G-3 RESOLUTION NO. I, 2001-02 CONTRACTED PROGRAMS FUND MID-YEAR BUDGET REVIEW

The Office of Budget Management is in the process of preparing Resolution No, 1, 2001-02 Contracted Programs Fund Mid-Year Budget Review. The resolution will amend the budget to reflect projections through June 30, 2002 after review of actual revenue receipts and expenditures through December 29, 2001. Copies of the resolution will be available no later than noon, February 8, 2002.

B-6 INITIATION OF ARBITRATION TO SETTLE CONTROVERSY AND CLAIM FOR MONEY DAMAGES ARISING FROM JOINT USE OF POLO PARK IN THE CITY OF MIAMI BEACH

The City of Miami Beach (“City”) and The School Board of Miami-Dade County, Florida (“M-DCPS”), entered into a Joint Use Agreement, dated January 20,1994, to provide and make available recreational programs, activities and facilities at Polo Park for the mutual use and benefit of M-DCPS and the City. The City and M-DCPS are in controversy over a demand by the City for payment of certain costs associated with alleged corrective work the City claims is necessary at Polo Park. The City is requesting M-DCPS to absorb costs for the corrective work in the amount of $270,000.00. M-DCPS is in disagreement with the City’s cost estimate, and the parties have been
unable to negotiate a settlement of the disagreement.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the initiation of arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association to settle the controversy and claim by the City of Miami Beach for payment of corrective work arising from joint use of Polo Park in the City of Miami Beach.

D-6 REQUEST FOR AUTHORIZATION TO PAY REAL ESTATE TAXES AND ASSESSMENTS

Staff of the Division of Governmental Affairs, Land Use Policy and Acquisition (Staff) has conducted research relative to outstanding property taxes alleged by Miami-Dade County (County) to be owed by the School District (District) in connection with real estate purchases, spanning the last decade.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize:

1. the Superintendent of Schools or his designee implement steps 1 through 4, as noted above; and to

J-12 REQUEST APPROVAL OF RESOLUTION No. 02-10 OF THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, SUPPORTING THE FLORIDA CONSTITUTIONAL AMENDMENT PROPOSED BY MR. ALEX PENELAS, MAYOR OF MIAMI-DADE COUNTY, FLORIDA, FOR THE IMPLEMENTATION OF UNIVERSAL PRE-KINDERGARTEN PROGRAMS

There are 953,181 children in the State of Florida under the age of five. Of those children almost 160,000 live in Miami-Dade County. According to Mayor Penelas’ Universal Pre-kindergarten Whitepaper, 30% of the children in Miami-Dade County entering kindergarten are not ready for school socially, emotionally, and cognitively.

ACTION PROPOSED BY PERLA TABARES HANTMAN: That The School Board of Miami-Dade County, Florida,
approve Resolution No. 02-10 of The School Board of Miami-Dade County, Florida, supporting the Florida
Constitutional Amendment proposed by Mr. Alex Penelas, Mayor of Miami-Dade County, Florida, for the
implementation of universal pre-kindergarten programs for all four-year-old children.

J-13 REQUEST FOR APPROVAL OF RESOLUTION NO. 02-11 OF THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, DESIGNATING MARCH 2002 AS CELTIC-AMERICAN HERITAGE MONTH TO BE CELEBRATED IN MIAMI-DADE COUNTY PUBLIC SCHOOLS

The descendants of immigrants from Ireland, Scotland, Wales and Galicia in Spain, as well as others of Celtic ancestry, have a long and distinguished history in the United States. They have made invaluable contributions to this country. Therefore, it is appropriate that the Board adopt the suggested resolution designating March 2002 as Celtic-American Heritage Month to be celebrated in all of Miami-Dade County’s Public Schools. This designation prompts our diverse community to become aware of, recognize and celebrate the many historic, cultural, social, educational and economic contributions, Celtic-Americans have made to the United States.

ACTION PROPOSED BY DR. MARTA PÉREZ: That The School Board of Miami-Dade County, Florida, approve Resolution No. 02-l 1 of The School Board of Miami-Dade County, Florida, designating March 2002 as Celtic-American Heritage Month to be celebrated in all of Miami-Dade County’s public schools.

