For 20 years Rev. G. David Horton has provided dedicated service and leadership to this community. As pastor of the Greater New Bethel Missionary Baptist Church, he has provided the proper guidance necessary for many hundreds to lead fulfilling and unselfish lives. His upstanding family is evidence of his great teachings. During the entire month of July, the community will celebrate Rev. Horton’s great achievements. On August 1, 1999, the celebration will culminate at a ceremony with his congregation.

K-3 PROVISION OF DEFENSE COUNSEL TO ALBA ALLISON IN THE CASE OF LILLIAN D. BERTOT V. ALBA ALLISON, Circuit Court Case No. 99-14688 CA 09

The above styled lawsuit was filed in the State Court of the Eleventh Judicial Circuit in and for Miami-Dade County, Florida and served on July 8, 1999 on Alba Allison, Foreign Language Chairperson at Miami Jackson Senior High School. The lawsuit alleges that Defendant made defamatory remarks about Plaintiff, a former coworker, and thus impeded Plaintiffs attempts to gain employment with the School Board.

We do not believe that the lawsuit has merit and are requesting that the School Board, pursuant to the authority vested in it under $230.234, Florida Statutes (1997), authorize a legal defense for Ms. Allison.

This item does not appear on the published Agenda. There is good cause to vary from the Agenda because a response to the Complaint is required prior to the next regularly scheduled School Board Meeting.

RECOMMENDED:

K-4 THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA v. MICHAEL EXELBERT - CASE NO. (Unassigned)

By letter received in the Office of School Board Clerk on July 7, 1999, a request for hearings was filed on behalf of administrator Michael Exelbert to contest the non-reappointment of his contract as principal and various actions purportedly taken as to his constitutional property and liberty interests.

The Office of the School Board Attorney is recommending that the School Board grant in part and deny in part, the request for administrative hearings as set forth in the proposed order submitted under separate cover.

There is good cause to vary from the agenda because School Board Rule 6Gx13-K-1.064, section II D3, provides that a request for hearing be granted or denied within fifteen (15) calendar days of receipt. The deadline expires on July 22, 1999, prior to the Board’s regularly scheduled August meeting. This item does not appear on the published agenda.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, enter its final order in The School Board of Miami-Dade County, Florida v. B-2 (formerly B-7) REQUEST FOR THE SUPERINTENDENT TO PREPARE A REPORT OUTLINING CURRENT AND FUTURE DISTRICT ACTIONS TO IMPROVE ACHIEVEMENT IN THE FLORIDA COMPREHENSIVE ASSESSMENT TEST

The Florida Department of Education’s School Accountability Report has created an emergency climate in our community as it relates to student achievement in the Florida Comprehensive Assessment Test (FCAT). Inasmuch as the community at large, but particularly parents, expect The School Board of Miami-Dade County, Florida, to provide the leadership in raising student achievement, it is hereby requested that the Superintendent be directed to develop and transmit to the Board Members a report that includes:

That The School Board of Miami-Dade County, Florida, direct the Superintendent to develop and transmit to the Board Members a district plan for the improvement of student achievement in the Florida Comprehensive Assessment Test.

(formerly B-2) DIRECT THE SUPERINTENDENT TO ESTABLISH PROCEDURE FOR SYSTEMATIC BOARD REVIEW AND RENEWAL OF CHARTER SCHOOL CONTRACTS

To insure that all students under the authority of the Miami-Dade County Public School Board receive the best possible education, it is proposed that the Superintendent shall establish a procedure which charter schools will be reviewed annually, with the results presented to this Board. Additionally, a systematic procedure shall be established to allow this board adequate time to review contract renewal requests. These procedures shall include, but not limited to, the following provisions:

ACTION PROPOSED BY DR. MARTA PEREZ: That The School Board of Miami-Dade County, Florida, direct the Superintendent of Schools to establish procedures for the review and renewal of charter school contracts consistent with the provisions set forth above.

