E-11 REQUEST FOR AUTHORIZATION TO RESOLVE HEALTH INSURANCE PLAN CLAIM

Representatives from UNlTEDHealthcare of Florida, Inc. and The School Board of Miami-Dade County, Florida, participated in negotiations to resolve a disputed health insurance claim concerning dependent coverage.

RECOMMENDED: That The School Board of Miami-Dade County, Florida authorize resolution of UNlTEDHealthcare of Florida, Inc. claim #113-l 040, by providing UNlTEDHealthcare of Florida, Inc. reimbursement of fifty (50%) percent of claims paid for claim #113-1040, said reimbursement to come from the Board’s self-insured general liability claims reimbursement fund, subject to receipt of full releases from all parties to the dispute, including UNlTEDHealthcare of Florida, Inc.‘s agreement to not count this claim as part of the Board’s overall claims experience for rate determination purposes in the future.

G-67 REJECT REQUEST FOR PROPOSALS # 159-ZZ10 - CONSULTING SERVICES FOR EVALUATION, DESIGN, AND IMPLEMENTATION OF THE DISTRICT'S ELECTRONIC PROCUREMENT SYSTEM

The purpose of this Request For Proposals, opened on July 18, 2000, was to establish a contract, to perform an independent review of the electronic procurement system of The School Board of Miami-Dade County, Florida. 

J-3 ADOPT RESOLUTION NO. 00-40 DECLARING BOARD OWNED PARCEL LOCATED AT S.W. 272 STREET AND S.W. 132 AVENUE UNSUITABLE FOR EDUCATIONAL PURPOSES, AND AUTHORIZING THE SALE OF SAID PARCEL TO MIAMI-DADE COUNTY FOR CONSERVATION UNDER ITS ENVIRONMENTALLY ENDANGERED LANDS PROGRAM

The School Board owns a parcel of vacant land located at S.W. 272 Street and S.W. 132 Avenue, adjacent to the site of Air Base Elementary School, consisting of approximately 18.4 acres (see attachment).

K-4 THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA v. YVONNE M. WEINSTEIN - DOAH CASE NO. 99-5125

On November 17, 1999, the School Board suspended teacher Yvonne M. Weinstein from her employment with The School Board of Miami-Dade County, Florida, and initiated dismissal proceedings against her.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, enter its final order in the case of The School Board of Miami-Dade County, Florida v. Yvonne M. Weinstein, accepting the recommendation of the Administrative Law Judge in DOAH Case No. 99-5125 or accepting the exceptions set forth in Respondent’s Exceptions to Recommended Order, filed on behalf of the employee on September 26, 2000.

A-2 RECOMMENDATION FROM THE TASK FORCE ON ETHICS, THAT THE MIAMI-DADE COUNTY PUBLIC SCHOOL BOARD ESTABLISH A BLUE RIBBON COMMISSION ON ETHICS

At the Board meeting of May 17, 2000, the School Board established a task force to analyze and study the feasibility of establishing a Blue Ribbon Committee on Ethics for The Miami-Dade County Public School Board and report its recommendation to the Board at the October 11, 2000, meeting.

RECOMMENDED: That The School Board of Miami-Dade County, Florida receive the recommendation of the Task Force on Ethics

E-2 APPOINTMENTS AND LATERAL ASSIGNMENTS OF MANAGERIAL EXEMPT, PROFESSIONAL, AND TECHNICAL PERSONNEL FOR 2000-2001

The following recommendations are made in accordance with Board Rules 6Gx13-4A-1.16, 6Gx13-4A-1.161, and the Miami-Dade County Public Schools/Dade County Schools Administrators’ Association labor contract.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the recommendations as set forth above for appointments and lateral transfers, to be effective October 12, 2000, or as soon thereafter as can be facilitated.

On September 28, 2000, the Superintendent of Schools sent the following letter to Mr. Victor I. Roa:
I am exercising my responsibility as Superintendent of Schools and recommending to The School Board of Miami-Dade County, Florida, at its scheduled meeting of October 11, 2000, that the School Board suspend you and initiate dismissal proceedings against you from your current position as Custodian, at North Miami Beach Senior High School, effective at the close of the workday, October 11, 2000, forjust cause, including, but not limited to, gross insubordination, improper conduct, violation of School Board Rules 6Gx13-4A-1.09, Employee-Student Relationships, and 6Gx13-4A-1.21, Responsibilities and Duties. This action is taken in accordance with Sections 230.03(2), 230.23(5)(f), 231.3605, and 447.209. Florida Statutes.

RECOMMENDED: That effective October 11, 2000, at the close of the workday, the School Board suspend and initiate dismissal proceedings against Mr. Victor I. Roa, Custodian, at North Miami Beach Senior High School, pending the outcome of a hearing, if requested.