C-14 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO EXPAND THE PRESENT CONTRACT WITH WOMEN IN NEED OF GREATER STRENGTH (W.I.N.G.S.) FOR LIFE, SOUTH FLORIDA, APPROVED ON THE BOARD MEETING OF JUNE 20, 2001, FROM 20 STUDENTS IN AN AMOUNT NOT TO EXCEED $120,680, TO 30 STUDENTS IN AN AMOUNT NOT TO EXCEED $145,820; EFFECTIVE FEBRUARY 14, 2002 THROUGH JUNE 30, 2002

In compliance with Section 230.23 (4)(c), (j), and (n), Florida Statutes, Miami-Dade County Public Schools Bureau of Adult/Vocational, Alternative and Dropout Prevention Programs and Deborah’s Way, a nonprofit organization in Miami-Dade County, have developed contractual agreements providing educational and related services for school-age students. Since June 2001, the Department of Juvenile Justice has increased allocations for ten additional students to said program. These students will be eligible for funding through the Florida Education Finance Program (FEFP). This program is funded yearly at 95 percent of the earned FTE. Supervision of this program is provided by the principal of the Educational Alternative Outreach Program.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to expand the present contract with Women in Need of Greater Strength (W.I.N.G.S.) for Life, South Florida, for 10 additional students, in an amount not to exceed $25,140, increasing the yearly contract from $120,680 to an amount not to exceed $145,820; effective February 14, 2002 through June 30, 2002.

The appropriation for this item is included in the 2001-2002 Adopted Budget.

D-5 AUTHORIZATION TO ACCEPT A DECLARATION OF RESTRICTIONS IN CONNECTION WITH ADMINISTRATIVE SITE PLAN REVIEW APPLICATION NO. 02-01, GULFSIDE DADELAND, LTD. (WILLIAMSON CADILLAC PROPERTY) FOR A CONTRIBUTION IN ADDITION TO EDUCATIONAL FACILITIES IMPACT FEES 

Introduction
Gulfside Dadeland, Ltd. (Applicant) is requesting an Administrative Site Plan Review for a mixed-use development on a 7.43-acre property currently occupied by Williamson Cadillac (Property). The property is located at the southeast corner of North Kendall Drive and Dadeland Boulevard.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to accept a new Declaration of Restrictions for Administrative Site Plan Review Application No. 02-01, Gulfside Dadeland, Ltd. (Williamson Cadillac Property) for a contribution in addition to educational facilities impact fees, under the terms and conditions set forth above.

Authorization of the Board is requested to waive Section II-D and F, of School Board Rule 6Gx13-4A-.16, Assignment, Transfer, and Appointment-Non-School Site Administrative Positions, for the position of Administrative Director, Food and Nutrition, MEP pay grade 24.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

a. waive the membership of the Interview and the Review Committees found in Section II, D and F. School Board Rule 6Gx13-4A-1.16, A s s i g n m e n t , Transfer, and Appointment-Non-School Site Administrative Positions, for the position of Administrative Director, Food and Nutrition, MEP pay grade 24; and

E-5 REQUEST FOR APPROVAL OF OUT-OF-FIELD TEACHERS FOR INSTRUCTIONAL PERSONNEL ASSIGNED TO TEACH-OUT-OF-FIELD IN THE BASIC K-12 PROGRAM, EXCEPTIONAL STUDENT EDUCATION, GIFTED EDUCATION, K-12 VOCATIONAL EDUCATION, AND ENGLISH FOR SPEAKERS OF OTHER LANGUAGES FOR THE 2001-2002 SCHOOL YEAR, FTE SURVEY 3

State Board of Education Rule 6A-I .0503 F.A.C. requires that instructional personnel assigned to teach out-of-field be approved by the School Board. Although many teachers appearing on the Out-of-Field Report are teaching only one class period out-of-field, Board approval is required by State Statute. All teachers who are teaching out-of-field are being monitored to insure compliance toward receiving appropriate certification within the required timeline.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the list of Out-of-Field Teachers for instructional personnel assigned to teach out-of-field in the Basic K-l 2 Program, the Exceptional Student Education Program, Gifted Education, the K-l 2 Vocational Education Program, and English for Speakers of Other Languages Program, for the 2001-2002 school year, FTE Survey 3.

G-61 REQUEST APPROVAL OF SUPPLEMENTAL AWARDS ON TERM BIDS

The purpose of this request is to obtain prior approval of supplemental awards on the following term bids, inasmuch as the estimated requirements, previously awarded by the Board, will be exceeded before the bid terms expire.

J-5 DIRECT SUPERINTENDENT TO REVIEW SCHOOL BOARD RULES AND LABOR CONTRACT PROVISIONS REGARDING EXTENDED PROFESSIONAL LEAVE WITHOUT PAY TO PROVIDE SPECIFIC GUIDELINES FOR GRANTING AND DENYING PROFESSIONAL LEAVE, AND CONSIDER DENYING EXTENDED PROFESSIONAL LEAVE TO EMPLOYEES WHO REQUEST SAID LEAVE WHILE BEING EMPLOYED WITH OUTSIDE ENTITIES THAT ARE DOING BUSINESS WITH THE SCHOOL BOARD

Board Rule 6Gx13-4E-1.09, states that employees on extended professional leave without -pay may engage "in activities for which no college credit is granted provided it is determined by the Superintendent of Schools or designee that these activities will enhance the employee’s professional competence." However, this rule does not provide specific guidelines forming the basis for granting or denying this type of leave.

