Since January 2000, the Board has leased 9,985 square feet of office space in suites 104, 201 and 220 at the 1444 Biscayne Boulevard Building (1444 Building) for the Office of Workforce Development and Education, Division of Materials Management, Division of Procurement Management, Pre-qualification and Educational Facilities Compliance, Stay in School Program, Virtual Adult Registration Center, and One Community One Goal, from
Biscayne Management Corporation (Biscayne Management).

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. authorize the Superintendent or his designee to execute a lease amendment with Biscayne Management Corporation for 9,985 square feet of administrative office space at the 1444 Biscayne Boulevard Building, under the terms and conditions set forth above, and authorize the renewal of the lease agreement for an additional one-year period, at an annual rental rate of $179,730, wh’ h IC is a reduction from the current annual rental amount of $190,813.35. The term of the renewal option period will commence January 25, 2003, and will end January 24, 2004. All other terms and conditions of the lease agreement, other than as set forth above, will remain unchanged;

A-6 REQUEST THAT THE SCHOOL BOARD ESTABLISH AND CLASSIFY THE POSITION OF EXECUTIVE ASSISTANT, STRATEGIC INITIATIVES

RECOMMENDED: That The School Board of Miami-Dade County, Florida, establish the position of Executive Assistant, Strategic Initiatives, and authorize the Board Attorney to prepare a one-year employment contract
effective July 1, 2002 between the Board and Dr. Ralph G. Lewis at an annual salary of $125,000.

C-3 MIAMI NORTHWESTERN SENIOR HIGH SCHOOL - AUTHORITY TO FILE SUIT AGAINST PROJECT ARCHIITECT

During the course of litigation with the Contractor for the Miami Northwestern Senior High School project, it was discovered that claims may exist against the Project Architect for inadequate design, contract administration and failure to properly perform inspections.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the filing of a lawsuit-against the Project Architect, Wolfberg, Alvarez & Partners, to recover damages incurred by the Board arising from the Project Architect’s breach of contract and other appropriate claims related to the design and construction of Miami Northwestern Senior High School.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into a contractual agreement, in an amount not to exceed $150,000, with Family Central, inc., whereby the agency will designate/funding for daycare services provided by Miami Lakes Educational Center Staff, from July 11, 2002 through June 30, 2003.

No local funds are required.

B-25 REQUEST AUTHORIZATION FOR THE SUPERINTENDENT TO AMEND A CONTRACTUAL AGREEMENT WITH THE SOUTH FLORIDA EMPLOYMENT AND TRAINING CONSORTIUM, PURSUANT TO ACTIONS APPROVED BY THE SOUTH FLORIDA WORKFORCE BOARD AND CHANGES IN STATE LAW, EFFECTIVE JUNE 5, 2002 THROUGH JUNE 30, 2011

Authorization is requested for the Superintendent to amend a contractual agreement between the South Florida Employment and Training Consortium (SFETC) and Miami-Dade County Public Schools (M-DCPS).

1. the Superintendent to amend a contractual agreement with the South Florida Employment and Training Consortium, pursuant to actions approved by the South Florida Workforce Board and changes in state law, effective June 5, 2002 through June 30, 2011; and

ACTION PROPOSED BY DR. MARTA PÉREZ: That The School Board of Miami-Dade County, Florida, request that the Board Attorney revise his current Employment Agreement with the School Board by adding a 45 day notice of termination provision, upon a majority vote to terminate by the School Board, and eliminating the automatic eight percent annual raise provision.

E-4 AUTHORIZATION FOR THE SUPERINTENDENT TO EXECUTE A JOINT PARTICIPATION AGREEMENT WITH THE VILLAGE OF KEY BISCAYNE FOR THE INSTALLATION OF AN EIGHT (8) INCH SANITARY SEWER FORCE MAIN IN CONNECTION WITH THE PROPOSED ADDITION AT KEY BISCAYNE ELEMENTARY SCHOOL

Miami-Dade County Public Schools (School District), pursuant to Section 235.193, is required to provide site plans for review by the appropriate local government having jurisdiction, in connection with proposed new and expanded K-8 educational facilities (see attached location map).

RECOMMENDED: That the School Board of Miami-Dade County, Florida authorize a Joint Participation Agreement with-The Village of Key Biscayne for the design, installation, permitting and conveyance to the Miami-Dade County Water and Sewer Department of an eight (8) inch sanitary sewer force main to serve Key Biscayne Elementary School, for an amount not to exceed $171,697.90, and for a term not to exceed on (1) year from the effective date of this Agreement.

