This request for change in the construction contract includes two items for the School Board’s confirmation and consideration. Attachment A presents a description of the item, the cause for the change, the effect upon the contract, and the action recommended to the Board. In order to prevent delay in the completion of the project, Staff authorized the Design Builder to proceed with item 1. These items are presented to the Board for confirmation as required by State Statute.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, confirm/approve Change Order No. 1 on Project No. 0051-BB, Design-Build, Mays Middle School for an extra of $498,806.

AGENDA ITEMS REVISED AFTER PUBLICATION OF THE AGENDA:

A-3 REVIEW OF THE ACCOUNTS PAYABLE OPERATION BY THE PROFIT RECOVERY GROUP INTERNATIONAL, INC.

At the School Board meeting of January 12, 2000, an item was presented to the Board, and approved, to contract with an independent firm to review/audit the districts payments to vendors for possible duplicate payments. The contract was awarded to The Profit Recovery Group International, Inc. (PRG). Payment for said service was based on a percentage contingent on any recovery as a result of duplicate payments found.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, receive and file the review of the Account Payable Report by The Profit Recovery Group International, Inc.

B-4 THAT THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, CONDUCT A REVIEW OF THE SUPERINTENDENT OF SCHOOLS AND THE SCHOOL BOARD ATTORNEY AND DISCUSS THEIR PERFORMANCE OF DUTIES AT THE JUNE 20, 200l BOARD MEETING

As elected officials, School Board members are "reviewed" by their constituencies every four years. In addition, the Board requires teachers, clerical staff, security personnel and custodians to undergo a yearly evaluation. A high standard of accountability from the employees of the district is crucial in maintaining an educational system that adequately prepares students for the future.

ACTION PROPOSED BY DR MARTA PEREZ: That The School Board of Miami-Dade County, Florida, exercise its right to review the performance of duties of the Superintendent of Schools and the School Board Attorney and discuss their performance at the June 20, 2001 Board meeting

B-6 CREATION OF TARDY POLICY FOR STUDENTS IN MIAMI-DADE COUNTY PUBLIC SCHOOLS

The School Board’s student adviser, Ms. Marylynn Hunt-Dorta, discussed with me her concerns about the lack of a consistent school-wide policy on student tardies. I have reviewed several Board rules, including Board Rule 6Gx13- 5A-1.04, Student Attendance Specific Responsibilities, and within that Board rule I do not see a provision for student tardies, nor do I see a separate Board rule similarly setting forth the specific responsibilities regarding tardies. However, I do see in Board Rule 6Gx13- 5D-1.08, the Code of Student Conduct, page 24, that:

ACTION PROPOSED BY OR MARTA PEREZ : That The School Board of Miami-Dade County, Florida request the Superintendent to review the student tardy policy and initiate rulemaking to adopt a district-wide policy governing student tardies, if appropriate.

B-8 THAT THE SCHOOL BOARD OF MIAMI-DADE COUNTY DIRECT STAFF TO CONDUCT A REVIEW OF THE TITLE I PROGRAM TO IDENTIFY BEST PRACTICES AND DEVELOP SIX PILOT PROGRAMS FOR TITLE I STUDENTS

The future of our nation is being forged in today’s classrooms. It is clear that our education crisis is the single greatest issue we face. Miami-Dade County Public Schools can no longer tolerate rampant mediocrity and the tragic loss of potential brain power from Title I students.

ACTION PROPOSED BY DR. ROBERT B. INGRAM: That The School Board of Miami-Dade County direct staff to conduct a review of the Title I Program to identify best practices and develop six pilot programs for Title I students.

E-1 PERSONNEL ACTION LISTING OF INSTRUCTIONAL AND NONINSTRUCTIONAL APPOINTMENTS, REASSIGNMENTS, LEAVES AND SEPARATIONS: DECEMBER 5, 2000 - JANUARY 10, 2001

The Personnel Action Listing numbered 900 consisting of 268 pages, includes the following items:

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the instructional and noninstructional appointments, reassignments, leaves, and separations as included in Personnel Action Listing 900.

