Speakers Supplemental List will generally be posted on Tuesday PM or Wednesday AM prior to the meeting.

Citizens who wish to speak on matters not on the agenda, or on agenda items that appear on the consent agenda, will be heard at the public hearing held at approximately 6:30 p.m. during the regularly scheduled Board meeting. The total time allotted for the public hearing shall not exceed one and one-half hours.

Pursuant to Board Rule 6Gx13-8C-1.17, a person not scheduled in advance to speak on a non-agenda topic must submit, either before or during the regularly scheduled meeting, a written request to the Chair. The request must state the person's name, address and subject. Board members present at the meeting must vote by a majority for the person to be heard.

The School Board of Miami-Dade County, Florida, seeks public input and participation. However, the public purpose is not served when citizens become disorderly or disrupt the meeting. Accordingly, the Chair may order the removal from any School Board meeting of any person interfering with the expeditious or orderly process of the meeting provided the Chair has first issued a warning that continued interference with the orderly processes of the meeting will result in removal. Any law enforcement authority or a sergeant-at-arms designated by Chair shall remove any person ordered removed pursuant to this section §1001.372 (3), Fla.Stat.

MOMENT OF SILENT MEDITATION

At its regular public meeting on June 17, 2009, the School Board voted to approve a two-month pilot project to allow the Board to present its resolutions, endorsements, and proclamations at a specified time before its regular public meeting. At the August 5, 2009 meeting, the Board voted to extend this pilot project through the December 9th, meeting with the exception that the starting time of this segment of the meeting will be changed to 12:00 noon.

Proposed Board member resolutions, endorsements, and proclamations will be presented and; upon vote being taken, the Board will recess to present the approved resolutions.

The Board will then reconvene the regular public meeting, including other hearings, in accordance with the Rules of the Board, at 1:00 p.m.

ACTION PROPOSED BY MS. ANA RIVAS LOGAN: That The School Board of Miami-Dade County, Florida, approve Resolution No. 09-122 of The School Board of Miami-Dade County, Florida, recognizing Robert Morgan Educational Center, John A. Ferguson, Homestead, and South Dade senior high schools for setting the Guinness World Record for the largest serving of guacamole.

1. enter into a contractual agreement with Empower U to provide HIV/STD counseling, testing and support related services within the Miami Central Senior High School Feeder Pattern, in an amount not to exceed $40,000, effective November 20, 2009, through October 31, 2010;

2. grant an exception to School Board Rule 6Gx13- 3F-1.021 as Empower U has specific expertise in providing HIV counseling and testing.

C-70 WITHDRAWAL OF AGENDA ITEM C-70 - REQUEST AUTHORIZATION FOR THE SUPERINTENDENT TO ACCEPT A DONATION OF A MCDONNELL DOUGLAS, DC-9-82 AIRCRAFT FROM AMERICAN AIRLINES, VALUED AT $6,000,000 TO BE UTILIZED TO ENHANCE TRAINING IN THE AVIATION MAINTENANCE AND AVIONICS PROGRAMS AT GEORGE T. BAKER AVIATION SCHOOL

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to accept a donation of a McDonnell Douglas, DC-9-82 (MD-82) aircraft from American Airlines valued at $6,000,000, to be utilized to enhance training in the Aviation Maintenance and Avionics programs at George T. Baker Aviation School.

No local funds are required.

C-80 REQUEST AUTHORIZATION TO ACCEPT A GRANT AWARD FROM THE FLORIDA DEPARTMENT OF EDUCATION (FLDOE) THROUGH STATE STABILIZATION FUNDS UNDER THE AMERICAN RECOVERY AND REINVESTMENT ACT TO FUND THE LEARNING FOR LIFE CHARACTER EDUCATION PROGRAM AND TO ENTER INTO A CONTRACTUAL AGREEMENT WITH LEARNING FOR LIFE, INC.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. accept a grant award from the Florida Department of Education (FLDOE) through State Stabilization Funds under the American Recovery and Reinvestment Act to fund the Learning for Life character education program in the approximate amount of $236,500, for the grant period of July 1, 2009, through June 30, 2010;

2. enter into a contractual agreement with Learning for Life, Inc., in the approximate amount of $236,500, for the contract period of July 1, 2009, through June 30, 2010;

3. extend this program and contractual agreement as authorized through official notification from the granting agency in order to complete the goals of the program; and

4. direct Financial Services to establish appropriations in the amount approved or as amended by the granting agency; such appropriations to be reported periodically to the Board.