AUDIT OF TEEN-PREGNANCY PREVENTION PROGRAMS AND EARLY-EDUCATION PROGRAMS

Adolescent pregnancy rates are declining, reports the Health and Human Service National Center for Health Statistics. In Florida, for example, the birthrate among 15-through-l9-year-old girls has fallen from 68 per 1000 girls to 61, but there is still a need for further reductions. Fifty percent of adolescents with children become pregnant again within two years of the baby’s birth, according to a University of Maryland study. The study adds that in 1996, 22 percent of births to adolescent mothers were repeat births, i.e. a second or third child. The study also found that an adolescent mother who returns to school after the first birth is less likely to have a repeat birth.

ACTION PROPOSED BY DR. MARTA PÉREZ:
That The School Board of Miami-Dade County, Florida, direct the Superintendent of Schools to - bring back to the Board a report on this district’s approach to combating teen pregnancy and its efforts to provide quality early-childhood education in agreement with the intent stated above.

C-11 REQUEST FOR CONFIRMATION OF A CONTRACTUAL AGREEMENT WHEREBY MIAMI-DADE COUNTY PUBLIC SCHOOLS WILL RECEIVE FUNDS, IN AN AMOUNT NOT TO EXCEED $66,425, FROM MIAMI-DADE COMMUNITY COLLEGE WHICH WILL ALSO PROVIDE SERVICES TO MIAMI-DADE COUNTY PUBLIC SCHOOLS GRADUATES PARTICIPATING IN THE SUMMER MENTORSHIP INSTITUTE FROM JUNE 28, 1999 THROUGH AUGUST 13,1999

STRATEGIC PLANNING GOAL: II -STUDENT ACHIEVEMENT /PREPARATION FOR POST SECONDARY EXPERIENCES

A joint-venture Summer Mentorship Institute (SMI) will be conducted this summer, in collaboration with the Florida Department of Juvenile Justice (DJJ), Miami-Dade Community College/North Campus (M-DCC/N), and Miami-Dade County Public Schools (M-DCPS), to assist 75 high schools graduates in obtaining the life skills they need to be productive, responsible employees. This joint venture has been in effect since 1997 for a total of two years.

RECOMMENDED:
That The School Board of Miami-Dade County, Florida, confirm a contractual agreement whereby Miami-Dade County Public Schools will receive funds, in an amount not to exceed $66,425, from Miami-Dade Community College which will also provide services to Miami-Dade County Public Schools graduates participating in the Summer Mentorship Institute from June 28, 1999 through August 13, 1999.

No local funds are required.

C-13 REQUEST FOR APPROVAL OF THE 1999 - 2000 BOARD OF TRUSTEES OF THE MIAMI-DADE COALITION FOR COMMUNITY EDUCATION

STRATEGIC PLANNING GOAL: IX - COMMUNITY/ HOME/PARENT/SCHOOL/BUSINESS PARTNERSHIPS

The Miami-Dade Coalition for Community Education is a Florida not-for-profit corporation which complies with the terms set forth in School Board Rule 6Gx13- 1 B-l .08, School Board Direct-Support Organizations. The mission of the coalition is to provide resources through adult and community education programs which will assist pre-kindergarten through adult public school students in Miami-Dade County. Annual School Board approval of the Board of Trustees is required as per Board Rule.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the 1999-2000 Board of Trustees of the Miami-Dade Coalition for Community Education.