On September 28, 2000, the Superintendent of Schools sent the following letter to Mr. Virgil A. Brown:
I am exercising my responsibility as Superintendent of Schools and recommending to The School Board of Miami-Dade County, Florida, at its scheduled meeting of October 11, 2000, that the School Board suspend you and initiate dismissal proceedings against you from your current position as Security Monitor, at Centennial Middle School, effective at the close of the workday, October 11, 2000, for just cause, including, but not limited to, misconduct in office, gross insubordination, and violation of School Board Rule 6Gx13-5D-1.07, Corporal Punishment-Prohibited. This action is taken in accordancewith Sections 230.03(2), 230.23(5)(f), 231.3605, and 447.209, Florida Statutes.

RECOMMENDED: That effective October 11, 2000, at the close of the workday, the School Board suspend and initiate dismissal proceedings against Mr. Virgil A. Brown, Security Monitor, Centennial Middle School, pending the outcome of a hearing, if requested.

E-16 SUBJECT: ACCEPTANCE OF RESIGNATION

Subsequent to the September 28, 2000, notification to Mr. Richard L. Thomas from the Superintendent of Schools, that he would be recommended for dismissal on October 11, 2000, because of failure to satisfactorily correct identified performance deficiencies during the go-calendar Day Performance, Mr. Thomas has submitted a resignation from the Miami-Dade County Public Schools, effective October 10, 2000.

RECOMMENDED: That effective October 11, 2000, at the close of the workday, the School Board of Miami-Dade County, Florida accept the resignation of Mr. Richard L. Thomas, Teacher, at Melrose Elementary School.

On September 28, 2000, the Superintendent of Schools sent the following letter to, Mr. Colin A. Kendrew:
I am exercising my responsibility as Superintendent of Schools and recommending to The School Board of Miami-Dade County, Florida, at its scheduled meeting of October 11, 2000, that the School Board suspend you and initiate dismissal proceedings against you from your current position as T.V. ACTION PROPOSED BY MR. DEMETRIO PEREZ, JR.: That The School Board of Miami-Dade County, Florida, direct the Superintendent to:

1. provide a response and a plan of action to the Final Report of the Miami-Dade Grand Jury before February, 2001; and

B-6 REQUEST FOR APPROVAL TO AUTHORIZE MIAMI-DADE COUNTY PUBLIC SCHOOLS TO PARTICIPATE IN THE SOUTH FLORIDA EXECUTIVE INSTITUTE AT FLORIDA INTERNATIONAL UNIVERSITY

Florida International University (FIU) has proposed the development of a unique pilot program, The South Florida Executive Institute, to strengthen the leadership and management skills of the administrators from Miami-Dade and Monroe County Public Schools and FIU.

ACTION PROPOSED BY MS. HANTMAN: That The School Board of Miami-Dade County, Florida authorize the Superintendent of Schools to allow school site administrators to participate in The South Florida Executive Institute at Florida International University, beginning June, 2001, for a period of six consecutive weeks, at no cost to the district.

This open budgeted position is due to the leave of absence of the incumbent.

Mr. Fernando Albuerne is recommended for appointment to the open, budgeted position of Director, Development and Governmental Affairs, MEP pay grade 21, Division of Governmental Affairs and Land Use Policy Acquisition.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint Mr. Fernando Albuerne, to the open budgeted position of Director, Development and Governmental Affairs, MEP pay grade 21, 12 months, and assign to the Division of Governmental Affairs and Land Use Policy Acquisition, effective October 12, 2000, or as soon thereafter as can be facilitated.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint Ms. Carmen Perea, to the open budgeted position of Asbestos Design Specialist, pay grade 36, 12 months, and assign to Asbestos Management, effective October 12, 2000, or as soon thereafter as can be facilitated.

E-9 REQUEST FOR AUTHORIZATION TO ENTER INTO AGREEMENT FOR CONSENT TO ASSIGNMENT OF CONTRACT WITH HIP HEALTH PLAN OF FLORIDA

As the Board has been made aware, HIP Health Plan of Florida, Inc. (HIP) was placed under Administrative Supervision by the State of Florida, Department of Insurance (DOI), in July, 2000, as a result of HIP having fallen below the required statutory reserve requirements.

RECOMMENDED: That The School Board of Miami-Dade County, Florida authorize: 1. the Superintendent of Schools to enter into an agreement for consent to assignment of the Board’s contract with HIP Health Plan of Florida, Inc., inclusive of the provisions where HIP Health Plan of Florida, Inc. would cease being a not-for-profit corporation, owned by HIP Health Plan of New York, and become a for-profit corporation, owned by Florida Health Plan Holdings, L.L.C., subject to the provisions outlined in a consent to assignment letter, incorporating all current contractual provisions, restrictions, and requirements currently existing in the Board’s contract with HIP Health Plan of Florida, Inc., subject to the provisions that HIP Health Plan of Florida, Inc. will contract with HIP Administrators of Florida, Inc. for currently-provided support services, at the sole expense of HIP Health Plan of Florida, Inc., to be effective upon the closing of the sale of HIP Healthcare of Florida, Inc., through December 31, 2001; and