E-2 APPOINTMENTS AND LATERAL ASSIGNMENTS OF MANAGERIAL EXEMPT, PROFESSIONAL, AND TECHNICAL PERSONNEL FOR 2000-2001

The following recommendations are made in accordance with Board Rules 6Gx13-4A-1.16, 6Gx13-4A-1.161, and the Miami-Dade County Public Schools/Dade County Schools Administrators’ Association labor contract.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the recommendations as set forth above for appointments and lateral transfers, to be effective February 15, 2001, or as soon thereafter as can be facilitated.

G-64 REQUEST AUTHORIZATION TO UTILIZE OTHER ENTITY BIDS, FOR PURCHASES OVER $100,000

Authorization is requested to utilize the State of Florida Contract #070-001-99-l -AUTOMOBILES AND LIGHT TRUCKS, which expires on September 19, 2001, to purchase various types of vehicles, for Maintenance and Operations. The referenced bid is issued by the State of Florida, on a statewide basis, for various types of vehicles. Inasmuch as this is a statewide bid, manufacturers bid through authorized dealers offering special incentives and price concessions on their vehicles.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, AUTHORIZE the Bureau of Procurement and Materials Management, to utilize the following contracts:

1. State of Florida Contract #070-00 l-99- 1 -AUTOMOBILES AND LIGHT TRUCKS, to purchase various types of vehicles, for Maintenance and Operations, for a total amount of $428,922.
2. Miami-Dade County, Florida Contract #5203-0/01 CW - MODEL YEAR 2001 VANS, to purchase walk-in step vans, model year 2001, for Plant Operations, for a total amount of $209,601.48.

G-84 AWARD BID #057-AA09 - SANITATION SERVICES AND CLEANING SUPPLY PROGRAM (REBID)

The purpose of this bid, opened on November 16, 2000, is to establish a contract, to purchase, at a firm unit price, quantities, as may be required, of sanitation and cleaning supply services, for the Department of Food and Nutrition. Of 102 vendors sent bid forms or card notices of this advertised bid, 6 responded, with 2 bids meeting specifications and 4 no bids. This bid reflects a savings of $249,815.84 from the previous bid expenditure.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, AWARD Bid #057-AA09 - SANITATION SERVICES AND CLEANING SUPPLY PROGRAM (REBID), to purchase, at a firm unit price, quantities, as may be required, of sanitation and cleaning supply services, for the Department of Food and Nutrition, during the term of the bid, effective February 14, 2001, through February 13, 2002, as follows:

G-86 AWARD OF BID #078-AA03 - VENDING MACHINE SERVICE - ACCESS FEE BASED

The purpose of this bid, opened on January 11, 2001, is to establish a contract, at a firm annual access fee per senior high school location, paid to Miami-Dade County Public Schools, to provide vending machine service at thirty-five (35) senior high and vocational schools.

RECOMMENDED: That The School Board of Miami-Dade County, Florida AWARD Bid #078-AA03 - VENDING MACHINE SERVICE - ACCESS FEE BASED, to establish a contract, at a firm annual access fee per senior high school location, paid to Miami-Dade County Public Schools, to provide vending machine service at thirty-five (35) senior high and vocational schools, during the term of the bid, effective April 1, 2001, through March 31, 2002, as follows:

J-2 AUTHORIZATION TO AMEND THE AGREEMENT WITH LUCKY START, LTD., FOR THE CONSTRUCTION OF PRIMARY LEARNING CENTER "U" AS A CONTRIBUTION IN-LIEU-OF IMPACT FEES

At its September 20, 1995 meeting, the Board authorized the Superintendent to negotiate a Declaration of Restrictions (Declaration) for Applications No. 94-597 and 95-272, for the following: 1) applicant’s construction of a Primary Learning Center (PLC) on an approximate two-acre parcel; 2) the dedication of an additional approximate two-acre parcel; and 3) the option to purchase six additional acres at fair market value, within a proposed 703-unit residential development, located at S.W. 157 Avenue and S.W. 96 Street to mitigate the impact of the development.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent or his designee to execute an amendment to the Agreement and to support a companion amendment to the Declaration of Restriction with Lucky Start, Ltd., as may be needed, to provide for a reimbursement in an amount not to exceed $327,427, under terms and conditions set forth above.