ACTION PROPOSED BY DR. MARTA PÉREZ: That The School Board of Miami-Dade County, Florida, direct the Superintendent to review School Board Rules and labor contract provisions regarding extended professional leave without pay, and provide recommendations for amending same in order to establish clear guidelines for the granting or denial of extended professional to employees who will be employed with firms doing business with the school district.

LEGISLATIVE ACTION AND FUNDING FOR THE 2002 SUMMER PROGRAM


Lacking necessary action by the State Legislature, funding of the 2002 Summer School Program is not finalized. The Governor’s budget continues the summer program within the Supplemental Academic Instruction (SAI) Program. The SAI Program permits these funds to be used for an extended school year, after school instruction, tutoring, extended
day, and/or mentoring programs.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

(1) authorize the implementation of educational programs for the 2002 Summer School Program, including the Alternative Delivery Pilot Summer Camp Programs K-8 and the Collaborative Parks and Recreation Initiative, for elementary schools and middle schools July 8,2002 through July 30,2002, and for senior high schools July
8, 2002 through August 13, 2002;

C-9 REQUEST FOR SCHOOL BOARD APPROVAL OF THE CHARTER SCHOOL CONTRACTUAL AGREEMENT FOR DOWNTOWN DEVELOPMENT AUTHORITY CHARTER SCHOOL

The School Board of Miami-Dade County, Florida, approved the charter school application for Downtown Development Authority Charter School on December 13, 2000, and authorized the Superintendent to negotiate the charter school contractual agreement with the applicant for a term of ten (10) years commencing with the 2002-2003 school year. The Charter School Contract Review Committee met on February 7, 2002, and by a majority vote, made a recommendation for approval of the charter school contractual agreement.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the charter school contractual agreement with Downtown Development Authority Charter School, for a period of ten years, commencing on the first day of the 2002-2003 school year.

E-13 SUSPENSION AND REDIRECTION OF EMPLOYEE
LUIS C. GARCIA - DIRECTOR I  
DEPARTMENT OF TRANSPORTATION


On February 12, 2002, the Superintendent of Schools sent the following letter to Mr. Luis C. Garcia:
I am exercising my responsibility as Superintendent of Schools and recommending to The School Board of Miami-Dade County, Florida, at its scheduled meeting of February 13, 2002, that the School Board suspend you for 30 workdays, and accept your request for career redirection from your current position as Director I at Department of Transportation, to the position of Coordinator I, effective at the close of the workday, February 13, 2002, for just cause, including, but not limited to: misconduct in office; violation of School Board Rule 6Gx13-4A-1.21, Responsibilities and Duties; and violation of M-DCPS Assigned Vehicles Procedures.

RECOMMENDED: That effective February 13, 2002, at the close of the workday, the School Board suspend Mr. Luis C. Garcia for 30 workdays and accept his request for career redirection from his current position as Director I at Department of Transportation to the position of Coordinator I; waiving the right to a hearing.

E-14 DEMOTION OF EMPLOYEE
LOUIS ALLEN, JR. - SENIOR HIGH SCHOOL PRINCIPAL
MIAMI JACKSON SENIOR HIGH SCHOOL

On February II, 2002, the Superintendent of Schools sent the following letter to Mr. Louis Allen, Jr.: I am exercising my responsibility as Superintendent of Schools and recommending to The School Board of Miami-Dade County, Florida, at its scheduled meeting of February 13, 2002, that the School Board demote you from your current position as Principal, at Miami Jackson Senior High School, to Assistant Principal, effective at the close of the workday, February 13, 2002, for just cause, including, but not limited to: incompetency; willful neglect of duty; gross insubordination; breach of statutory duties; failure to adhere to the Manual of Internal Accountinq and the Manual of Procedures for Managerial Exempt Personnel; and violation of School Board Rules 6Gx13-1C-1.08, Gifts to School Personnel; 6Gx13-1C-1.09, Fund Raising Drives among Employees and Selling of Merchandise or Services by Employees; 6Gx13-6A-1.24, Authorized Student Fees in Secondary Schools; and 6Gx13-4A-1.21, Responsibilities and Duties. This action is taken in accordance with Sections 230.03(2), 230.23(5)(f), 231.36(6)(a), 231.36(4)(c), 231.36(6)(b), 237.211, and 447.209, Florida Statutes.

RECOMMENDED: That effective February 13, 2002, at the close of the workday, the School Board demote Mr. Louis Allen, Jr., as Principal, at Miami Jackson Senior High School, to Assistant Principal, pending the outcome of a hearing, if requested.

