The School Board’s negotiators and its exclusive bargaining agents reached Tentative Agreement on Thursday, December 20, 2001 regarding the implementation of the Pay Reduction Plan. All Unions have indicated that the Tentative Agreement will be submitted to its membership for ratification prior to the regularly-scheduled School Board Meeting in January.

G-1 RESOLUTION NO. 01-48; REQUESTING ISSUANCE BY THE STATE -BOARD OF EDUCATION OF FLORIDA OF $1,950,000 OF CAPITAL OUTLAY BONDS FOR AND ON BEHALF OF THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA

The legislature passed House Bill 17A during the special legislative session in November of 1997, requiring districts which receive Classrooms First funds to participate in State Board of Education (SBE) bond sales issued by the State Board of Education of Florida on behalf of Florida school districts.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve Resolution No. 01-48 requesting the State Board of Education of Florida to issue capital outlay bonds on behalf of The School Board of Miami-Dade County for the purpose of financing the cost of capital outlay projects described in section 1 (b) therein.

RECOMMENDED: That the School Board of Miami-Dade County, Florida, authorize the Superintendent to initiate rulemaking proceedings in accordance with the Administrative Procedure Act to amend School Board Rule 6Gxl3-3E-1.22, Food and Nutrition Service.

B-22 PROPOSED AMENDMENT OF BOARD RULE: FINAL READING 6Gx13-6A-1.26, INSTRUCTIONAL MATERIALS AND RESOURCES

The School Board of Miami-Dade County, Florida, announced on December 12, 2001, its intention to amend School Board Rule 6Gx13-6A-1.26, Instructional Materials and Resources, at the meeting of January 16, 2002.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, adopt amended Board Rule 6Gx13-6A-1.26, Instructional Materials and Resources, and authorize the Superintendent to file the rule with The School Board of Miami-Dade County, Florida, to be effective January 16, 2002.

D-2 AUTHORIZATION TO EXECUTE THIRD LEASE AMENDMENT WITH MIAMI SHORES/BARRY UNIVERSITY "CONNECTED LEARNING COMMUNITY" (CLC), INC., FOR THE USE OF SIX BOARD-OWNED PORTABLE CLASSROOMS

Since August 1997, the District has leased six Board-owned portable classrooms to the Miami Shores/Barry University "Connected Learning Community" (CLC), Inc. (Charter School), for use as a temporary facility to operate a charter school program.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent or his designee to execute a third lease amendment with the Miami Shores/Barry University "Connected Learning Community" (CLC), Inc., for the use of six Board-owned portable classrooms, for an additional one-year period commencing July 1, 2002 and ending June 30, 2003, at an annual rental amount of $35,568, and under the terms and conditions set forth above. 

D-4 AUTHORIZATION TO ACCEPT CONVEYANCE OF A VOLUNTARY LAND CONTRIBUTION IN ADDITION TO EDUCATIONAL FACILITIES IMPACT FEES IN CONNECTION WITH APPLICATION NO. 95-534 R.O. LOVELL, RUTH LOVELL AND ROSE LOVELL

In January, 1996, R. 0. Lovell, Ruth Lovell and Rose Lovell, (applicant), requested a zoning change from GU (Interim) to RU-IM(b) (Modified Single-Family), on approximately 80 gross acres located at approximately N.W. 162 Street and N.W. 87 Avenue (please see attached location map).

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to accept conveyance of a 1.7 net acre school site at the northwest corner of N.W. 87th Avenue and N.W. 164" Street, as a voluntary contribution, over and above impact fees, subject to clear title and payment by the School District of real property taxes in the amount of $6,522.32, if a tax exemption for that period cannot be obtained from the Miami-Dade County Tax Collector’s office.

D-27 COMMISSIONING OF BROWN & BROWN ARCHITECTS TO PERFORM ARCHITECTURAL/ENGINEERING SERVICES FOR A NEW PROTOTYPICAL PRIMARY LEARNING CENTER (PLC "Y") AT MARJORY STONEMAN DOUGLAS ELEMENTARY SCHOOL PROJECT # A-0675

Staff has completed the selection process for a Project Architect to perform architectural/engineering services for a new prototypical Primary Learning Center (PLC "Y") at Marjorie Stoneman Douglas Elementary School.

