* The public hearing shall begin no later than approximately 6:30 p.m. The Chair may begin calling speakers who are present immediately following the conclusion of the regular agenda. The public hearing shall not conclude before 4:30 p.m., unless all of the speakers signed up to speak are present and have been given the opportunity to speak.

Citizens who wish to speak on matters not on the agenda, or on agenda items that appear on the consent agenda, will be heard at the public hearing. The total time allotted for the public hearing shall not exceed one and one-half hours.

Pursuant to Board Policy 0169.1, a person not scheduled in advance to speak on a non-agenda topic must submit, either before or during the regularly scheduled meeting, a written request to the Chair. Board members present at the meeting must vote by a majority for the person to be heard.

The School Board of Miami-Dade County, Florida, seeks public input and participation. However, the public purpose is not served when citizens become disorderly or disrupt the meeting. Accordingly, the Chair may order the removal from any School Board meeting of any person interfering with the expeditious or orderly process of the meeting provided the Chair has first issued a warning that continued interference with the orderly processes of the meeting will result in removal. Any law enforcement authority or a sergeant-at-arms designated by Chair shall remove any person ordered removed pursuant to this section §1001.372 (3), Fla.Stat.

D-21  REQUEST APPROVAL OF ADMINISTRATIVE APPOINTMENTS FOR 2019-2020 (REVISED)

RECOMMENDED:  That The School Board of Miami-Dade County, Florida, approve the recommendation for appointments and lateral transfers to be effective August 15, 2019, or as soon thereafter as can be facilitated, with the exception of the effective dates as noted throughout the item and authorize compensation adjustments upon appointment and thereafter as stipulated in the agenda item.


D-22  REQUEST THE SCHOOL BOARD TO AUTHORIZE THE SUPERINTENDENT OF SCHOOLS TO SUBMIT AN UPDATE AND CONTINUATION OF THE M-DCPS PROFESSIONAL LEARNING CATALOG (2019-2024) TO THE FLORIDA DEPARTMENT OF EDUCATION

RECOMMENDED:  That the School Board of Miami-Dade County, Florida authorize the Superintendent to submit an update and continuation of the current Professional Learning Catalog, 2019-2024 to the Florida Department of Education (FDOE) for approval, as required in accordance with State Board Rule 6A-5.071 (FAC).


D-55  RECOMMENDED ACCEPTANCE OF AGREED UPON DISCIPLINARY ACTION (REVISED)

RECOMMENDED: That the School Board of Miami-Dade County, Florida, approve the Superintendent's recommendation for disciplinary action, which has been agreed to by the employee.

  1. Lea Coto: suspension without pay from her position as Secretary/Treasurer at David Lawrence, Jr. K-8 Center, for ten (10) workdays, effective August 15, 2019, for just cause, including, but not limited to: violation of School Board Policies 4210, Standards of Ethical Conduct; 4210.01, Code of Ethics; and 6610, Internal Accounts. This action is taken in accordance with Sections 1001.32(2), 1012.22(1 )(f), and 447.209, Florida Statutes.

D-65  REQUEST FOR AUTHORIZATION TO ENTER INTO CONTRACTUAL AGREEMENTS WITH COMMUNITY AGENCIES FOR THE DEPARTMENT OF FOOD AND NUTRITION TO PROVIDE AFTERSCHOOL MEALS/SNACKS FOR PARTICIPANTS IN THEIR PROGRAMS FROM AUGUST 19, 2019 THROUGH AUGUST 19, 2022.

RECOMMENDED:  That The School Board of Miami-Dade County, Florida, authorize the Superintendent of Schools to enter into contractual agreements with community agencies for the Department of Food and Nutrition to provide afterschool meals/snacks for participants in their programs from August 19, 2019 through August 19, 2022.

 

E. INNOVATION, GOVERNMENTAL RELATIONS, AND COMMUNITY ENGAGEMENT/FISCAL ACCOUNTABILITY


E-106  REQUEST FOR APPROVAL OF THE TENTATIVE BOARD MEETING SCHEDULE FOR 2020

RECOMMENDED:  That The School Board of Miami-Dade County, Florida, tentatively approve for planning purposes, the following schedule of Board meeting dates for the period January-December 2020: January 15, February 12, March 11 (Instructional Materials Public Hearing), March 18, April 29, May 20, June 17, July 15, July 29 (First Budget Public Hearing), August 12, September 2 (Regular Meeting/Second Budget Public Hearing), October 21, November 17 (Organization Meeting), November 18 and December 9.  The final listing of meeting dates for 2020 will be established by the Board at the 2019 Organization Meeting scheduled for Wednesday, November 20, 2019.


E-142  REJECT REQUEST FOR PROPOSALS RFP-18-004-CH MENTAL WELLNESS CURRICULUM

RECOMMENDED:  That The School Board of Miami-Dade County, Florida REJECT REQUEST FOR PROPOSALS NO. RFP-18-004-CH – MENTAL WELLNESS CURRICULUM, to permit rebidding at a later date.

