* The public hearing shall begin no later than approximately 6:30 p.m. The Chair may begin calling speakers who are present immediately following the conclusion of the regular agenda. The public hearing shall not conclude before 4:30 p.m., unless all of the speakers signed up to speak are present and have been given the opportunity to speak.

Citizens who wish to speak on matters not on the agenda, or on agenda items that appear on the consent agenda, will be heard at the public hearing. The total time allotted for the public hearing shall not exceed one and one-half hours.

Pursuant to Board Policy 0169.1, a person not scheduled in advance to speak on a non-agenda topic must submit, either before or during the regularly scheduled meeting, a written request to the Chair. Board members present at the meeting must vote by a majority for the person to be heard.

The School Board of Miami-Dade County, Florida, seeks public input and participation. However, the public purpose is not served when citizens become disorderly or disrupt the meeting. Accordingly, the Chair may order the removal from any School Board meeting of any person interfering with the expeditious or orderly process of the meeting provided the Chair has first issued a warning that continued interference with the orderly processes of the meeting will result in removal. Any law enforcement authority or a sergeant-at-arms designated by Chair shall remove any person ordered removed pursuant to this section §1001.372 (3), Fla.Stat.

Pursuant to its Policies, proposed Board member resolutions, endorsements, and proclamations will be presented at 11:00 a.m. Upon vote being taken, the Board will recess to present the approved resolutions, endorsements, and proclamations, to which all persons are invited. The Superintendent’s Special Orders shall follow the Board Member presentations.

The Board will then reconvene the regular public meeting, including other hearings, in accordance with Policies of the Board, at 1:00 p.m.

RECOMMENDED: That the School Board of Miami-Dade County, Florida, receive and file the Review of Audited Financial Statements for 25_of 130 Charter Schools Operating During the Fiscal Year Ended June 30, 2018.

 

E-106 REQUEST TO RESCHEDULE THE MAY 8, 2019, INSTRUCTIONAL MATERIALS PUBLIC HEARING TO WEDNESDAY, MAY 1, 2019, AND TO SCHEDULE A SPECIAL MEETING OF THE BOARD ON JULY 16, 2019           

RECOMMENDED:  That The School Board of Miami-Dade County, Florida:

a. reschedule the May 8, 2019, Instructional Material Public Hearing to Wednesday, May 1, 2019, beginning at 10:00 a.m., and

b. schedule a Special Meeting of the Board to be held on July 16, 2019 at 10:00 a.m. for the specific purpose of providing authorization for the Tentative Budget and Millage Levy Advertisement.

 

E-201  REQUEST AUTHORIZATION TO ACCEPT GRANT AWARDS/DONATIONS FOR SEVEN PROGRAMS FROM MULTIPLE FUNDING SOURCES AND ENTER INTO CONTRACTUAL SERVICE AGREEMENTS WITH THE AGENCIES PRESCRIBED IN THE GRANT

RECOMMENDED:  That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. accept six grant awards and one donation for programs from:

a. Florida Department of Education (FLDOE) for funding under The Florida Best and Brightest Teacher & Principal Scholarship Program, in the approximate amount of $22,154,455, for the grant period of July 1, 2018, through June 30, 2019;

b. Florida Department of Education (FLDOE) for funding under the Safety and Security of School Buildings, in the approximate amount of $12,183,523, for the grant period of July 1, 2018, through January 31, 2021;

c. Miami-Dade County for funding under the Head Start Program, in the approximate amount of $12,998,226, for the grant period of August 1, 2019, through July 31, 2020;

d. Miami-Dade County for funding under the Early Head Start Program, in the approximate amount of $2,564,234, for the grant period of August 1, 2019, through July 31, 2020;

e. Digital Promise for funding under Verizon Innovative Learning, in the approximate amount of $360,000, and for in-kind equipment and services valued at $8,640,000, for the grant period of April 13, 2019, through July 30, 2021;

f. Florida Department of Education (FLDOE) for funding under 2018-2020 Public Charter School Program (CSP) Planning, Program Design and Implementation – Somerset Palms Academy, in the approximate amount of $388,043, for the grant period of November 19, 2018, through July 31, 2019; and

g. Florida Department of Education (FLDOE) for funding under 2018-2020 Public Charter School Program (CSP) Planning, Program Design and Implementation – Somerset Academy Kendall, in the approximate amount of $319,584, for the grant period of November 19, 2018, through July 31, 2019.