C-15 REQUEST AUTHORIZATION FOR THE SUPERINTENDENT TO RENEW A CONTRACTUAL AGREEMENT WITH PARTNERS FOR AMERICAN VOCATIONAL EDUCATION, IN AN AMOUNT NOT TO EXCEED $153,000, FROM JULY 15,1999 THROUGH AUGUST 30,200O

STRATEGIC PLANNING GOAL: IX - COMMUNITY/ HOME/PARENT/SCHOOL/BUSINESS PARTNERSHIPS

The Partners for American Vocational Education (PAVE), an education and training foundation, in collaboration with Miami-Dade County Public Schools, has developed and implemented a post secondary curriculum in residential construction at William H. Turner Technical Arts High School. The program, a component of the training network sponsored by the National Association of Home Builders and PAVE, is based upon nationally recognized industry standards, and graduates are certified as skilled workers.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to renew a contractual agreement with the Partners for American Vocational Education, in an amount not to exceed $153,000, from July 15, 1999 through August 30,2000, to provide a six-month training program in residential construction for 30 post secondary students.

The appropriation for this item will be included in the General Fund of the 1999-2000 Tentative Budget to be recommended for adoption on July 26, 1999.

E-6 APPOINT AND ASSIGN:
SPECIALIST, REAL PROPERTY DEVELOPMENT
AND ACQUISITION

The following recommendation is made in accordance with the Miami-Dade County Public Schools/Dade County Schools Administrators’ Association labor contract. This open budgeted position is due to the promotion of the incumbent. Ms. Vivian G. Villaamil, currently a Data Input Specialist, is recommended for appointment to the open, budgeted position of Specialist, Real Property and Acquisition, pay grade 39. Ms. Villaamil received a Bachelor of Arts Degree from Florida International University, Miami, Florida, and a Juris Doctor Degree from the University of Miami, Florida. From 1984 to 1995, Ms. Villaamil was Vice-President, Co-Owner, Administrator and Chief Closer for Riviera Title Company, Miami, Florida. Since 1995 to the present, Ms. Villaamil has been employed by Miami-Dade County Public Schools as a Paraprofessional and a Data Input Specialist, her current position.

This recommendation is the direct result of the Board-approved advertisement and selection process.

RECOMMENDED:
That The School Board of Miami-Dade County, Florida, appoint Vivian G. Villaamil, to the open budgeted position of Specialist, Real 1 Property Development and Acquisition, pay grade 39,12 months, and assign to Governmental Affairs and Land Use Policy and Acquisition, effective July 15, 1999, or as soon thereafter as can be facilitated.
E-15 DISMISSAL OF EMPLOYEE
HECTOR PEREZ - TEACHER
G.W. CARVER MIDDLE SCHOOL

On June 30, 1999, the Superintendent of Schools sent the following letter to Mr. Hector Perez:

I am exercising my responsibility as Superintendent of Schools and recommending to The School Board of Miami-Dade County, Florida, at its scheduled meeting of July 14,1999, that the School Board suspend you and initiate dismissal proceedings against you from your current position as Teacher at G.W. Carver Middle School, effective at the close of the workday July 14, 1999, for just cause, including, but not limited to, misconduct office, violation of School Board Rule 6Gx13-4A-1.21, Responsibilities and Duties, and conviction of a crime involving moral turpitude, upon such conviction. This action is taken in accordance with Sections 230.03(2), 230.23(5)(f), 231.36(l)(a), 231.36(6)(a), and 447.209, Florida Statutes.

If you wish to contest your suspension and dismissal, you must request a hearing in writing within 15 calendar days of the receipt of notice of the Board action, in which case, formal charges will be filed and a hearing will be held before an administrative law judge.

RECOMMENDED: That effective July 14, 1999, at the close of the workday, the School Board suspend and initiate dismissal proceedings against Mr. Hector Perez, Teacher at G.W. Carver Middle School, pending the outcome of a hearing, if requested.

G-1 AUTHORIZATION TO ADVERTISE PROPOSED TENTATIVE BUDGET AND MILLAGE LEVIES FOR 1999-2000

Florida Statutes require that the Superintendent submit a tentative budget and millage levy recommendation to the Board no later than 24 days after certification of the tax roll or by July 24, 1999.

