Miami-Dade County Public Schools is fortunate to have a fine group of teachers and administrative team at Miami Springs Senior High School. Year after year, the accomplishments and performance of these students validates the quality of our instructional team.

This request for change in the construction contract includes one item for the School Board’s consideration. Attachment A presents a description of the item, the cause for the change, the effect upon the contract, and the action recommended to the Board. This item is presented to the Board for consideration as required by State Statute.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve Change Order No. 2 on Project No. A-071 4, Design-Build for Addition at S/S "SS" @ Allapattah Middle Site for a time extension of 139 days.

E-35 SCHOOL SIZE

Beginning July 1, 2003, Florida Statute Chapter 235.2157 (attached) will require that all plans for new educational facilities to be constructed within a school district and reflected in the 5year school district facilities work plan shall be plans for small schools in order to promote increased learning and more effective use of school facilities.

RECOMMENDED: That the School Board of Miami-Dade County, Florida approve the use of the school within a school concept and direct staff to develop new facilities lists for Board approval based on the proposed new school sizes.

E-37 APPROVAL OF GUARANTEED MAXIMUM PRICE (GMP) FOR PIRTLE CONSTRUCTION COMPANY RELOCATABLE CLASSROOMS PROJECT NO. A0825

At it’s meeting January 16, 2001, the Board commissioned Pirtle Construction Company as the CM @ Risk for the relocatable classroom replacement project. This GMP phase provides for the purchase of 35 modular classrooms or conventional construction for two facilities, Felix Varela Senior High (24) and South Dade Senior High (11). The District has three options to meet the demands of the student population for Felix Varela Senior and South Dade Senior; Option No. 1 - Move Existing Relocatable Classrooms, Option No. 2 -Purchase Modular Units and Option No. 3 - Site-Build the Units With Conventional Construction.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the GMP for Pirtle Construction Company, Project No. A0825CM, Relocatable Classrooms, Option No. 3, Site-Build the Units with Conventional Construction of 35 classroom units in the amount of $3,500,000 which includes a contingency in the amount of $150,000. This option complies with Florida statutes.

G-68 PARTIAL AWARD BID NO. 063-BB08M/WBE - BALLASTS

The purpose of this bid, opened on February 12, 2002, is to establish a contract, to purchase, at firm unit prices, quantities, as may be required, of ballasts, for Maintenance Materials Management stock. This is a term bid which states that the Board may purchase quantities, as may be required, at the unit price bid, but is not obligated to purchase any guaranteed amount. This bid is a Minority/Women Business Enterprise (M/WBE) set-aside for African American/Women-owned and operated businesses. Of 28 vendors sent bid forms or card notices of this advertised bid, 6 responded, with 6 regular bids.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, AWARD Bid No. 063-BB08M/WBE - BALLASTS, to purchase, at firm unit prices, quantities, as may be required, of ballasts, for Maintenance Materials Management stock, during the term of the bid, effective April 17, 2002, through October 31, 2003, as follows:

D-13 REQUEST FOR APPROVAL OF RESOLUTION NO. 02-21 OF THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, RECOGNIZING THE PARTNERSHIP BETWEEN MIAMI-DADE COUNTY PUBLIC SCHOOLS AND THE FOUNDATION FOR DEMOCRACY IN AFRICA

On August 17, 2001, the School Board directed the Superintendent to collaborate with the Foundation for Democracy in Africa in establishing sister-school partnerships and student exchange programs with schools in Africa. Since then, representatives of the district, foundation and community have developed a pilot program to be introduced this fall at Carol City Elementary, Carol City Middle, and Miami Carol City Senior High schools.

ACTION PROPOSED BY DR ROBERT B. INGRAM: That The School Board of Miami-Dade County, Florida, approve resolution No. 02-21 of The School- Board of Miami-Dade County, Florida, recognizing the partnership between Miami-Dade County Public Schools and the Foundation for Democracy in Africa.