2. enter into contractual service agreements with the agencies prescribed in the grant, with whom the School Board must contract, pursuant to Board Policy 6320 – Purchase Approval and Competitive; Bidding Process Requirements:

    a. Miami-Dade County, in the approximate amount of $12,998,226, in support of the Head Start Program;

    b. Miami-Dade County, in the approximate amount of $2,562,234, in support of the Early Head Start Program;

c. Hearing and Speech Center of Florida, in the approximate amount of $67,725, in support of the Head Start Program and Early Head Start Program;

d. High Scope, in the approximate amount of $64,600, in support of the Head Start Program; and

e. Waterford, in the approximate amount of $60,000, in support of the Head Start Program.

    3. extend these programs and contractual agreements as authorized through official notification from the granting agency in order to complete the goals of the program;

4. retain funds from the grant in an amount not to exceed the annually negotiated indirect cost rate, as allowed and approved by the FLDOE;

    5. direct Financial Services to establish appropriations in the amount approved or as amended by the granting agency; such appropriations to be reported periodically to the Board;

6. authorize travel out-of-state as required by the grant parameters; and

7. eliminate any grant-funded position upon cessation of the grant funds, and place the impacted employee(s) on the Personnel Action Listing of Instructional and Non-Instructional Appointments, Reassignments, Leaves and Separations for the relevant period.

 

 

F. FACILITIES AND CONSTRUCTION

 

F-1 AUTHORIZATION FOR THE SUPERINTENDENT TO EXECUTE AN AMENDMENT TO THE LEASE AGREEMENT BETWEEN THE SCHOOL BOARD AND MIAMI-DADE COUNTY (“COUNTY”), FOR THE COUNTY’S INTERIM USE OF A PORTION OF THE PLAYFIELD AT SWEETWATER ELEMENTARY SCHOOL FOR THE TEMPORARY OPERATION OF A FIRE STATION

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1)finalize negotiations and execute an Amendment to the Lease Agreement between the School Board and Miami-Dade County (“County”), for the County’s interim use of a portion of the playfield at Sweetwater Elementary School, located at 10655 S.W. 4 Street, Miami, Florida, under substantially the terms and conditions noted in the agenda item;

2)execute amendments to the Lease Agreement within the authority granted to the Superintendent by the Board in the Lease Agreement; and

3)grant or deny all approvals required under the Lease Agreement, including renewing, extending, canceling or terminating the Lease Agreement, and placing the County in default, as may be applicable.

 

F-2  AUTHORIZE THE SUPERINTENDENT TO FINALIZE NEGOTIATIONS AND EXECUTE AN AMENDMENT TO THE LEASE AGREEMENT BETWEEN THE SCHOOL BOARD AND RK 750 IVES DAIRY, LLC, A FLORIDA LIMITED LIABILITY COMPANY, FOR CLASSROOM SPACE USED AS AN ANNEX TO AVENTURA WATERWAYS K-8 CENTER, LOCATED AT 850 IVES DAIRY ROAD, MIAMI, FLORIDA 33179

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to finalize negotiations and execute an amendment to the Lease Agreement between the School Board and RK 750 Ives Dairy, LLC, a Florida limited liability company, for classroom space used as an annex to Aventura Waterways K-8 Center, located at 850 Ives Dairy Road, Miami, Florida 33179, to extend the term of the Lease Agreement from July 1, 2019 to June 30, 2023, including an annual rental rate of $1,041,862 for the period of July 1, 2019 through June 30, 2020, $1,073,118 for the period of July 1, 2020 through June 30, 2021, $1,105,311 for the period of July 1, 2021 through June 30, 2022; and $1,138,470 for the period of July 1, 2022 through June 30, 2023, and under, substantially, the terms and conditions noted in the agenda.

 

F-3 THAT THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, AUTHORIZE THE SUPERINTENDENT TO EXECUTE A NON-EXCLUSIVE LEASE AGREEMENT WITH THE CITY OF CORAL GABLES (“CITY”), FOR INTERIM USE BY THE CITY OF A PORTION OF THE CENTRAL EAST TRANSPORTATION CENTER, LOCATED AT 7011 S.W. 4 STREET, MIAMI, FLORIDA, FOR THE STORAGE AND MAINTENANCE OF CITY TROLLEYS

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

H-15 TRAUMA INFORMED INVESTIGATIONS AND PROFESSIONAL DEVELOPMENT (REVISED)

1. Initiate rulemaking to codify the current practice that all allegations of sexual battery as defined by Florida Statute § 794.011, will be investigated by Miami-Dade County’s, the local jurisdiction’s or the municipality’s Sexual Battery Unit;

2. Ensure that all investigations involving allegations of a sexual nature that result in a finding of no probable cause indicate that they have been reviewed prior to finalization by the Miami-Dade County Public Schools Chief of Police; and

3. Prior to the commencement of the 2019-20 school year, explore and determine professional development opportunities for:

a) Miami-Dade Schools Police personnel to receive trauma informed practices training, particularly in the area of sexual abuse victim interview techniques, and