Florida Statutes require that the Superintendent submit a tentative budget and millage levy recommendation to the Board no later than 24 days after certification of the tax roll or by July 24, 2002.

RECOMMENDED: That The School Board of Miami-Dade County, Florida authorize the Superintendent to:

1. advertise pursuant to state law a proposed operating millage levy of 6.479 mills, a proposed capital outlay millage levy of 2,000 mills, and a proposed debt service levy of .770 mills, subject to certification of the State Required Local Effort Millage Levy and the Supplemental Discretionary Millage Levy;

At the School Board meeting of June 19, 2002, Agenda Item Revised Replacement A-1, the Board authorized the appointment of the Interim Chief Facilities Officer (Maintenance) to the position of Region Superintendent, Region VI, creating a management vacancy in a department whose performance needs improvement. The position for Chief Facilities Officer (Maintenance) was advertised nationally.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. authorize the Superintendent to issue a Request For Proposals to provide management services for the M-DCPS Facilities Maintenance and Operations Department; and

B-10 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO AN INTERLOCAL AGREEMENT WITH MIAMI-DADE COUNTY FOR ENFORCEMENT OF BUILDING, FIRE, ZONING, AND LAND USE REGULATIONS IN CONNECTION WITH CHARTER SCHOOLS

Authorization is requested for the Superintendent to enter into an interlocal agreement with Miami-Dade County for enforcement of building, fire, zoning, and land use regulations in connection with charter schools.

B-22 REQUEST AUTHORIZATION FOR THE SUPERINTENDENT TO CONSOLIDATE SELECTED ADULT AND COMMUNITY EDUCATION CENTERS AND COMMUNITY SCHOOLS, EFFECTIVE JULY 11, 2002

Recent budget constraints imposed by the State and the District have necessitated austerity measures to be imposed on adult/vocational education programs in Miami-Dade County Public Schools. The consolidation of selected community education centers and community schools will allow the school district to curtail operating costs and maximize available resources for the 2002-2003 school year.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to consolidate selected adult and community education centers and community schools, effective July 11, 2002,
and in the future, consolidate other selected centers as it becomes a necessary action in regards to cost saving measures.

D-2 THAT THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA DIRECT THE SUPERINTENDENT TO PROVIDE TIMELY WRITTEN RECOMMENDATIONS TO THE BOARD FORTHE ESTABLISHMENT OF NEW POSITIONS AND QUALIFICATIONS FOR THOSE POSITIONS

Florida law sets forth the duties and responsibilities for the Superintendent of Schools and the School Board as it pertains to personnel matters. With regard to personnel matters, Florida law requires a school board to authorize the establishment of new positions and to prescribe qualifications for those positions.

ACTION PROPOSED BY MS. PERLA TABARES HANTMAN: That The School Board of Mianii-Dade County, Florida direct the Superintendent to provide to the Board written recommendations on the establishment of positions to be filled and qualifications for those positions no later than the Friday before the Board meeting.

G-46 REQUEST FOR AUTHORIZATION TO CONTRACT WITH THE LAW FIRM OF COLODNY, FASS, TALENFELD, KARLINSKY & ABATE, P.A. TO PROVIDE LEGAL SERVICES SPECIFIC TO EMPLOYEE BENEFIT LAW RELATING TO HEALTH INSURANCE RENEWAL FOR CALENDAR YEAR 2003

At the Board meeting of June 19, 2002, the Board authorized the Superintendent to enter into negotiations with the law firm of Colodny, Fass, Talenfeld, Karlinsky & Abate, P.A., to effectuate a contract to provide the Board legal services, specific to employee benefit law in relation to its health insurance renewal for calendar year 2003.

RECOMMENDED: That The School Board of Miami-Dade County, Florida contract with the law firm of Colodny, Fass, Talenfeld, Karlinsky & Abate, P.A., to provide legal services specific to employee benefit law in relation to
its health insurance renewal for calendar year 2003 at hourly fees of $280 for partners, $175 for associates, and $75 for paralegal, with total expenditures not to exceed $75,000, with funding for this contract to come from the Board’s general liability claims fund (0100, 5324, 9112, 8150, 7730).

Funds for this expenditure will be included in the General Fund of the 2002-2003 Adopted Budget.