E-41 ADA MERRITT ELEMENTARY HISTORICAL RESTORATION PROJECT NO. A-0586

At the School Board meeting of September 25, 1996, citizens representing the Historical Building Preservation interests, asked the Board to restore the Ada Merritt Middle School. The Board agreed. After continuing with the design directive to save the structure, the project was awarded to James B. Pirtle, as Construction Manager at Risk, at the School Board meeting of April 18, 2001. The estimated cost of the remedial work is now double that identified last month and is increasing rapidly. The cost has increased by more than one million dollars over the $850,000 last requested. The cost of the historical restoration is projected to be greater than $152 per square foot.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

a) authorize staff to proceed with the removal of the existing facility as recommended by the architect, engineer and construction manager; and

b) amend the existing contracts as required to construct a replacement facility,

A-2 (B-6) REQUEST THAT THE SCHOOL BOARD OF MIAMI-DADE COUNTY AUTHORIZE THE SUPERINTENDENT TO REQUEST AN INCREASE OF THE STATUTORILY-IMPOSED CHARTER SCHOOL CAP ON A CASE-BY-CASE BASIS ACCORDING TO SPECIFIC CRITERIA AND RECEIVE THE BRIEFING PAPER: THE IMPACT OF PUBLIC CHARTER SCHOOLS IN MIAMI-DADE COUNTY

B-68 REQUEST FOR AUTHORIZATION TO ACCEPT A GRANT AWARD FROM THE FLORIDA DEPARTMENT OF EDUCATION FOR FUNDING UNDER THE PUBLIC CHARTER SCHOOLS FEDERAL GRANT PROGRAM AND ENTER INTO A CONTRACTUAL AGREEMENT WITH LIBERTY CITY CHARTER SCHOOL; PROJECT CYCLE: OCTOBER 15, 2001 THROUGH JUNE 30, 2002

The Florida Department of Education (FDOE) issued a Request for Proposals under the Public Charter Schools Federal Grant Program for the purpose of awarding grants to charter schools partnering with local educational agencies in order to provide a high quality education for all students. The Public Charter Schools Federal Grant Program provides funds only to those charter schools which have been approved by the local school district, and which have established a collaborative partnership for the oversight and operation of the charter schools. Funds received from this grant will be used to conduct training for operators and teachers of Florida public charter schools.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. accept a grant award from the Florida Department of Education, in the total amount of $100,000, for funding under the Public Charter Schools Federal Grant Program and enter into a contractual agreement with Liberty City Charter School, in an amount not to exceed $96,340; Project Cycle: October 15, 2001 through June 30, 2002;

2 . approve acceptance of the grant award, in accordance with Florida Statutes 228.056, Charter Schools, as well as United States Department of Education, Public Charter Schools Program, CFDA: 84.282A. This action is not an endorsement of the expansion activities undertaken by charter schools;

3. extend the grant award and contractual agreement, at no additional cost, for up to one year, as authorized through official notification from the granting agency, if deemed necessary, in order to fully expend the grant award and thus complete the scope of the project; and

4 . direct Financial Affairs to establish appropriations in the amounts approved by the granting agency; such appropriations to be reported periodically to the Board.

B-69 REQUEST FOR AUTHORIZATION TO ACCEPT A GRANT AWARD FROM THE NATIONAL COUNCIL OF JEWISH WOMEN TO EXPAND THE "BULLY PROOFING YOUR SCHOOL" PROJECT, PROJECT CYCLE: APRIL 18, 2002 THROUGH JUNE 30, 2003

The Office of Exceptional Student Education and Student Services developed and submitted a grant application to the National Council of Jewish Women (NCJW) for funding to expand the "Bully Proofing Your School" project to add an additional school site. Biscayne Elementary School is currently participating in the "Bully Proofing Your School" project. Through this grant, the project will be replicated at Nautilus Middle School. The school was selected based on demographics, location, and demonstration of need. The project seeks to make the school environment safe for all, both physically and psychologically, using a comprehensive process for recognizing and intervening in bullying situations. It empowers the "caring majority" of students to assist victims and to deny bullies the peer reinforcement that perpetuates their behavior.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. accept a grant award from the National Council of Jewish Women, in the amount of $5,000, to expand the "Bully Proofing Your School" project, Project Cycle: April 18, 2002 through June 30, 2003;

2. extend this grant award, at no additional cost, for up to one year, as authorized through official notification from the granting agency, if deemed necessary, in order to fully expend the grant award and thus complete the scope of the project; and

3. direct Financial Affairs to establish appropriations in the amounts approved by the granting agency; such appropriations to be reported periodically to the Board.