J-28 APPROVAL OF AN EXCEPTION TO THE STANDARD SITE SIZE FOR VARIOUS SCHOOLS

Florida Statutes require that educational facilities be adequate in size to meet the educational needs of the students to be served. Pursuant to s.235.19 Florida Statute, the Florida Department of Education recommends standard site sizes for educational plants. Exceptions to recommended site sizes are allowed, provided the Board, by a two-thirds majority, recommends the site and finds that it can provide an appropriate and equitable educational program on such site.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

(1) approve the exception to the existing site size for the educational facilities referenced herein; and
(2) authorize the Superintendent to submit to the Commissioner of Education at the Florida Department of Education, the Board-approved site exceptions for the educational facilities referenced herein.

K-1 THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA v. PRISCILLA G. STEPHENS KRUIZE - DOAH CASE NO. 00-l 114

On March 15, 2000, the School Board terminated teacher Priscilla G. Stephens Kruize’s employment contract, pending a hearing if requested. A hearing was requested and the case was tried on September 15, 2000, before DOAH Administrative Law Judge Florence Rivas Snyder in Miami,  Florida.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, enter its final order in the case of The School Board of Miami-Dade County, Florida v. Priscilla G. Stephens Kruize, accepting the recommendation of the Administrative Law Judge in DOAH Case No. 00-l 114 or accepting the exceptions set forth in Respondent’s Exceptions to Recommended Order, filed on behalf of the employee on January 16, 200l.


AGENDA ITEMS REPLACED AFTER PUBLICATION OF THE AGENDA:

A-1 RATIFICATION OF NEW THREE YEAR LABOR CONTRACT BETWEEN MIAMI-DADE COUNTY PUBLIC SCHOOLS AND THE AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES (AFSCME), LOCAL 1184

Negotiations on a successor labor contract between The School Board of Miami-Dade County, Florida and the American Federation of State, County and Municipal Employees (AFSCME), Local 1184 began on June 16, 2000.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, ratify the tentative agreement with the American Federation of State, County, and Municipal Employees (AFSCME), Local 1184, effective July 1, 2000 through June 30, 2003. The Agreement will be effective July 1, 2000.

A-4 RESOLUTION NO. 1, 2000-01 CAPITAL OUTLAY FUNDS MID-YEAR BUDGET REVIEW

This Capital Outlay Resolution will recognize new revenues, changes to appropriations, and various changes in object codes made since budget adoption.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. Approve Resolution No. 1, 2000-01 Capital Outlay Funds Mid-Year Budget Review, (a) recognizing new revenues, (b) amending appropriations, and (c) documenting changes in object codes, as described above and summarized on page 6 of 6.
2. Authorize changes to the Five Year Facilities Work Program which result from Resolution No. 1, 2000-01 Capital Outlay Funds Budget.

B-7 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO PROMOTE THE CONSERVATION OF WATER-- IN MIAMI-DADE COUNTY PUBLIC SCHOOLS; AND EDUCATE STAFF, STUDENTS, AND PARENTS ABOUT THE COMPREHENSIVE EVERGLADES RESTORATION PLAN

The Florida Everglades was once a vibrant, free-flowing river of grass that provided clean water from Lake Okeechobee down to the Florida Bay. Today, this extraordinary ecosystem is dying. The dramatic increase in population of South Florida has contributed greatly to the steady decline of this ecosystem that is also leading to a severe shortage of clean, reliable water for South Florida.

ACTION PROPOSED BY MS. BETSY H. KAPLAN: That The School Board of Miami-Dade County, Florida, direct the Superintendent of Schools to promote the conservation of water in Miami-Dade County Public Schools; and educate staff, students, and parents about the Comprehensive Everglades Restoration Plan.

B-11 REQUEST FOR APPROVAL OF RESOLUTION NO. 01-08 OF THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA ENDORSING MARCH 12-16, 200l AS "YOUTH CRIME WATCH OF MIAMI-DADE COUNTY WEEK" TO BE CELEBRATED IN ALL OF MIAMI-DADE COUNTY’S PUBLIC SCHOOLS

Youth Crime Watch of Miami-Dade County is an important organization to this community and in particular to our youth. It has a long and distinguished history of working jointly with Miami-Dade County Public Schools (M-DCPS) to educate young people in crime prevention, public safety and school and community pride.