Statutes also prescribe that each school board shall advertise its intent to adopt a tentative budget and millage levy within 29 days of certification of the tax roll or by July 29, 1999. Not less than 2 days or more than 5 days thereafter, the district shall hold a public hearing on the tentative budget and millage levy. The School Board must advise the property appraiser of its proposed millage rates within 35 days of certification of the roll or by August 4, 1999.

RECOMMENDED: That The School Board of Miami-Dade County, Florida authorize the Superintendent to:

1. advertise a proposed operating millage levy of 6.709 mills, a proposed capital outlay millage levy of 2.000 mills, and a proposed debt service levy of .990 mills, subject to certification of the State Required Local Effort Millage Levy and the Supplemental Discretionary Millage Levy;
2. advertise the Tentative Budget (Attachment A) including such changes directed at the Board meeting of July 14;
3. advertise the listing and description of capital projects to be funded from the 1999-2000 Capital Millage Levy (Attachment B), including such changes directed at the Board meeting of July 14;
4. modify the advertised State Required Local Effort Millage Levy and the Supplemental Discretionary Millage Levy pursuant to official notification by the Commissioner of Education;
5. amend for the purpose of advertisement the State portion of the Florida Education Finance Program (FEFP) pursuant to official notification by the Commissioner of Education.


G-64 RENEWAL OF BID #066-VV07 - WELDING GASES

The purpose of this bid, opened on September 25, 1997, was to establish a contract, to purchase, at firm unit prices, quantities, as may be required, of welding gases, for various schools and departments. The terms of agreement, as contained in the subject bid, awarded by the Board on November 5, 1997, and renewed on October 7, 1998, provided, that by mutual agreement between the successful vendor and The School Board of Miami-Dade County, Florida, the contract may be renewed for two (2) additional one (1) year periods, and, if needed, ninety (90) days beyond the expiration date of the current contract period. The contract is currently in its first renewal period. The awardee has agreed to renew, for the final ninety (90) day renewal period, by letter, on file. It is considered to be in the best interest of the Board to renew this bid, for an additional ninety (90) day renewal period, at the current prices, to provide continuity of service. Staff is in the process of reviewing and revising the bid specifications.

H-11 REQUEST FOR APPROVAL OF MEMORANDUM OF UNDERSTANDING (MOU) MODIFYING PROVlSlONS OF THE LABOR CONTRACT BETWEEN MIAMI-DADE COUNTY PUBLIC SCHOOLS (MDCPS) AND THE UNITED TEACHERS OF DADE (UTD) RELATING TO IMPLEMENTATION OF THE FLORIDA COMPREHENSIVE ASSESSMENT TEST (FCAT) ENHANCEMENT INITIATIVE STRATEGIC

PLANNING GOAL: VIII - PROFESSIONAL STAFF AND PRACTICES

The current labor contract between Miami-Dade County Public Schools (MDCPS) and the United Teachers of Dade (UTD) include provisions pertaining to teaching conditions, paraprofessional duties and responsibilities and salary for instructional personnel and paraprofessionals.

RECOMMENDATION: That The School Board of Dade County, Florida approve the proposed Memorandum of Understanding (MOU) modifying provisions of the MDCPS/UTD labor contract to facilitate the implementation of the Florida Comprehensive Assessment Test (FCAT) Enhancement Initiative. (Revised-Replacement)

I-9 PRE-QUALIFICATION OF CONTRACTORS FOR EDUCATIONAL FACILITIES CONSTRUCTION

On December 9,1998, The School Board of Miami-Dade County, Florida adopted School Board Rule 6Gx13-7D-1.05, Pre-Qualification of Contractors for Educational Facilities Construction. This rule was created pursuant to Section 235.31 of the Florida Statutes and State Requirements for Educational Facilities (1997), which require school districts to pre-qualify contractors prior to their bidding on school work. This new law became effective July I, 1998.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the above list of contractors for pre-qualification, and authorize staff to Revised issue a certificate to each contractor, certifying pre-qualification for a period of one (1) year.

