A-1 REQUEST FOR THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, TO ENTER INTO A CONTRACTUAL AGREEMENT WITH EDISON SCHOOLS INC. TO EXTEND THE PARTNERSHIP BETWEEN MIAMI-DADE COUNTY PUBLIC SCHOOLS AND EDISON SCHOOLS INC. EXISTING AT HENRY E. S. REEVES ELEMENTARY SCHOOL FROM JULY 1, 200l THROUGH JUNE 30, 2006

At the School Board meeting of December 13, 1995, the Board entered into a contractual agreement with The Edison Project for five academic years, beginning August 1996 through June 30, 200l. This contract established the partnership with Miami-Dade County Public Schools (M-DCPS) and The Edison Project at Henry E. S. Reeves Elementary School.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, enter into a new contractual agreement with Edison Schools Inc. to extend the partnership that authorizes management, operational, and professional development services for the K-5 component at Henry E. S. Reeves Elementary School by Edison Schools Inc. beginning July 1, 2001 through June 30, 2006.

A-2 SUBMISSION OF A CHARTER SCHOOL APPLICATION FOR HENRY E. S. REEVES-EDISON JUNIOR ACADEMY WITH RECOMMENDATION FOR APPROVAL; AND AUTHORIZATION FOR THE SUPERINTENDENT TO NEGOTIATE A FIVE-YEAR CHARTER SCHOOL CONTRACTUAL AGREEMENT BEGINNING WITH THE 2001-2002 SCHOOL YEAR

As established in School Board Rule 6Gx13-6A-1.47, Charter Schools, Miami-Dade County Public Schools received charter school applications from individuals and/or organizations from the community.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. approve the Henry E. S. Reeves-Edison Junior Academy application and authorize the negotiation of a five-year charter school contractual agreement for the 2001-2002 through 2005 2006 school years; and

2. authorize the Superintendent to negotiate with the approved applicant the charter school contractual agreement which reflects the contents of the application, as approved by the School Board. This charter school contractual agreement will be submitted for School Board consideration at a subsequent meeting at which time there will be a public hearing to provide for community input.

The purpose of this bid, opened on March 22, 2001, is to establish a contract, to purchase, at firm unit prices, quantities, as may be required, of storage services for dry, frozen, and refrigerated commodities, for the Department of Food and Nutrition Food Service Program. This is a term bid which states that the Board may purchase quantities, as may be required, at the unit price bid, but is not obligated to purchase any guaranteed amount. Of 37 vendors sent bid forms or card notices of this advertised bid, 3 responded, with 2 bids meeting specifications (not all vendors bid all items) and 1 no bid.

K-3 ACCEPTANCE OF RESIGNATION THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA v. BRIAN
GLASFORD - DOAH CASE NO. 00-3038

At its regularly scheduled meeting of July 19,2000, the School Board took action to suspend and dismiss teacher Brian Glasford from all employment for just cause including, but not limited to, misconduct in office, immorality, and for violation of School Board rules. The employee requested a hearing on his dismissal which was scheduled for May 1,200l. Prior to said hearing, on April 9, 2001, the employee tendered his resignation.

RECOMMENDED: That The School Board of Miami-Dade County, Florida accept the resignation of Brian Glasford, teacher at Coral Reef Senior High School, effective as of April 9, 200l.

K-4 KIMBERLY HALL v. THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA - CASE NO. SBC 01-314

By letter received by the School Board Clerk on April 11, 2001, the above-named employee requested a hearing to contest her dismissal from employment.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, enter its order in Kimberly Hall v. The School Board of Miami-Dade County. Florida, Case No. SBC 01-314 denying the Request for Administrative Hearing filed as untimely as set forth in the proposed order.

B-10 REQUEST THAT THE SCHOOL BOARD OF MIAMI-DADE COUNTY DIRECT THE SUPERINTENDENT TO DRAFT A REVISION TO BOARD RULE 6Gx13-7A-1.011, HISTORICAL PRESERVATION OF FACILITIES, TO REQUIRE PUBLIC NOTIFICATION AND OPPORTUNITY FOR PUBLIC COMMENT PRIOR TO COMMENCEMENT OF DESIGN WORK ON ANY PROJECT INVOLVING RENOVATION, REMODELING, OR DEMOLITION OF ANY MDCPS BUILDING ON ANY MDCPS SITE THAT IS FIFTY YEARS OLD OR OLDER TO PROTECT THE COMMUNITIES INTEREST AND TO ALLOW MDCPS TO IDENTIFY AND BETTER UNDERSTAND THE ARCHITECTURAL, CULTURAL, OR HISTORIC SIGNIFICANCE OF SAID BUILDING IN THE EARLY PLANNING STAGES WHEN ALTERATION OR DEMOLITION IS BEING CONSIDERED.