 

E-201  REQUEST AUTHORIZATION TO ACCEPT GRANT AWARDS/DONATIONS FOR THREE PROGRAMS FROM MULTIPLE FUNDING SOURCES AND ENTER INTO CONTRACTUAL SERVICE AGREEMENTS WITH THE AGENCIES PRESCRIBED IN THE GRANT

RECOMMENDED:  That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

  1. accept three grant awards for programs from:
  2. a. Florida Department of Education (FLDOE) for funding under Adults with Disabilities (AWD) Grant Program, in the approximate amount of $1,125,208, for the grant period of July 1, 2019, through June 30, 2020;

    b. Florida Department of Education (FLDOE) for funding under Carl D. Perkins, Career and Technical Education Secondary Programs, Section 131, in the approximate amount of $4,446,135, for the grant period of July 1, 2019, through June 30, 2020; and

    c. Florida Department of Education (FLDOE) for funding under Carl D. Perkins, Career and Technical Education Postsecondary Programs, Section 132, in the approximate amount of $1,176,687, for the grant period of July 1, 2019, through June 30, 2020.

  3. enter into contractual service agreements with the agencies prescribed in the grant, with whom the School Board must contract, pursuant to Board Policy 6320 – Purchase Approval and Competitive; Bidding Process Requirements;
  4. extend these programs and contractual agreements as authorized through official notification from the granting agency in order to complete the goals of the program;
  5. retain funds from the grant in an amount not to exceed the annually negotiated indirect cost rate, as allowed and approved by the FLDOE;
  6. direct Financial Services to establish appropriations in the amount approved or as amended by the granting agency; such appropriations to be reported periodically to the Board;
  7. authorize travel out-of-state as required by the grant parameters; and
  8. eliminate any grant-funded position upon cessation of the grant funds, and place the impacted employee(s) on the Personnel Action Listing of Instructional and Non-Instructional Appointments, Reassignments, Leaves and Separations for the relevant period.

 

F. FACILITIES AND CONSTRUCTION

F-26   COMMISSION OF LAURA M. PEREZ & ASSOCIATES, INC., AS ARCHITECT/ENGINEER OF RECORD (A/E) FOR PART 2 (FULL A/E) SERVICES FOR GENERAL OBLIGATION BOND FUNDED ADDITION & RENOVATIONS AT MIAMI BEACH SOUTH POINTE ELEMENTARY SCHOOL, PROJECT NUMBER 01530400

RECOMMENDED: That The School Board of Miami-Dade County, Florida, commission Laura M. Perez & Associates, Inc., as Architect/Engineer of Record for Part 2 (Full A/E) Services for General Obligation Bond Funded Addition & Renovations at Miami Beach South Pointe Elementary School, located at 1050 Fourth Street, Miami Beach, FL 33139, Project Number 01530400, as follows:

  1. A lump sum fee of $327,000 for Part 2 Basic Services; and
  2. Project scope and all terms and conditions as set forth in the Agreement and the body of the agenda item.

F-29  AUTHORIZATION TO AMEND THE PROGRAM MANAGEMENT SUPPORT SERVICES AGREEMENT WITH WSP USA INC., BY THE ADDITION OF GEOTECHNICAL CONSULTANTS INTERNATIONAL, INC. (D/B/A GCI, INC.) AS A SUB-CONSULTANT FIRM TO PROVIDE SUPPORT SERVICES STAFF

RECOMMENDED:  That The School Board of Miami-Dade County, Florida, authorize the addition of Geotechnical Consultants International, Inc., d/b/a GCI, Inc., as a sub-consultant to WSP USA Inc., for the Program Management Support Services Agreement in accordance with the terms and conditions, for the duration of the Agreement.

RECOMMENDED:  That The School Board of Miami-Dade County, Florida, commission Wolfberg Alvarez & Partners, Inc., as Architect/Engineer of Record for Part 2 (Full A/E) Services for General Obligation Bond Funded Renovations at Homestead Middle School, located at 650 N.W. 2 Avenue, Homestead, Florida 33030, Project Number 01528900, as follows:

  1. A lump sum fee of $357,200 for Part 2 Basic Services; and
  2. Project scope and all terms and conditions as set forth in the Agreement and the body of the agenda item.

F-40  CHANGE ORDER CONFIRMATION OR APPROVAL

RECOMMENDED:  That The School Board of Miami-Dade County, Florida, confirm or approve:

B-1.    Change Order Number 7 on Project Number 01426100, General Obligation Bond funded addition/renovation Project (K-8 Conversion), Ethel Koger Beckham K-8 Center for an additional cost of $11,400.00.

B-2. Final Change Order, Change Order Number 2 on Project Number 01442700, Classroom Addition To Replace Portables, Gulfstream Elementary for a time extension of 73 days.

