RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to initiate rulemaking proceedings in accordance with the Administrative Procedure Act to amend Board Rule 6Gx13-7B-l.02, Architectural, Engineering, and Inspection Services-Authority of Superintendent of Schools to Employ, and the document, Procedures for the Selection of Technical Review Services Consultant and Uniform Building Code Inspector, which is incorporated by reference and part of this rule.

C-12 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO A CONTRACTUAL AGREEMENT WITH THE MIAMI-DADE COUNTY CORRECTIONS AND REHABILITATION DEPARTMENT TO PROVIDE EDUCATION AND TRAINING TO INCARCERATED STUDENTS IN THE ADULT EDUCATION PROGRAM, IN AN AMOUNT NOT TO EXCEED $400,000, FROM OCTOBER 1, 2001 TO SEPTEMBER 30, 2002

Authorization is requested for the Superintendent to enter into a contractual agreement with the Miami-Dade County Corrections and Rehabilitation Department, to provide training and educational services to incarcerated students in the adult education program, from October 1, 2001 to September 30, 2002.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1.  enter into a contractual agreement with the Miami-Dade County Corrections and Rehabilitation Department, from October 1, 200l to September 30, 2002;

2.  provide education and training to inmates of correctional facilities; and

3.  receive payments for these services in an amount not to exceed $400,000.

D-2 AUTHORIZATION TO EXECUTE LEASE AGREEMENTS WITH MIAMI-DADE COUNTY FOR VACANT BOARD-OWNED LAND FOR PARK PURPOSES (WILD LIME PARK), AND DR. MICHAEL M. KROP SENIOR HIGH SCHOOL AND HERBERT A. AMMONS MIDDLE SCHOOL FOR USE OF COUNTY-OWNED LAND FOR DISTRICT RECREATIONAL PURPOSES

At its meeting of June 4, 1997, the Board authorized the execution of a Joint Operating Agreement with Miami-Dade County (County), to allow the use of six acres of vacant Board-owned land for public park purposes The Board-owned land is located adjacent to 5.86 acres of County-owned land, and the combined 11.86 acre parcel is used as Wild Lime Park (see location map). The Board-owned land falls within a statutorily mandated airport restrictive zone, and the District is currently unable to develop the site as a school.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1.  authorize the Superintendent or his designee to execute a lease agreement with Miami-Dade County for use of vacant Board-owned land located at S.W. 147 Avenue and South Hammocks Boulevard (adjacent to Wild Lime Park), at an annual rental rate of $1, and under the terms and conditions set forth above, and cancel the Joint Operating Agreement with Miami-Dade County effective with the commencement date of the new lease: and

2.  authorize the Superintendent or his designee to execute lease agreements with Miami-Dade County for the use of County-owned land adjacent to Dr. Michael M. Krop Senior High School (Ives Estates District Park) and Herbert A. Ammons Middle School (Eureka Villas Park), each at an annual rental rate of $1, and under the terms and conditions set forth above, and cancel the Joint Operating Agreements with Miami-Dade County effective with the commencement date of the new leases.

D-30 AUTHORIZATION TO EXECUTE THE ABSOLUTE BILL OF SALE FOR THE CONVEYANCE OF WASTEWATER FACILITIES AT THE CUTLER RIDGE MIDDLE SCHOOL SITE IN FAVOR OF MIAMI-DADE COUNTY

Wastewater services for the Cutler Ridge Middle School site have been provided a by the installation of a wastewater line to the existing Miami-Dade Water and Sewer Department (MDWASD) utility infrastructure.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Chair and Secretary to execute the Absolute Bill of Sale for wastewater facilities at the Cutler Ridge Middle School site in favor of Miami-Dade County.

D-31 AGREEMENT BETWEEN MIAMI-DADE COUNTY AND THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, FOR THE CONSTRUCTION OF WATER AND WASTEWATER FACILITIES TO SERVICE THE ROBERT MORGAN TECHNICAL EDUCATIONAL CENTER SITE (STATE SCHOOL "HHH").

In order to provide potable water, irrigation, additional fire protection and wastewater services to the Robert Morgan Technical Educational Center site, the Board must install and connect a water transmission main, ten fire hydrants, a gravity sewer and force main, private pump station and other appurtenances to the existing Miami-Dade County (County) infrastructure (see location map).

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent or his designee to execute an agreement with Miami-Dade County and the execution of relevant conveyance documents for the provision of water and wastewater services for planned improvements at the Robert Morgan Technical Educational Center Site, at an approximate cost of $ 388,920 which is included in the construction contract.

E-2 APPOINTMENTS AND LATERAL ASSIGNMENTS OF MANAGERIAL EXEMPT, PROFESSIONAL, AND TECHNICAL PERSONNEL FOR 2001-2002

The following recommendations are made in accordance with Board Rules 6Gx13-4A-1.16, 6Gx13-4A-1.161, and the Miami-Dade County Public Schools/Dade County School Administrators’ Association labor contract.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the recommendations as set forth above for appointments and lateral transfers, to be effective September 13, 2001, or as soon thereafter as can be facilitated.