C-23 PROPOSED AMENDMENT OF BOARD RULES: FINAL READING 6Gx13- 6A-1.02, ELEMENTARY AND SECONDARY SCHOOL CALENDAR

D-4 THAT THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA DIRECT THE SUPERINTENDENT TO REVIEW ALL THE CURRENT PROCUREMENT BIDDING PROCEDURES FOR REQUESTS FOR PROPOSALS AND COMPETITIVE BIDS, INCLUDING- THE PROCUREMENT AND ACQUISITION OF ALL EMPLOYEE BENEFITS AND EMPLOYEE BENEFIT PROGRAMS, AND PROVIDE A REPORT TO THE BOARD AT THE MAY BOARD MEETING WITH RECOMMENDATIONS FOR IMPROVEMENTS AND POSSIBLE RULEMAKING AS TO THE MODEL PROCEDURES FOR BIDDING

At the March 5, 2002, Financial Affairs Committee Meeting, a discussion by Committee members, Board members and staff occurred. That discussion concerned the procedures set forth in two Miami Herald articles concerning requests for proposals. Those articles will be provided to the Board under separate cover. In one of the articles, a company accused the school district of unfair dealing in awarding contracts. These allegations cause concern over the current RFP/Bid proposal process. Additionally, in a recent administrative ruling, a DOAH Administrative Law Judge issued an 87-page ruling stating that the district showed "bias and favoritism" in choosing a drug screening company.

ACTION PROPOSED BY DR. MARTA PÉREZ: That The School Board of Miami-Dade County, Florida direct the Superintendent to review all the current procurement bidding procedures for requests for proposals and competitive bids, including the procurement and acquisition of all employee benefits and employee benefit programs, and provide a report to the Board at the May Board meeting with recommendations for improvements and possible rulemaking as to the model procedures for bidding.

G-88 AUTHORIZATION FOR PAYMENT

The Board is requested to approve payment to Virtual Learning Systems, in the amount of $24,000, for the purchase of curriculum materials for a Train the Trainer workshop. A staff member from the Division of Mathematics and Science Education authorized the vendor to ship goods without a valid purchase order. The Office was advised, in writing, of the unauthorized purchase, and directed to follow proper purchasing procedures, as stipulated by Board Rule 6Gxl3-3C-1.09 --Purchasing Department -- Board Designated Authority and 6Gx13-3C-1.14 --Ordering Goods and Services -- Authorization. Moreover, a memorandum issued by the supervising administrator, documenting that proper administrative procedures must be followed at all times, has been discussed and placed in the personnel file of the staff member.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, APPROVE payment to the following vendor: Virtual Learning Systems, for the purchase of curriculum materials for a Train the Trainer workshop, for the Division of - Mathematics and Science Education, for a total amount of $24,000.

G-89 REQUEST AUTHORIZATION TO UTILIZE OTHER ENTITY BIDS FOR PURCHASES OVER $100,000

Authorization is requested to utilize the State of Florida Contract No. 070-001-02-1 - AUTOMOBILES AND LIGHT TRUCKS, which expires on September 30, 2002, to purchase pickup trucks, for Maintenance. This contract is issued by the state and manufacturers bid through authorized dealers, offering special incentives and price concessions on their vehicles. The District receives better prices, using this contract, than issuing its own bid.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, AUTHORIZE Procurement and Materials Management, to utilize the following contracts:

1. State of Florida Contract No. 070-001-02-1 - AUTOMOBILES AND LIGHT TRUCKS, to purchase pickup trucks, for Maintenance, for a total amount of $522,564.

2. Florida Sheriffs Association Bid No. 01-09-0905 -PURSUIT, ADMINISTRATIVE NON-PURSUIT, UTILITY, FIRE & RESCUE VEHICLES, TRUCKS & VANS to purchase twenty-six (26) 2003 Ford Crown Victoria police vehicles, for the Miami-Dade County Schools Police Department, for a total amount of $537,653.

H-6 REQUEST FOR AUTHORIZATION TO ENTER INTO A CONTRACTUAL AGREEMENT WITH THE GALLUP ORGANIZATION EDUCATION SERVICES DIVISION FOR THE GALLUP PRINCIPAL PERCEIVER PROCESS

The Miami-Dade County Public Schools’ (M-DCPS) Leadership Assessment Process is designed to assess administrative potential. The Gallup Principal Perceiver Process (the Gallup Process) has been used by M-DCPS since 1996 as a follow up to the 1996 State of Florida Human Resource Management Development Audit Committee recommendation.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into a contractual agreement with the Gallup Organization Education Services Division of the Gallup Principal Perceiver Process from April 18, 2002 through April 18, 2003, at a cost not to exceed $21,000; this item will be brought to the Board annually for consideration of contract renewal for re-certification of assessors in the amount not to exceed $21,000 per year.