B-4 (formerly B-3) SCHOOL BOARD’S BUDGET RESPONSIBILITY AND AUTHORITY; CLIMATE SURVEY OF ADMINISTRATIVE STAFF TO IMPROVE BOARD MEMBERS EFFECTIVENESS IN SETTING POLICY

Florida Statute (ES.) 230.22, General Powers of School Board, establishes the Board’s responsibility and authority to make policy for the the school district’s operation. F.S. 230.23005, Supplemental Powers and Duties of School Board, establishes the Board’s authority over the district’s fiscal management. Miami-Dade County School Board rule 6Gx13- 3A-1.01, District Budget -- Responsibility of Superintendent of Schools, establishes the Board’s responsibility and authority to approve amendments to the district’s budget. In this spirit, it is proposed that the Board reaffirm the Superintendent’s prescribed practice of bringing to the Board for majority vote all matters that have budget impact and all other matters that lead to policy decisions.

ACTION PROPOSED BY DR. PEREZ: That The School Board of Dade County, Florida:

1)reaffirm the Superintendent’s prescribed practice of bringing to the Board for majority vote all matters that have budget impact and all other matters that lead to policy decisions; and
2)conduct a survey of the District Office staff to assess the climate in which they work.


B-9 INCLUDE REQUEST IN MIAMI-DADE COUNTY PUBLIC SCHOOLS STATE LEGISLATIVE PACKAGE FOR THE MANDATORY DRUG TESTING OF MIDDLE AND SENIOR HIGH SCHOOL STUDENTS AS AN ANNUAL REQUIREMENT FOR ENTRY INTO SCHOOL

The proliferation of drug abuse among adolescents, across the State of Florida, continues to pose serious threats to the health, safety and well-being of the victims, their families, and the surrounding community. Although the Miami-Dade County Public Schools district has led the State in a range of programs which address drug abuse, gaps remain in the efforts to ensure that students are certifiably drug free when they enter school at the beginning of each year.

ACTION PROPOSED BY MR. PEREZ: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to include a request in the Miami-Dade County Public Schools State legislative package for the mandatory drug testing of middle and senior high school students as an annual requirement for entry into school. (Revised-Replacement)

Pasarin, currently a Project Manager, Payroll, pay grade 43, Office of Information Technology, is recommended for appointment to the open, budgeted position of Senior Project Manager, Systems and Programs, pay grade 44, Office of Information Technology. Ms. Pasarin received a Bachelor of Business Administration Degree from Florida International University, Miami, Florida. Since 1984 to the present, Ms. Pasarin has been employed by Miami-Dade County Public Schools as a Project Manager, Payroll, her current position.

This recommendation is the direct result of the Board-approved advertisement and selection process.