G-2 RESOLUTION NO. 1, 2001-02 CAPITAL OUTLAY FUNDS MID-YEAR BUDGET REVIEW

This Capital Outlay Resolution will recognize new revenues, changes to appropriations, and various changes in object codes made since budget adoption.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. Approve Resolution No. I, 2001-02 Capital Outlay Budget Funds Mid-Year Budget Review, 

(a) recognizing new revenues and other sources, 

(b) amending appropriations, and

(c) documenting changes in object codes, as described above and summarized on page 5 of 6.

2. Authorize changes to the Five-Year Facilities Work Program which result from Resolution No. I, 2001-02 Capital Outlay Funds Mid-Year Budget Review.

G-92 PARTIAL AWARD BID NO. 119-AA11 - AUDIO VISUAL, TELEVISION, RADIO, STUDIO EQUIPMENT, CCTV AND PERIPHERALS - CATALOG DISCOUNT

The purpose of this bid, opened on July 10, 2001, is to establish a contract, to purchase, at firm discounts, quantities, as may be required, of audio visual, television, radio, studio equipment, cctv and peripherals, for various schools and departments. This is a term bid which states that the Board may purchase quantities, as may be required, at the unit price bid, but is not obligated to purchase any guaranteed amount, and was under protest for six months. Of 443 vendors sent bid forms or card notices of this advertised bid, 95 responded with 23 bids meeting specifications (not all vendors bid all items), and 38 no bids.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, AWARD Bid No. 119-AA11 - AUDIO VISUAL, TELEVISION, RADIO, STUDIO EQUIPMENT, CCTV AND PERIPHERALS - CATALOG DISCOUNT, to establish a contract, to purchase, at firm discounts, quantities, as may be required, of audio visual, television, radio, studio equipment, cctv and peripherals, for various schools and departments, during the term of the bid, effective February 13, 2002, through February 12, 2003, as follows:

J-6 RE-CONVENE THE PAPER REDUCTION TASK FORCE TO PROVIDE A STATUS REPORT ON PREVIOUS RECOMMENDATIONS, UPDATE ITS ORIGINAL RECOMMENDATIONS AND DEVELOP NEW STRATEGIES FOR REDUCING PAPER IN ADMINISTRATIVE FUNCTIONS.

In addition to its central mission of educating our community, Miami-Dade Public Schools is a $4.2 billion enterprise with the same challenges and needs facing major corporations in the business sector today. Communicating and conducting transactions through various levels of the organization do not seem to have adapted to more efficient,
cost-effective and electronic means of communication such as through email and the Internet.

ACTION PROPOSED BY FRANK J. BOLAÑOS: That The School Board of Miami-Dade County,
Florida, authorize the Superintendent to re-convene the Paper Reduction Task Force to provide a status report, update its original recommendations, present new strategies for reducing paper in administrative functions and report back to the Board within 120 days.

J-9 REQUEST THE SUPERINTENDENT TO CONDUCT A STUDY ON THE ADVANTAGES AND DISADVANTAGES OF HAVING DOUBLE SESSIONS, ESPECIALLY IN MIAMI-DADE COUNTY PUBLIC SCHOOLS

School overcrowding is one of the primary challenges facing Miami-Dade County Public Schools. Additionally, there is no anticipated slowdown in the population growth, thus the existing conditions are expected to remain constant or worsen. Traditionally, the solution to overcrowding is new construction or the placement of relocatable classrooms
in existing facilities. However, in light of the circumstances described, it is prudent that this district engage in activities that explore alternative solutions to overcrowding.

ACTION PROPOSED BY MS. BETSY H. KAPLAN: That The School Board of Miami-Dade County, Florida, direct the Superintendent of Schools to conduct a study on the advantages and disadvantages of double sessions in the secondary schools. The study should be presented at the May 15, 2002, School Board meeting and should include parents’ and staff input as well as the fiscal impact.

J-11 REQUEST FOR APPROVAL OF RESOLUTION NO. 02-08 OF THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, ENDORSING MARCHAS “MUSIC IN OUR SCHOOLS MONTH” TO BE CELEBRATED IN ALL OF MIAMI-DADE COUNTY’S PUBLIC SCHOOLS

Involvement with music, from performance to appreciation, provides valuable experience that broadens students’ understanding, perception and aesthetic sense of the world around them. Additionally, it plays an important part in intellectual development.

ACTION PROPOSED BY MS. BETSY H. KAPLAN: That The School Board of Miami-Dade County, Florida, approve Resolution No. 02-08 of the School Board of Miami-Dade County, Florida, endorsing March as "Music in Our Schools Month" to be celebrated in all of Miami-Dade County’s public schools.