The appropriation for this item is included in the General Fund of the 2001-2002 Adopted Budget.


AGENDA ITEMS REPLACED AFTER PUBLICATION OF THE AGENDA:

B-1 REQUEST FOR SCHOOL BOARD APPROVAL OF A REDUCTION TO ONE PERCENT FROM THE FIVE PERCENT STATUTORILY PERMITTED ADMINISTRATIVE FEE, THE PROPOSED SITE, AND THE CHARTER SCHOOL CONTRACTUAL AGREEMENT FOR AVENTURA CHARTER ELEMENTARY SCHOOL

The School Board of Miami-Dade County, Florida, approved the charter school application for Aventura Charter Elementary School on December 12, 2001, and authorized the Superintendent to negotiate the charter school contractual agreement with the applicant for a term of 15 years commencing with the 2003-2004 school year.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. approve a reduction to 1% from the 5% statutorily permitted administrative fee in exchange for compliance with all of the five required conditions;

2. approve the charter school location; and

3. approve the charter school contractual agreement with Aventura Charter Elementary School, for a period of 15 years, commencing with the 2003-2004 school year.

B-2 REQUEST FOR SCHOOL BOARD APPROVAL OF THE CHARTER SCHOOL CONTRACTUAL AGREEMENT FOR BAYARD RUSTlN CHARTER SCHOOL

The School Board of Miami-Dade County, Florida, approved two charter school applications submitted by UTD-Edison Schools on December 13, 2000, for nine schools, and authorized the Superintendent to negotiate individual charter school contractual agreements with the applicant for a term of five years commencing with the 2003-2004 school year.

RECOMMENDED: Recognizing that The School Board of Miami-Dade County, Florida, has previously approved this site and application, it is recommended that the Board grant final approval of the charter school contractual agreement for the Bayard Rustin Charter School, for a period of 5 years, commencing with the 2003-2004 school year.

B-21 PROPOSED AMENDMENT TO SCHOOL BOARD RULE: INITIAL READING 6Gx13-6C-1.02, ADULT/VOCATIONAL EDUCATION SCHOOL CALENDAR - 2001-2002, TO REFLECT AN AMENDED BEGINNING/ENDING THIRD TRIMESTER START DATE FOR THE CURRENT SCHOOL YEAR

This item is submitted for consideration by the Board due to the critical financial shortage in the school district’s adult/vocational education budget. It is imperative to revise the existing School Board Rule 6Gx13-6C-1.02, Adult/Vocational Education School Calendar - 2001-2002 to minimize the effects of the budget reduction. The current calendar indicates that the term for the 2001-2002 is scheduled to commence on April 29, 2002, and end on August 8, 2002. A two-week delay in the beginning of this term would reflect a new starting date of May 13, 2002, and the ending date of August 21, 2002.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. authorize the Superintendent to initiate rulemaking proceedings in accordance with the Administrative Procedure Act to amend School Board Rule 6Gx13-6C-1.02, Adult/Vocational Education School Calendar - 2001-2002, to reflect the new starting date of May 13, 2002, and ending date of August 21, 2002, for the third trimester of the 2001-2002 school year;

2. permit selected school sites to continue operating under the previously approved 2001-2002 Adult/Vocational School Calendar; and

3. allow agencies, contracted programs, share-time and grant-funded programs to operate under the current 2001-2002 Adult/Vocational School Calendar.

D-9 EMPLOYEE EFFICIENCY AND COMPETITION AWARDS

Miami-Dade County Public Schools established an Efficiency and Competition Committee (ECC) in March of 2002 to assist the district in assessing the cost effectiveness of services and overseeing cost reduction initiatives.

ACTION PROPOSED BY MR. FRANK J. BOLAÑOS: That the School Board of Miami-Dade County, Florida direct the Efficiency and Competition Committee to develop an employee awards program to solicit, review and implement employee proposals for improvements in cost-efficiency as well as competitive bid projects.

D-10 FLORIDA COALITION AGAINST DOMESTIC VIOLENCE

Domestic violence is a crime that has an impact on many of the citizens in Miami-Dade and impacts the education of our children. When the security and comfort of a student or employee is affected because of violent acts at home, our mission in the classroom and as an employer is negatively impacted.