E-10 RESTRUCTURING OF HEALTH PLANS FOR CALENDAR YEAR 2002

At the Board meeting of June 21, 2000, Agenda Item A-3, the Board approved the rates for calendar year 2001, the fifth year of its five-year health plan contract, which was approved at the Board meeting of August 28, 1996, pursuant to the terms of Request For Proposal (RFP) # 173-SS-10.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. authorize staff to begin work on a comprehensive Request For Proposal (RFP) incorporating different approaches towards benefits design and financing alternatives for health plan offerings for calendar year 2002, with the request to issue an RFP for health plans coming to the Board meeting of January 17, 2001;

I am exercising my responsibility as Superintendent of Schools and recommending to The School Board of Miami-Dade County, Florida, at its scheduled meeting of October II, 2000, that the School Board suspend you from your current position as Paraprofessional I, at Robert Morgan Vocational Technical Institute, for 30 workdays, effective at the close of the workday, October II, 2000, for just cause, including, but not limited to, misconduct in office, immorality, violation of School Board Rules 6Gx13-4A-1.21, Responsibilities and Duties, and 6Gx13-6A-1.112, Acceptable Use Policy for the Exploration and Utilization of the Internet. This action is taken in accordance with Sections 230.03(2), 230.23(5)(f), 231.3605, and 447.209, Florida Statutes.

RECOMMENDED: That effective October 11, 2000, at the close of the workday, the School Board suspend Mr. Franjehi J. Morgan, Paraprofessional I, at Robert Morgan Vocational Technical Institute, for 30 workdays.

On September 28, 2000, the Superintendent of Schools sent the following letter to Ms. Emma Wallace:
I am exercising my responsibility as Superintendent of Schools and recommending to The School Board of Miami-Dade County, Florida, at its scheduled meeting of October 11, 2000, that the School Board suspend you and initiate dismissal proceedings against you from your current position as Senior Secretary, at Applied Technology, Adult and Career Education, effective at the close of the workday, October 11, 2000, for just cause, including but not limited to, misconduct in office, gross insubordination, conduct unbecoming a school board employee, and violation of School Board Rule 6Gx13-4A-1.21, Responsibilities and Duties. This action is taken in accordance with Sections 230.03(2), 230.23(5)(f), 231.3605, and 447.209, Florida Statutes.

RECOMMENDED: That effective October 11, 2000, at the close of the workday, the School Board suspend and initiate dismissal proceedings against
Ms. Emma Wallace, Senior Secretary, Applied Technology, Adult and Career Education, pending the outcome of a hearing, if requested.

BUILDING OPERATIONS

I am exercising my responsibility as Superintendent of Schools and recommending to The School Board of Miami-Dade County, Florida, at its scheduled meeting of October 11, 2000, that the School Board suspend you and initiate dismissal proceedings against you from your current position as Custodian, at Building Operations, effective at the close of the workday, October 11, 2000, for just cause, including but not limited to, excessive absenteeism, abandonment of position, misconduct in office, conduct unbecoming a School Board employee, gross insubordination, deficient performance, theft, conviction of a crime of moral turpitude upon such conviction, violation of School Board Rule 6Gx13-4A-1.21, Responsibilities and Duties, and 6Gx13-4E-1.01, Absences, Leaves and Vacations.  This action is taken in accordance with Sections 230.03(2), 230.23(5)(f), 231.3605, 231.44, and 447.209, Florida Statutes.

RECOMMENDED: That effective October 11, 2000, at the close of the workday, the School Board suspend and initiate dismissal proceedings against
Mr. Gregory Gissendanner, Custodian, at Building Operations, pending the outcome of a hearing, if requested.

The purpose of this bid, opened on August 29, 2000, is to estalish a contract, to purchase services, at firm unit prices, as may be required, for the administration of Hepatitis "B" vaccine, for the Office of Professional Standards.

J-50 REQUEST TO DECLARE EMERGENCY AND WAIVE BIDDING PROCEDURES FOR CORRECTING LIFE SAFETY DEFICIENCIES

On June 21, 2000, the Board approved the sum of $30 million to correct life safety deficiencies, which had been identified in schools throughout the District.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1) declare the correction of life safety issues requiring capital modification to existing facilities to be of an emergency nature;
2) authorize the Superintendent to waive such bidding and other related requirements as necessary to comply with the time frame committed to the Department of Education;

Staff has completed the selection process for one (1) Design Criteria Professional (DCP) to prepare a prototypical design criteria package for Primary Learning Centers (PLC) that can be re-use at various sites.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, commission the firm of Gili-McGraw Architects, to prepare and administer the design criteria package for Primary Learning Center (PLC) "B-1" at Auburndale Elementary School and PLC "D-1" at Brentwood Elementary School for the following considerations:
