Amendment and Renewal
Since January 2000, the Board has leased 9,985 square
feet of office space in suites 104, 201 and 220
at the 1444 Biscayne Boulevard Building (1444 Building)
for the Office of Workforce Development and Education,
Division of Materials Management, Division of Procurement
Management, Pre-qualification and Educational Facilities
Compliance, Stay in School Program, Virtual Adult
Registration Center, and One Community One Goal,
from
Biscayne Management Corporation (Biscayne Management).
RECOMMENDED:
That The School Board of Miami-Dade County, Florida:
1.
authorize the Superintendent or his designee to
execute a lease amendment with Biscayne Management
Corporation for 9,985 square feet of administrative
office space at the 1444 Biscayne Boulevard Building,
under the terms and conditions set forth above,
and authorize the renewal of the lease agreement
for an additional one-year period, at an annual
rental rate of $179,730, wh h IC is a reduction
from the current annual rental amount of $190,813.35.
The term of the renewal option period will commence
January 25, 2003, and will end January 24, 2004.
All other terms and conditions of the lease agreement,
other than as set forth above, will remain unchanged;

MIAMI NORTHWESTERN SENIOR HIGH SCHOOL - AUTHORITY TO
FILE SUIT AGAINST PROJECT ARCHIITECT
During
the course of litigation with the Contractor for the
Miami Northwestern Senior High School project, it was
discovered that claims may exist against the Project
Architect for inadequate design, contract administration
and failure to properly perform inspections.
RECOMMENDED:
That The School Board of Miami-Dade County, Florida,
authorize the filing of a lawsuit-against the Project
Architect, Wolfberg, Alvarez & Partners, to recover
damages incurred by the Board arising from the Project
Architect’s breach of contract and other appropriate
claims related to the design and construction of Miami
Northwestern Senior High School.

Recent
budget constraints imposed by the State and the
District have necessitated austerity measures to
be imposed on adult/vocational education programs
in Miami-Dade County Public Schools. The consolidation
of selected community education centers and community
schools will allow the school district to curtail
operating costs and maximize available resources
for the 2002-2003 school year.
RECOMMENDED:
That The School Board of Miami-Dade County, Florida,
authorize the Superintendent to consolidate selected
adult and community education centers and community
schools, effective July 11, 2002,
and in the future, consolidate other selected centers
as it becomes a necessary action in regards to cost
saving measures.

ABATE, P.A. TO PROVIDE LEGAL SERVICES SPECIFIC TO
EMPLOYEE BENEFIT LAW RELATING TO HEALTH INSURANCE
RENEWAL FOR CALENDAR YEAR 2003
At
the Board meeting of June 19, 2002, the Board authorized
the Superintendent to enter into negotiations with
the law firm of Colodny, Fass, Talenfeld, Karlinsky
& Abate, P.A., to effectuate a contract to provide
the Board legal services, specific to employee benefit
law in relation to its health insurance renewal
for calendar year 2003.
RECOMMENDED:
That The School Board of Miami-Dade County, Florida
contract with the law firm of Colodny, Fass, Talenfeld,
Karlinsky & Abate, P.A., to provide legal services
specific to employee benefit law in relation to
its health insurance renewal for calendar year 2003
at hourly fees of $280 for partners, $175 for associates,
and $75 for paralegal, with total expenditures not
to exceed $75,000, with funding for this contract
to come from the Boards general liability
claims fund (0100, 5324, 9112, 8150, 7730).
Funds
for this expenditure will be included in the General
Fund of the 2002-2003 Adopted Budget.