An original building of the Mays Middle School was demolished by MDCPS over the year 2000 Christmas break. This demolition took place after an engineering analysis determined that the planned restoration was not feasible due to structural problems.

ACTION PROPOSED BY JACQUELINE V. PEPPER: That The School Board of Miami-Dade County, Florida direct the

Superintendent to draft a revision to Board Rule 6Gx13-7A-1.011, Historical Preservation of Facilities, to require public notification and opportunity for public comment prior to commencement of design work on any project involving renovation, remodeling, or demolition of any MDCPS fifty years or older to allow for community input as to the architectural, cultural, or historic significance of the building to the community.

B-11 REQUEST THAT THE SCHOOL BOARD OF MIAMI-DADE COUNTY DIRECT THE SUPERINTENDENT TO DIRECT STAFF TO DESIGNATE AN ARCHITECT TO BE RESPONSIBLE FOR ALL ASPECTS OF COMPILING AND COMPLETING THE APPLICATIONS FOR THE SIT AWARDS AVAILABLE FROM THE STATE OF FLORIDA SMART SCHOOLS CLEARINGHOUSE. THIS TEMPORARY ASSIGNMENT REQUIRES THE REASSIGNMENT OF ONE FULL TIME EXISTING EMPLOYEE FOR APPROXIMATELY THREE MONTHS

In 1997, the State of Florida established the Smart Schools Clearinghouse to assist school districts in building SMART schools utilizing functional and frugal practices. Smart Schools are schools that are soundly made, accountable, reasonable, and thrifty. The Smart Schools Clearinghouse was funded and authorized to give grants to school districts which constructed schools meeting the program’s guidelines.

ACTION PROPOSED BY JACQUELINE V. PEPPER: That The School Board of Miami-Dade County, Florida, direct the Superintendent to direct staff to designate an architect to be responsible for all aspects of compiling and completing the applications for the SIT awards available from the State of Florida SMART Schools Clearinghouse. This temporary assignment requires the reassignment of one full time existing employee for approximately three months.

B-12  REQUEST THAT THE BOARD DIRECT THE SUPERINTENDENT, WITH THE ASSISTANCE OF THE SCHOOL BOARD AUDIT COMMITTEE, TO PREPARE A REQUEST FOR PROPOSALS (RFP) FOR PROFESSIONAL SERVICES TO PERFORM AN OUTSIDE AUDIT OF THE CONSTRUCTION MONIES EXPENDED SINCE THE 1988 BOND ISSUE AND REVIEW FACILITIES PLANNING AND CONSTRUCTION ORGANIZATIONAL STRUCTURE

Recently, several things have happened which point to the need for the District to have an independent look into how the construction monies have been spent and the operations of Facilities Planning and Construction.

ACTION PROPOSED BY JACQUELINE V. PEPPER: That The School Board of Miami-Dade County, Florida, direct the Superintendent, with the assistance of the School Board Audit Committee, to prepare an RFP for professional services to perform an outside audit of the construction monies expended since the bond issue of 1988, and of the organizational structure of Facilities Planning and Construction, and to present the RFP at the June 20, 2001, School Board meeting

C-5 REQUEST FOR AUTHORIZATION TO IMPLEMENT EDUCATIONAL PROGRAMS FOR THE 2001 SUMMER SCHOOL SESSION FOR ELEMENTARY SCHOOLS AND MIDDLE SCHOOLS - JULY 9, 2001 THROUGH AUGUST 3, 2001, AND SENIOR HIGH SCHOOLS - JULY 9, 200l THROUGH AUGUST 17, 200l

LEGISLATIVE ACTION AND FUNDING FOR THE 2001 SUMMER PROGRAM

Lacking necessary action by the State Legislature, funding of the 2001 Summer Program is not finalized. The Governor’s budget continues the summer program within the Supplemental Academic Instruction (SAI) program. The SAI program permits these funds to be used for an extended school year, after school instruction, tutoring, extended day, and/or mentoring programs.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1.  authorize the proposed allocation formulas for the 2001 summer session, including designated supplementary programs, and authorize the Superintendent to implement the programs subject to any additional adjustments necessary to balance the overall 2001 -2002 operating budget;

RECOMMENDED: That The School Board of Miami-Dade County, Florida, appoint Mr. Rolando Avila, currently a Senior Project Manager, Telecommunications, pay grade 43, to the open budgeted position of Supervisor, Telecommunications, pay grade 44, 12 months, and assign to the Office of Information Technology, effective April 19, 2001, or as soon thereafter as can be facilitated.

F-1 REQUEST FOR AUTHORIZATION TO ENTER INTO CONTRACTUAL AGREEMENTS WITH THE SOUTH FLORIDA EMPLOYMENT AND TRAINING CONSORTIUM (SFETC) TO RECEIVE FUNDING TO IMPLEMENT THE 2001 SUMMER YOUTH EMPLOYMENT AND TRAINING PROGRAMS; PROJECT CYCLE: APRIL 1, 200l THROUGH MARCH 31, 2002

Miami-Dade County Public Schools submitted a letter of intent to the South Florida Employment and Training Consortium (SFETC) to implement the Summer Youth Employment and Training Program for summer 2001. It is recommended that the current contract with SFETC be amended to include the following components:

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. enter into contractual agreements with the South Florida Employment and Training Consortium (SFETC) to receive funding, in the amount of $1,809,700, to implement the 2001 Summer Youth Employment And Training Programs; Project Cycle: April 1, 2001 through March 31, 2002;

2. extend these contractual agreements, at no additional cost, for up to one year, as authorized through official notification from the granting agency, if deemed necessary, in order to complete the scope of the project; and

3. Financial Affairs to establish appropriations in the amounts approved by the granting agency; such appropriations to be reported periodically to the Board.

G-22 RESOLUTION 0l-21 ISSUANCE OF CERTIFICATES OF PARTICIPATION, SERIES 2001A AND 2001B

The attached Resolution grants authorization to issue the Certificates of Participation, Series 2001A and 2001B and provides respectively for fixed rate certificates and variable auction rate certificates. The team of underwriters was previously appointed by the Board. The team consists of eleven firms, including four Minority/Women Business Enterprise (M/WBE) firms.

RECOMMENDED: That The School Board of Miami-Dade County, Florida approve Resolution 01-21 providing for the issuance of Certificates of Participation, Series 2001A and 2001B for the School District of Miami-Dade County, Florida, in an aggregate amount not to exceed a total of $205,000,000.

On March 17, 1999 the Board commissioned the firm of Walgridge Aldinger to provide construction management (CM) at-risk services for State School "B-l" (Ada Merritt Elementary Community School).

RECOMMENDED: That The School Board of Miami-Dade County, Florida, commission the firm of James B. Pirtle Construction Co., Inc. to provide Construction Management (CM) At-Risk services for State School "B-1" (Ada Merritt Elementary Community School) for the following considerations:

1) lump sum fee of $25,000, which represents approximately 0.20% of the construction cost; and

2) authorize the Superintendent to provide written notification of this action to James B. Pirtle Construction, Co., Inc.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve GMP for Project No. A0526B-CM, Roof Repair/Replacement, Exterior Painting and Waterproofing, South Miami Senior High School, in the amount of $1,629,630, which includes a contingency in the amount of $77,601.


AGENDA ITEMS REPLACED AFTER PUBLICATION OF THE AGENDA:

B-3 REQUEST AUTHORIZATION TO DIRECT THE SUPERINTENDENT TO PROVIDE A WORKSHOP TO INTERESTED SCHOOL BOARD MEMBERS ON THE IMPLEMENTATION OF SCHOOL BOARD RULE 6Gx13-4A-1.21, PERMANENT PERSONNEL RESPONSIBILITIES AND DUTIES 

Pursuant to School Board Rule 6Gx13-4A-1.21, Permanent Personnel Responsibilities and Duties, the Superintendent of Schools has the responsibility to develop and distribute periodically information relating to employee conduct, records and reports, reporting crime, disruptive and inappropriate behavior, and self-reporting of arrest and convictions/dispositions.

ACTION PROPOSED BY DR. MARTA PEREZ: That The School Board of Miami-Dade County, Florida, direct the Superintendent to provide a workshop to interested School Board Members on the implementation of School Board Rule 6Gx13-4A-1.21 Permanent Personnel Responsibilities and Duties.

B-13 REQUEST THAT THE BOARD DIRECT THE SUPERINTENDENT TO STUDY AND REPORT ON THE FEASIBILITY OF MAKING ALL THE MIAMI-DADE COUNTY PUBLIC SCHOOLS ANNUAL OPERATING BUDGETS AVAILABLE ON THE MDCPS WEBSITE

State Representative Ralph Arza of District 102 is on the Education Appropriations Committee of the Florida House of Representatives and a history teacher at Miami Senior High School. Representative Arza suggested that it would be beneficial to the citizens of Miami-Dade County if Miami-Dade County Public Schools would make the operating budgets of each school available on the web.

ACTION PROPOSED BY JACQUELINE V. PEPPER: That The School Board of Miami-Dade County, Florida, direct the Superintendent to study the feasibility of making all the Miami-Dade County Public Schools annual operating budgets available on the MDCPS Website and to report back to the Board at its next regularly scheduled meeting.

B-15 INCREASE RANDOM METAL DETECTOR SEARCH PROGRAM

Violent incidents involving firearms and other weapons of violence have been unfortunately too frequent over the past few years. From urban metropolitan areas to suburban locations to peaceful rural settings, our schools have witnessed terrible crimes perpetrated against our teachers and students.

ACTION PROPOSED BY MRS. MANTY SABATES MORSE: That The School Board of Miami Dade County, Florida, direct the Superintendent to increase the metal detector program to include more random checks, as well as explore new methods of prevention.

E-5 APPOINTMENT OF ADMINISTRATIVE ASSISTANTS TO BOARD MEMBERS

Ms. Perla Tabares Hantman, Chair of The School Board of Miami-Dade County, Florida, recommends that Ms. Jeannette Garcia be contractually employed as her Administrative Assistant.

Ms. Jacqueline Pepper, Member of The School Board of Miami-Dade County, Florida, recommends that Ms. Nancy Tobin be contractually employed as her Administrative Assistant.

Dr. Marta Perez, Member of The School Board of Miami-Dade County, Florida,  recommends that Mr. Valentin Alvarez be contractually employed as her Administrative Assistant .

RECOMMENDED: That The School Board of Miami-Dade County, Florida, contractually employ:

  1. Ms. Jeannette Garcia as Administrative Assistant to School Board Chair, Ms. Perla Tabares Hantman, effective April 19, 2001, or as soon thereafter as can be facilitated;

  2. Ms. Nancv Tobin as Administrative Assistant to School Board Member, Ms. Jacqueline Pepper, effective April 19,2001, or as soon thereafter as can be facilitated; and

E-10 RENEWAL OF BOARD’S PROPERTY INSURANCE PROGRAM

At the Board meeting of April 12, 2000, the Board authorized the second year renewal of the current three-year, all risk, replacement cost property insurance program, to be effective May 1, 2000.

RECOMMENDED: That The School Board of Miami-Dade County, Florida authorize Arthur J. Gallagher & Co., Miami, Florida, to secure and bind property insurance coverage, providing up to $700 million of protection in coverage limits, with annual premiums for its catastrophic, all risk, replacement cost coverage not to exceed $13 million, effective May 1, 2001, with payment to be funded its property insurance budget, with a full report, including confirmation of coverages, carriers, deductibles, and terms to be submitted to the Board at its meeting of May 16, 2001.

Subsequent to the April 11, 2001 notification to Mr. Ayube Majeed from the Superintendent of Schools, recommending for dismissal on April 18,2001, because he did not satisfactorily correct identified performance deficiencies during your go-calendar Day Performance Probation. Mr. Majeed has submitted a resignation from the Miami-Dade County Public Schools, effective April 18, 2001.

RECOMMENDED: That effective April 18,2001, at the close of the workday, the School Board of Miami-Dade County, Florida accept the resignation of Mr. Ayube Majeed, Teacher, at Homestead Senior High School.

b) require that Hartford Fire Insurance Company of Hartford, Connecticut take over the project and complete the work.