RECOMMENDED: That The School Board of Miami-Dade County, Florida commission the firm of Brown & Brown Architects to perform architectural/engineering services for a new prototypical Primary Learning Center (PLC’Y") at Marjory Stoneman Douglas Elementary School, with an estimated construction cost of $2,380,000 for the following considerations:

D-28 REQUEST FOR AUTHORlZATlON TO ISSUE REQUEST FOR PROPOSALS (RFP) FOR THE SELECTION OF ONE OR MORE FIRM TO PROVIDE COST ESTIMATING SERVICES

Pursuant to Board Rule 6Gx13-3F-1.021, staff has prepared a RFP for Board approval for the selection of one or more consultants for a two-year term.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1)  authorize the Superintendent to issue Request for Proposals (RFP) for the selection of one or more firms to provide cost estimating services for a two-year term; and

D-30 AUTHORlZATlON TO EXECUTE THE ABSOLUTE BILL OF SALE FOR THE CONVEYANCE OF THE WATER AND WASTEWATER FACILITIES AT THE EUGENIA THOMAS/ STATE SCHOOL "A" ELEMENTARY SCHOOL SITE IN FAVOR OF MIAMI-DADE COUNTY

Adequate domestic water and wastewater services for the Eugenia Thomas Elementary School site has been provided for by the installation of water and wastewater lines to the existing Miami-Dade Water and Sewer Department (MDWASD) utility infrastructure.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Chair and Secretary to execute the Absolute Bill of Sale for water and wastewater facilities at the Eugenia Thomas/State School "A" Elementary School site in favor of Miami-Dade County.

D-41 REQUEST FOR AUTHORlZATlON TO ISSUE REQUEST FOR PROPOSALS (RFP) FOR THE SELECTION OF ONE OR MORE FIRMS TO PROVIDE GEOTECHNlCAL/CONSTRUCTlON MATERlALS TESTING AND ENVIRONMENTAL ASSESSMENT SERVICES

Pursuant to Board Rule 6Gx13-3F-1.021, staff has prepared a RFP for Board approval for the selection of one or more consultants for a two-year term.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1)  authorize the Superintendent to issue a Request for Proposals (RFP) for the selection of one or more firms to provide geotechnical, construction materials testing and environmental assessment services for a two-year term; and

E-2 APPOINTMENTS AND LATERAL ASSIGNMENTS OF MANAGERIAL EXEMPT, PROFESSIONAL, AND TECHNICAL PERSONNEL FOR 2001-2002

The following recommendations are made in accordance with Board Rules 6Gx-13-4A-1.16, 6Gx13-4A-1.161, and the Miami-Dade County Public Schools/Dade County School Administrators’ Association labor contract.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the recommendations as set forth above for appointments and lateral transfers, to be effective January 17, 2002, or as soon thereafter as can be facilitated.

E-4 ACCEPTANCE OF RESIGNATION

On December 20, 2001, the Superintendent of Schools notified Mr. James W. Austin, that he would be recommended for dismissal on January 16, 2002, for just cause, including, but not limited to: deficient performance of job responsibilities; immorality; conviction of a crime of moral turpitude, upon such conviction; violation of School Board Rules 6Gx13-4-1.09, Employee-Student Relationships; and 6Gx13-4A-1.21, Responsibilities and Duties. Subsequent to that notification, Mr. Austin submitted a resignation from the Miami-Dade County Public Schools, effective January 11, 2002.

RECOMMENDED: That effective January 16, 2002, at the close of the workday, the School Board of Miami-Dade County, Florida accept the resignation of Mr. James W. Austin, Custodian, at Barbara Hawkins Elementary School.

E-5 ACCEPTANCE OF RESIGNATION

Subsequent to the January 16, 2002, notification to Mr. Christopher L. James, from the Superintendent of Schools, that he would be recommended for dismissal on January 16, 2002, for just cause, including, but not limited to: violation of School Board Rules 6Gx13-4-1.09, Employee-Student Relationships; 6Gx13-4A-1.21, Responsibilities and Duties; and violation of the Code of Ethics and the Principles of Professional Conduct of the Education Profession in Florida (State Board Rule 6B-1.001), Mr. James has submitted a resignation from the Miami-Dade County Public Schools, effective January 9, 2002.

RECOMMENDED: That effective January 16, 2002, at the close of the workday, the School Board of Miami-Dade County, Florida accept the resignation of Mr. Christopher L. James, Security Monitor, at Biscayne Gardens Elementary School.