The purpose of this bid, opened on June 16, 1998, was to establish a contract, to purchase, at firm unit prices, quantities, as may be required, of tree trimming and fence line clearing services, for the Bureau of Facilities Operations. The terms of agreement, as contained in the subject bid, awarded by the Board on August 26, 1998, provided, that by mutual agreement between the successful vendors and The School Board of Miami-Dade County, Florida, the contract may be renewed for one (1) additional one (1) year period, and, if needed, ninety (90) days beyond the expiration date of the current contract period. The contract is currently in its initial year, The primary vendor, Florida Coast Services, Inc., has agreed to renew for a ninety (90) day renewal period, by letter, on file. The secondary vendor, Maria Del Caribe, Inc., elected not to renew. It is considered to be in the best interest of the Board to renew this bid, for an additional ninety (90) day renewal period, at the current continuity of service during this period. This bid was awarded by the Board on July 22, 1998, to establish a contract, to purchase, at firm unit prices, quantities, as may be required, of circuit breakers, for Maintenance Materials Management stock. Items 27 through 38 were awarded to Electrical Supplies, Inc., of Miami Florida. Subsequent to the award, the awardee failed to perform in accordance with the terms and conditions of the bid. Based on the failure of this vendor to perform, it is recommended that the award of these items be terminated, and that the vendor lose eligibility to transact new business with the Board for a period of fourteen (14) months, pursuant to Board Rule 6Gx13- 3C-1.08 - Performance and Payment Security, Declining A Bid Award, And Bonding Company Qualifications. The terms of agreement, as contained in the subject bid, awarded by the Board July 8, 1998, provided, that by mutual agreement between the successful vendors and The School Board of Miami-Dade County, Florida, the contract may be renewed for three (3) additional one (1) year periods. The contract is currently in its initial year. The awardees, except for Trans Florida Limousine Service, Inc., of Hollywood, Florida, who has gone out of business, have agreed to renew for the first one (1) year renewal period, by letter, on file. The items awarded to Trans Florida Limousine Service, Inc. will be handled by the alternate vendors. H-2 REQUEST FOR AUTHORIZATION TO ENTER INTO A CONTRACT WITH THE LAW FIRM OF MARINO & WALSH TO PROVIDE CONTRACT LEGAL SERVICES SPECIFIC TO THE OPERATIONS OF THE MIAMI-DADE COUNTY SCHOOL POLICE DEPARTMENT

The Miami-Dade County Police Department is the fourth-largest police force in Miami-Dade County, Florida. As issues have developed unique to the department, a need for continuing legal advice has arisen to address issues that include the following:

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. authorize the Superintendent to contract with the law firm of Marino & Walsh to provide “as-needed” legal advice to the M-DCPS Police Department on legal matters dealing with the department, pursuant to the terms of their proposal and subsequent contract, including the use of the attorneys at a rate of $125 per billable hour, and $60 per hour for paralegal services, plus related expenses pursuant to the School Board’s reimbursable schedule, as it applies to all contracted defense attorneys, effective July 15, 1999 to July 15, 2000, with annual expenditures not to exceed $90,000;
2. authorize the Superintendent to extend the contract for two additional one-year terms, upon the same terms and conditions. The appropriation for this contract will be included in the 1999-2000 tentative budget, which will be brought back to the Board for adoption on July 26, 1999.

 

H-42 AUTHORIZATION TO EXECUTE A PURCHASE AND SALE AGREEMENT WITH TRACT 14 LAND CO., OSCAR ALTMAN, AND ACT REALTY, INC., FOR LAND FOR STATE SCHOOL “PPP” AND TRACT 14 LAND CO., FOR LAND FOR STATE SCHOOL “VVl” AND AUTHORIZE STAFF TO NEGOTIATE FOR TBlE PURCHASE OF A 10 ACRE ELEMENTARY SITE

At its May 12, 1999 meeting, the Board authorized staff to negotiate for the purchase of a 60 acre vacant parcel located at S.W. 56 Street and theoretical S.W. 162 Avenue. Acquisition of this acreage is intended for the construction of State School “PPP” to provide relief to G. Holmes Braddock Senior High. Additionally, at its June 23, 1999 meeting, the Board authorized staff to negotiate for the purchase of a 30 acre vacant parcel, located at the southwest corner of S.W. 47 Street and S.W. 157 Avenue. Acquisition of this acreage is intended for the construction of State School “VVl” to provide relief for Paul W. Bell and W. R. Thomas Middle Schools (see attached location map).(Revised Replacement)

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize:

1. the Superintendent or his designee to execute a purchase and sale agreement for the purchase of the subject parcels at a price of $116,500 per acre for the proposed sites for State Schools “W 1” and “PPP” and under the terms and conditions set forth above;
2. the payment of environmental assessments related to the purchase of the subject parcel; and
3. authorize the Superintendent or his designee to secure appraisals, surveys and environmental assessments for certain lands within Miami-Dade County, Florida, as described above and to negotiate for the purchase of same.