B-3. Final Change Order, Change Order Number 1 on Project Number 01424100, General Obligation Bond funded partial replacement/renovation project, Hibiscus Elementary School for a time extension of 19 days.

B-4.    Final Change Order, Change Order Number 1 on Project Number 01433900, General Obligation Bond funded renovation project, Jack D. Gordon Elementary School for a credit of $98,234.84.

B-5. Final Change Order, Change Order Number 2 on Project Number 01326900, General Obligation Bond funded remodeling/renovation project, Miami Northwestern Senior High School for a credit of $9,211.57.

B-6. Change Order Number 5 on Project Number 01509506, General Obligation Bond funded, Pull Out to expedite black box theatre, PE and Dining shelter, Parking, Norland Middle School for an additional cost of $120,405.50.

F-58   MIAMI-DADE COUNTY PUBLIC SCHOOLS ANNUAL SAFETY-TO-LIFE INSPECTION DOCUMENTS

RECOMMENDED:  That The School Board of Miami-Dade County, Florida, receive the Miami-Dade County Public Schools Annual Safety-to-Life Inspection Documents.


F-80    AUTHORIZATION TO APPROVE THE PREQUALIFICATION OF CONTRACTORS FOR EDUCATIONAL FACILITIES CONSTRUCTION

RECOMMENDED:  That The School Board of Miami-Dade County, Florida, approve the prequalification certificates for one (1) new application for educational facilities, as listed on Attachment “A” of the agenda item.



G. SCHOOL BOARD ATTORNEY

G-1   INITIAL READING: TO AMEND BOARD POLICIES 6835, OFFICE OF MANAGEMENT AND COMPLIANCE AUDITS; AND 6840, AUDIT AND BUDGET ADVISORY COMMITTEE

RECOMMENDED:  That The School Board of Miami-Dade County, Florida, authorize the Superintendent to initiate rulemaking proceedings in accordance with the Administrative Procedure Act to amend Policies 6835, Office of Management and Compliance Audits, and 6840, Audit and Budget Advisory Committee.


G-2   AUTHORIZATION TO RETAIN OUTSIDE LEGAL COUNSEL IN THE FOLLOWING MATTERS: (1) CITY OF AVENTURA’S INVOCATION OF FLORIDA’S GOVERNMENTAL CONFLICT RESOLUTION ACT AND (2) 20-1500 PROJECT

RECOMMENDED:   That The School Board of Miami-Dade County, Florida, authorize the School Board Attorney to retain the following attorneys:

  1.  Shareholders Mr. Elliot Scherker and Mr. Frank Sanchez at a rate of $650.00 per hour, Mr. Jay Yagoda (Of Counsel) and Ms. Nancy Lash at a rate of $550 per hour, Mr. Robert C. Gang at $395.00 per hour, Ms. Brenda Saavedra at $495.00 per hour, Ms. Stephanie Jimenez at $375 per hour and paralegals from the firm at $130.00 per hour from the law firm Greenberg Traurig, P.A.; and
  2. Attorneys Isabel Diaz, Richard Rodriguez, Daniel Hanlon and Vivian de las Cuevas from the law firm of Holland & Knight at $494.00 per hour and other attorneys (partners and associates) at $394.00 per hour, and paralegals at an hourly rate of $175.00 per hour.

ACTION PROPOSED BY DR.  MARTIN KARP:   That The School Board of Miami-Dade County, Florida, direct the Superintendent to:

  1. Continue encouraging student participation in the School Breakfast Program at all Miami-Dade County Public Schools; and,
  2. Encourage adult participation, if feasible, in the School Breakfast Program on October 2, 2019 in conjunction with the International “Walk Our Children to School Day.”

H-4    MIAMI-DADE COUNTY PUBLIC SCHOOL BOARD ENDORSEMENT OF OCTOBER 2019 AS NATIONAL PRINCIPALS MONTH (REVISED)

ACTION PROPOSED BY MS. MARIA TERESA ROJAS:  That The School Board of Miami-Dade County, Florida, endorse October 2019 as National Principals Month in Miami-Dade County Public Schools.

H-8   COLLABORATION WITH MIAMI-DADE COUNTY PARKS DEPARTMENT FOR MIAMI-DADE COUNTY PUBLIC SCHOOLS PARTICIPATION IN NOCHES TROPICALES EVENTS (REVISED)

ACTION PROPOSED BY LUBBY NAVARRO:   That The School Board of Miami-Dade County, Florida, request that the Superintendent explore the feasibility of collaborating with Miami-Dade County Parks Department to give school bands the opportunity to perform at Tropical Park for Noches Tropicales.

ACTION PROPOSED BY CHAIR PERLA TABARES HANTMAN:    That The School Board of Miami-Dade County, Florida, request the Superintendent integrate the “BikeSafe” Bicycle Safety Program, developed by the University of Miami KIDz Neuroscience Center, into the existing Miami-Dade County Public Schools Pedestrian/Bus Safety Education Program, grades K-8 districtwide.