E-9 DISMISSAL OF EMPLOYEE
ROBERT C. SEITZ - COMPUTER SPECIALIST
NORTH MIAMI SENIOR HIGH SCHOOL

On January 8, 2002, the Superintendent of Schools sent the following letter to Mr. Robert C. Seitz:

I am exercising my responsibility as Superintendent of Schools and recommending to The School Board of Miami-Dade County, Florida, at its scheduled meeting of January 16, 2002, that the School Board suspend you and initiate dismissal proceedings against you from your current position as Computer Specialist, at North Miami Senior High School, effective at the close of the workday, January 16, 2002, for just cause, including, but not limited to: excessive absenteeism; violation of School Board Rules 6Gx13-4A-1.21, Responsibilities and Duties; 6Gx13-4E-1.01, Absences and Leaves; conviction of a crime involving moral turpitude; and conduct unbecoming a School Board employee.

RECOMMENDED: That effective January 16, 2002, at the close of the workday, the School Board suspend and initiate dismissal proceedings against Mr. Robert C. Seitz, Computer Specialist, at North Miami Senior High School, pending the outcome of a hearing, if requested.

F-1 REQUEST FOR AUTHORIZATION TO ENTER INTO A COOPERATIVE AGREEMENT WITH MIAMI-DADE COUNTY, HEAD START DIVISION OF THE COMMUNITY ACTION AGENCY, TO OPERATE FOUR PREKINDERGARTEN PROGRAMS FOR STUDENTS ELIGIBLE FOR TITLE I SERVICES; PROJECT CYCLE: JULY 1, 2001 THROUGH JUNE 30,2002

Authorization is being requested for the Superintendent to enter into a cooperative agreement with Miami-Dade County, on behalf of the Community Action Agency for the Head Start Program to implement prekindergarten programs, in conjunction with the Miami-Dade County Public Schools (M-DCPS) Title I program.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into a cooperative agreement with Miami-Dade County, Head Start Division of the Community Action Agency, to operate four prekindergarten programs for students eligible for Title I services, effective as of July 1, 2001 through June 30, 2002. The appropriation for this cooperative agreement is included in the 2001-2002 Title I budget under Program 4905.

The purpose of this bid, opened on September 14, 2000, was to establish a contract, to purchase, at firm unit prices, quantities, as may be required, of milkshakes, ice cream, ice milk products and fruit juice bars, for use in the Food Service Program of the Department of Food and Nutrition. The terms of agreement, as contained in the subject bid, awarded by the Board on December 13, 2000, provided, that by mutual agreement between the successful vendors and The School Board of Miami-Dade County, Florida, the contract may be renewed for two (2) additional one (1) year periods. The contract is currently in its initial year.

The purpose of this bid, opened on November 27, 2001, is to establish a contract, at a firm price, to replace the existing combination supply/exhaust fan in the kitchen at Redland Middle School, for Maintenance Operations. Of 16 vendors sent bid forms or card notices of this advertised bid, 2 responded, with 1 bid meeting specifications and 1 no bid.

MARTA PÉREZ: That The School Board of Miami-Dade County, Florida, direct the Superintendent to review Board Rule 6Gx13-5D-1.08 - Maintenance of Appropriate Student Behavior and the Secondary Level - Code of Student Conduct, and revise the rule to allow possession & use of cellular phones in selected areas outside of school buildings, during non-school hours as designated by school principals.

The belief that there is still much to do to eradicate the legacy of three centuries of racial oppression is what encourages Dr. Nontombi Naomi Tutu to continue to speak out all over the world to diverse groups about apartheid and the continuing struggle in South Africa.

J-9 REQUEST FOR APPROVAL OF RESOLUTION NO. 02-03 OF THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, HONORING DR. NONTOMBI NAOMI TUTU FOR HER OUTSTANDING LEADERSHIP AND HUMANITARIAN EFFORTS

The belief that there is still much to do to eradicate the legacy of three centuries of racial oppression is what encourages Dr. Nontombi Naomi Tutu to continue to speak out all over the world to diverse groups about apartheid and the continuing struggle in South Africa.  Apart from lecturing, Naomi, daughter of South African Nobel Peace Prize winner Archbishop Desmond Tutu founded and chaired the Tutu Foundation which helped South African refugees and awarded them scholarships so that they could learn skills that would make them self-supporting while in exile as well as prepare them for constructive roles in the free South Africa.

ACTION PROPOSED BY DR. ROBERT B. INGRAM:  That The School Board of Miami-Dade County, Florida, approve Resolution No. 02-03 of The School Board of Miami-Dade County, Florida, honoring Dr. Nontombi Naomi Tutu for her outstanding leadership and humanitarian efforts.