ACTION PROPOSED BY FRANK J. BOLAÑOS: That The School Board of Miami-Dade County, Florida authorize the Superintendent to direct staff to support the activities of the Florida Coalition Against Domestic Violence as appropriate and to allow any recognized student organizations to affiliate with FCADV for the purpose of raising awareness of domestic violence and promoting a statewide victims hotline.

D-12 REQUEST FOR APPROVAL OF RESOLUTION NO. 02-20 OF THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, HONORING MS. SIMINE HEISE, PRINCIPAL, MAYA ANGELOU ELEMENTARY SCHOOL, FOR BEING AWARDED THE "CHEVALIER DANS L’ORDRE DES PALMES ACADÉMIQUES" DIPLOMA BY THE FRENCH MINISTRY OF EDUCATION

Created in 1808 by Emperor Napoleon I, the "Chevalier dans l’Ordre des Palmes Académiques" diploma is the oldest honorific distinction given to a civilian by the French Government’s Ministry of Education. Individuals bestowed with this honor have distinguished themselves by their promotion of the French language and culture as well as related extracurricular and educational activities.

ACTION PROPOSED BY FRANK J. BOLAÑOS: That The School Board of Miami-Dade County, Florida, approve Resolution No. 02-20 of The School Board of Miami-Dade County, Florida, honoring M!s. Simine Heise, Principal, Maya Angelou Elementary School, for being awarded the "Chevalier dans l’Ordre des Palmes Académiques" diploma by the French Ministry of Education.

E-38 AUTHORITY TO AMEND THE CAPITAL CONSTRUCTION BUDGET

The capital construction budget is being amended to provide additional funding for completion of on-going projects, to closeout accounts and to transfer unused amounts to central reserves to provide contingencies for future use. The adjustments necessary to affect these changes are as follows:

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

(1) authorize staff to adjust the capital budget as detailed above, and in the event there are, at the time of transfer, insufficient available funds in a structure from which to transfer the indicated amount, the difference will be provided from Central Contingencies, reserves or other accounts; and

(2) authorize staff to make the changes to the five year facilities work program resulting from these budget adjustments.

F-3 AUDITOR GENERAL OF THE STATE OF FLORIDA’S REPORT NO. 92-195 - OPERATIONAL AUDIT OF BUDGET AND STAFF ALLOCATION PROCEDURES FOR MIAMI-DADE COUNTY DISTRICT SCHOOL BOARD, JULY 1, 2000 THROUGH JANUARY 31, 2002

The above-mentioned audit report by the Auditor General of the State of Florida was received on April 10, 2002 by e-mail. The report includes findings and recommendations as well as administrative staff responses.

RECOMMENDED: That The School Board of Miami-Dade County, Florida receive and file the Auditor General of the State of Florida’s Report No. 02-195 - Operational Audit of Budget and Staff Allocation Procedures for Miami-Dade County District School Board, July 1, 2000 through January 31, 2002, presented -by the Office of Management and Compliance Audits.

The Board’s current third party administrative services agreement for Section 125 Flexible Benefits and enrollment expires December 31, 2002 with Fringe Benefits Management Company. The Board authorized the re-marketing of this contract at the Board meeting of October 24, 2001, as a result of the recommendations contained within Agenda Item l-3, Internal Audit Report - Review of the District’s Internet Employee Benefits Enrollment. The OPPAGA report also recommends that the Board seek competitive proposals for this contract.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. authorize the Superintendent to issue Request For Proposal (RFP) # 093-BB10, Administrative Services -Section 125 Flexible Benefits Program and Enrollment;

The purpose of this bid, opened on March 28, 2002, was to establish a contract, for the commercial leasing of the parking facility at South Pointe Elementary School, for the Department of Site Acquisition and Leasing. Of 12 vendors sent bid forms or card notices of this advertised bid, 3 responded, with 2 bids meeting specifications and I no bid.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, REJECT Bid No. 070-BB10 - COMMERCIAL LEASING OF PAVED PARKING FACILITY AT SOUTH POINTE ELEMENTARY SCHOOL, to permit rebidding, using revised specifications,

H-5 APPOINTMENT OF ADMINISTRATIVE ASSISTANTS TO SCHOOL BOARD MEMBERS

Mr. Frank J. Bolaños, Member of The School Board of Miami-Dade County, Florida, recommends that Ms. Susana V. Castillo be contractually employed as his Administrative Assistant.

Dr. Marta Pérez, Member of The School Board of Miami-Dade County, Florida, recommends that Ms. Victoria Guerrero be contractually employed as her Administrative Assistant.