C-81 REQUEST AUTHORIZATION TO ACCEPT sIX (6) GRANT AWARDs FROM THE FLORIDA DEPARTMENT OF EDUCATION (FLDOE) FOR FUNDING UNDER THE PUBLIC CHARTER SCHOOL GRANT PROGRAM

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. accept six (6) grant awards from the Florida Department of Education (FLDOE) for funding under the Public Charter School Grant Program in the approximate total amount of $1,116,600;

2. disburse grant funds in the approximate amount of $1,108,464, to:

i. Excel Academy, Inc., on behalf of Excel Academy Charter School, North, in the amount of $200,000, for the grant period of July 1, 2009 through July 31, 2010;

ii. Lawrence Academy, Inc., on behalf of Lawrence Academy Elementary Charter School, in the amount of $73,364, for the grant period of September 1, 2009 through July 31, 2010;

iii. Lincoln-Marti Charter Schools, Inc., on behalf of Lincoln-Marti Charter School (Hialeah Campus), in the amount of $250,000, for the grant period of July 1, 2009 through July 31, 2010;

iv. Miami Community Charter School, Inc., on behalf Miami Community Charter High School, in the amount of $196,792, for the grant period of July 1, 2009 through July 31, 2010;

v. Advantage Academy of Miami, Inc., on behalf of Summerville Advantage Academy, in the amount of $138,579, for the grant period of September 17, 2009 through December 31, 2009; and

vi. Miami Arts, Inc., on behalf of Miami Arts Charter School, in the amount of $249,730, for the grant period of July 1, 2009 through July 31, 2010.

3. retain funds from the grants in an amount not to exceed the annually negotiated indirect cost rate, as allowed and approved by the FLDOE;

4. extend these programs as authorized through official notification from the granting agency in order to complete the goals of the program; and

5. direct Financial Services to establish appropriations in the amounts approved or as amended by the granting agency; such appropriations to be reported periodically to the Board.

C-82 REQUEST AUTHORIZATION TO ACCEPT A GRANT AWARD FROM THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) TO FUND THE HIGHWAY SAFETY PROGRAM, IMPLEMENTATION OF TRAFFIC DATA COLLECTION

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. accept a grant award from the Florida Department of Transportation (FDOT) to fund the Highway Safety Program, Implementation of Traffic Data Collection, in the approximate amount of $61,040, for the grant period of October 1, 2009, through September 30, 2010;

2. extend this program as authorized through official notification from the granting agency in order to complete the goals of the program; and

3. direct Financial Services to establish appropriations in the amounts approved or as amended by the granting agency; such appropriations to be reported periodically to the Board.

C-100 PROPOSED AMENDMENT OF BOARD RULE: FINAL READING 6Gx13‑ 6A-1.331, PROCEDURES FOR PROVIDING SPECIAL EDUCATION FOR EXCEPTIONAL STUDENTS

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. adopt amended School Board Rule 6Gx13- 6A-1.331, Procedures for Providing Special Education for Exceptional Students, and authorize the Superintendent of Schools to file the rule with The School Board of Miami-Dade County, Florida, effective November 17, 2009; and

2. authorize the Superintendent of Schools to submit Exceptional Student Education Policies and Procedures (SP&P) Effective Dates: 2009-2010 through 2011-2012, to the Florida Department of Education.

D. SCHOOL SUPPORT ACCOUNTABILITY

D-10 RATIFICATION OF THE 2009-2012 TENTATIVE AGREEMENT (SUCCESSOR CONTRACT) BETWEEN MIAMI-DADE COUNTY PUBLIC SCHOOLS (M-DCPS) AND THE AMERICAN FEDERATION OF STATE, COUNTY, AND MUNICIPAL EMPLOYEES, LOCAL 1184 (AFSCME) (revised replacement)

RECOMMENDED: That The School Board of Miami-Dade County, Florida, ratify the 2009-2012 Tentative Agreement (Successor Contract) with the American Federation of State, County, and Municipal Employees, Local 1184 (AFSCME), effective July 1, 2009 through June 30, 2012. If the Tentative Agreement is not ratified by a majority vote of employees voting, the School Board's ratification will not be effective.

D-11 RATIFICATION OF THE 2009-2012 TENTATIVE AGREEMENT (SUCCESSOR CONTRACT) BETWEEN MIAMI-DADE COUNTY PUBLIC SCHOOLS (M-DCPS) AND THE DADE COUNTY SCHOOL MAINTENANCE EMPLOYEE COMMITTEE (DCSMEC) (replacement)

1. Prohibit school bus drivers from using any data transmission device while operating a School Board vehicle and to provide an exception for certain emergencies;

2. Prohibit the use of data transmission devices that are not hands-free by all other employees, except School Police, while operating School Board owned vehicles, and providing an exception for certain emergencies; and

3. Provide that any employee who violates these rules will be subject to disciplinary action.

1. direct the Superintendent to conduct a workshop before the end of this calendar year that allows the Superintendent and Board Members to discuss proper use of our accounts and ways of minimizing expenses that are, or give the appearance of, campaigning;

2. direct the Superintendent to provide a report, no later than the February 2010 School Board Meeting, on what School Board Member controlled monies have been used in campaigning activities that could have been used for other educational purposes.

3. request the Ethics Committee to recommend language that strengthens the Board Rule regarding the prohibition of the practice whereby Board Members and administrators use their influence to solicit support and/or collect political donations from employees.

ACTION PROPOSED BY DR. MARTA PÉREZ, VICE CHAIR: That The School Board of Miami-Dade County, Florida, ask the Superintendent to look into and report to the Board on actions to make students aware of their responsibility to their classmates, their community and those in need. These recommendations should help us to encourage a culture of "the Good Samaritan" at our School District. They may include, but are not limited to, that we revise the "Code of Student Conduct", we adopt a month dedicated to values, forums, and any other strategies/policies that may be helpful to achieve our goals. The Superintendent should report to the Board no later than March, 2010.