ACTION PROPOSED BY DR. ROBERT B. INGRAM:

That The School Board of Miami-Dade County, Florida, approve Resolution No. 01-08 of The School Board of Miami-Dade County, Florida, endorsing March 12-1 6, 2001 as "Youth Crime Watch of Miami-Dade County Week" to be celebrated in all of Miami-Dade County’s public schools.

B-12 EXTENSION OF SUPERINTENDENT OF SCHOOLS CONTRACT

Since December of 1996, Miami-Dade County Public Schools (M-DCPS) has experienced a series of dramatic events and challenges from which it has emerged stronger than ever before. A large part of this success is attributable to the leadership of the Superintendent of Schools and the excellent relationship that he has maintained with the School Board.

ACTION PROPOSED BY MRS. MANTY SABATES MORSE: That The School Board of Miami-Dade County, Florida, extend the Superintendent’s contract with the same terms and conditions, from July 1, 2002 through June 30, 2004, with no salary increases to be provided during this term of the contract.

E-8 APPOINT AND ASSIGN:
ARCHITECT-MAINTENANCE CONSTRUCTION PLANNER

The following recommendation is made in accordance with the Miami-Dade County Public Schools/Dade County School Administrators’ Association labor contract.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint Mr. Reinaldo J. Olivera, currently, a Coordinator, Construction, pay grade 40, to the open, budgeted position of Architect-Maintenance Construction Planner, pay grade 42, 12 months, and assign to Maintenance and Operations, effective February 15, 2001, or as soon thereafter as can be facilitated.

E-9 APPOINT AND ASSIGN:

The following recommendation is made in accordance with the Miami-Dade County Public Schools/Dade County School Administrators’ Association labor contract.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint Mr. Louis Perez, currently, a Project Supervisor I, pay grade 41, Systems and Programming, to the open, budgeted position of Project Manager, Systems and Programs, pay grade 43, 12 months, and assign to the Office of Information Technology, effective February 15, 2001, or as soon thereafter as can be facilitated.

E-17 TERMINATION OF EMPLOYMENT CONTRACT OF INSTRUCTIONAL EMPLOYEE FOR FAILURE TO SATISFACTORILY CORRECT PERFORMANCE DEFICIENCIES DURING THE 90-CALENDAR DAY PERFORMANCE PROBATION

The following instructional employee has been notified by the Superintendent of Schools that he has failed to satisfactorily correct identified performance deficiencies during his 90-Calendar Day Performance Probationary period:

RECOMMENDED: That The School Board of Miami-Dade County, Florida, terminate the employment contract of the above-referenced instructional employee, effective February 14, 2001, the close of the workday, pending the outcome of a hearing, if requested.

ELECTRONIC DATA PROCESSING (EDP) AUDITS DIRECTOR I

The following recommendation is made in accordance with the Miami-Dade County Public Schools/Dade County School Administrators’ Association labor contract.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint Ms. Patricia A. Lvstad, to the open, budgeted position of EDP Audits Director I, pay grade 45, 12 months, and assign to Management and I Compliance Audits, effective February 15, 2001, or as soon thereafter as can be facilitated.

b) award Project No. A-0592B, New Transportation Facility, John H. Schee Transportation Center on the basis of Base Bid in the amount of $2,350,000 to the low bidder:

K-3 CONTRACT WITH OUTSIDE FIRM FOR EMINENT DOMAIN MATTERS

In 1996, the School Board entered into a contract with the Miami-Dade County Attorney’s Office to represent the School Board in Eminent Domain cases. This contract provided that inasmuch as it is possible that the County Attorney’s Office may, at times, be carrying a caseload of County work which is too heavy to permit it to take on additional work, the School Board would have the ability to obtain another eminent domain firm for those occasions. The County Attorney’s Office has advised that its current caseload is too heavy to permit taking on additional work. Therefore, the School Board needs to retain another eminent domain firm to pursue the acquisition of property for State School "JJJ" and other acquisitions.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, employ the law firm of Ruden McClosky Smith Schuster & Russell, P.A. to represent the Board’s interests in cases arising out of Eminent Domain matters and other related fields as may be assigned by the Board Attorney, with compensation not to exceed $160 per hour.
