternative education programs, for the Bureau of Adult/Vocational, Alternative and Dropout Prevention Programs, during the term of the proposal, effective July 1, 2000, through June 30, 2001, as follows:

K-1 PROPOSED CONTRACTS FOR ASSISTANT BOARD ATTORNEYS

The contracts for the current in-house Assistant Board Attorneys expire June 30, 2000. The Board Attorney recommends that the in-house assistant attorneys be awarded new contracts with appropriate salary adjustments.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. Establish and classify the position of Deputy School Board Attorney;
