I-2 REQUEST FOR AUTHORIZATION TO CONDUCT A PILOT PROGRAM FOR 26 SCHOOLS TO PARTICIPATE IN THE SPECIAL ASSISTANCE PROVISION 2 PROGRAM OF THE NATIONAL SCHOOL LUNCH AND BREAKFAST PROGRAM

The Federal Government in 1980 through The National School Lunch and Breakfast Program (NSLBP) authorized school districts to participate in the Special Assistance Provision 2 Program. The Superintendent of Schools requests authorization to conduct a pilot program for 26 schools to participate in the Provision 2 project.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent of Schools to conduct a pilot program for 26 schools to participate in The Provision 2 Program of The National School Lunch and Breakfast Program.

J-4 GRANT OF EASEMENT TO BROWARD COUNTY AT THE WLRN BROADCAST TOWER SITE

Miami-Dade County Public Schools (Board) and the Florida Educational Television Commission (State of Florida), each owns one-half interest in a 17.1 acre parcel of land located at 5200 S.W. &34 Street in Broward County, Florida.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Chair and the Secretary to execute a grant of easement agreement with Broward County, for the provision of an easement as described above, on the WLRN Broadcast Tower site.

J-30 COMMISSIONING OF SPILLIS CANDELA & PARTNERS, INC., AS DESIGN CRITERIA PROFESSIONAL (DCP) FOR A NEW MIDDLE LEARNING CENTER (STATE SCHOOL "FF") ADDITION AT KEY BISCAYNE ELEMENTARY SCHOOL PROJECT #A-0701.

The firm of Spillis Candela & Partners, Inc., was previously selected on January 25,1999, as Design Criteria Professional (DCP) to prepare design criteria packages for prototypical elementary, middle and senior high schools.

The School Board approved the award of F & L Construction, Inc. for Job Order Contracting (JOC) Services on December 8, 1999. The original contract contains an option-to-renew provision for two (2) additional one year periods. Design & Construction is requesting authorization to renew the contractual agreement, as provided for in Article 14 of the General Conditions, within 30 days after the contract expiration date.

K-20 PROPOSED AMENDMENT OF BOARD RULE: FINAL READING 6Gx13- 6A-1.161, INTERSCHOLASTIC ATHLETICS-SENIOR HIGH SCHOOL

The School Board of Miami-Dade County, Florida, announced on October 11, 2000; its intention to amend School Board Rule 6Gx13- 6A-1.161, Interscholastic Athletics-Senior High School, and the document, Athletic Manual, which is incorporated by reference and is a part of this rule, at the meeting of November 15, 2000.

RECOMMENDED: That The School Board Miami-Dade County, Florida, adopt amended Board Rule 6Gx13-6A-1.161, Interscholastic Athletics-Senior High School, and the document, Interscholastic Athletic Manual, which is incorporated by reference and is a part of this rule, and authorize the Superintendent to file the rule with The School Board of Miami-Dade County, Florida, to be effective December 13, 2000.

REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO REQUIRE AN ELECTROCARDIOGRAM (EKG) AS PART OF THE PHYSICAL EXAMINATION FOR STUDENT ATHLETES

According to School Board Rule 6Gx13-5D-1.021, "The Superintendent of Schools shall establish such procedures as are necessary to provide for cooperative efforts in the area of school health services and for implementation of statutes pertaining to health programs to be provided in the schools."

ACTION PROPOSED BY DEMETRIO PEREZ, JR., M.S.: That The School Board of Miami-Dade County, Florida, direct the Superintendent to:

1. require an electrocardiogram (EKG) as part of the sports physical examination for student athletes, effective 2001-2002 school year, at an additional estimated cost of $1,125,000, which equates to $75 for administration and interpretation of an EKG for approximately 15,000 student athletes; and

The following recommendation is made in accordance with the Miami-Dade County PublicSchools/Dade County School Administrators’ Association labor contract.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint Mr. Thomas T. Sims, currently a Supervisor I, Network Services, pay grade 43, to the open budgeted position of Director I, Technical Services, pay grade 45, 12 months, and assign to the Office of Information Technology, effective December 14, 2000, or as soon thereafter as can be facilitated.

E-12 REQUEST FOR AUTHORIZATION TO CONTRACT WITH NEWLY ESTABLISHED LAW FIRMS FOR WORKERS’ COMPENSATION DEFENSE

The law firm of Daniels, Kashtan & Fornaris, P.A. has been under contract with the School Board to provide workers’ compensation defense since 1991. Effective November 1, 2000, changes within the firm occurred whereby a partner of the firm has begun practicing only workers’ compensation defense by developing a separate firm, and a previous firm associate working on Board files has left and started his own firm. Both attorneys, while with Daniels, Kashtan, & Fornaris, P.A., provided credible service to the Board, and it is recommended that each be allowed to continue to provide workers’ compensation defense coverage under the new firm’s names.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. cancel its present contract with the law firm of Daniels, Kashtan & Fornaris, P.A., effective November 1, 2000; and