G-11 APPROVAL OF ANNUAL FINANCIAL REPORT FOR 2000-2001

State Board of Education Administrative Rule 6A-l-0071(2), requires School Board approval of the Annual Financial before submittal to the Florida Department of Education.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1.  approve the Annual Financial Report for 2000-2001; and

2.  authorize the Superintendent to submit the approved report to the Florida Department of Education.

G-21 REQUEST FOR AUTHORIZATION TO ISSUE A REQUEST FOR PROPOSAL FOR THE PROVISION OF FINANCIAL ADVISORY SERVICES

The existing contract with DeLara Associates as Financial Advisor to Miami-Dade County Public Schools will expire on November 19, 200l. The Request for Proposal for the provision of these services for a term of three years, with a possible three-year extension, has been reviewed by appropriate staff and is attached hereto (Exhibit A).

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

a)  approve the Request for Proposal for selection of Financial Advisor presented as Exhibit A;

b)  approve the Selection Committee presented as Exhibit B;

c)  authorize the Superintendent to advertise and distribute a Request for Proposal for Financial Advisory Services; and,

d)  authorize the Chair to appoint a School Board member to participate in the Selection Committee.

e)  authorize the Chair to appoint a member of the Investment Advisory Committee to participate in the Selection Committee.

G-22 REQUEST FOR AUTHORIZATION TO ISSUE A REQUEST FOR PROPOSAL FOR UNDERWRITERS FOR GENERAL OBLIGATION BONDS (GOB’s) AND CERTIFICATES OF PARTICIPATION (COP’s) 

The recent lowering of interest rates is resulting in interest levels at which outstanding GOB’s and COP’s may soon be refunded for an aggregate savings of $4,000,000.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

a)  approve the Request for Proposal for GOB’s and COP’s Refundings presented as Exhibit A;

b)  approve the Selection Committee presented as Exhibit B;

c)  authorize the Superintendent to advertise as presented in Exhibit C and distribute the Request for Proposal for GOB’s and COP’s Refundings; and,

d)  authorize the Chair to appoint a School Board member to participate in the Selection Committee for the selection and recommendation process.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, AWARD Bid No. 105-AA03 - BAKERY ITEMS, to purchase, at firm unit prices, quantities, as may be required, of various bakery items, for use in the Food Service Program of the Department of Food and Nutrition, during the term of the bid, effective November 20, 2001, through November 30, 2003, as follows:

A-1 AMENDMENT TO THE 2000-2003 LABOR CONTRACT BETWEEN THE MIAMI-DADE COUNTY PUBLIC SCHOOLS AND THE UNITED TEACHERS OF DADE

Pursuant to the provisions of the labor contract between The Miami-Dade County Public Schools and The United Teachers of Dade, the parties commenced reopener negotiations on June 7, 200l and concluded on August 30, 200l with Tentative Agreement being reached on all open economic and non-economic issues.

RECOMMENDED: That The School Board of Miami-Dade County, Florida ratify the Amendment to the labor contract with the United Teachers of Dade, effective July 1, 2001 through June 30, 2002.

A-3  1.  AUTHORIZE THE 2001-2002 SALARY SCHEDULE FOR ADMINISTRATIVE ASSISTANT TO SCHOOL BOARD MEMBERS

B-1 SETTLEMENT OF THE FEDERAL COURT MATTER OF: HELENA BENITEZ v. THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FL UNITED STATES DISTRICT COURT CASE NO.: 00-02201-Civ-MOORE

This lawsuit was filed by the Plaintiff in the United States District Court for the Southern District of Florida on June 20, 2000, alleging sexual harassment and retaliation.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into the settlement agreement in the case of Helena Benitez v. The School Board of Miami-Dade County, Florida, U.S.D.C. Case No.: 00-02201-Civ-Moore, for the sum of $30,000.00. The settlement will release the School Board from all claims including damages, attorneys’ fees and costs.

B-22 PROPOSED AMENDMENT OF SCHOOL BOARD RULE: INITIAL READING 6Gx13- 2C-1.14, DEPARTMENT OF MANAGEMENT AUDITS, STATEMENT OF POLICIES AND PROCEDURES

At the School Board meeting of May 16, 2001, the School Board authorized the School Board Attorney to amend the subject rule in order to specify the reporting line of the Department of Management Audits so as to comport with Florida Law.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to initiate rulemaking proceedings in accordance with the Administrative Procedure Act to amend School Board Rule 6Gx13-2C-1.14, Department of Management Audits, Statement of Policies and Procedures.

B-23 PROPOSED AMENDMENT OF SCHOOL BOARD RULE: INITIAL READING 6GX13-w-1.17, CITIZEN APPEARANCES--BOARD MEETINGS

At its meeting of August 22, 2001, the Board directed the Superintendent to amend this rule for consent to be granted by the Board for a person to address the Board who is not scheduled in advance to speak on a non-agenda topic upon a two-thirds (2/3) majority vote.

ACTION PROPOSED BY FRANK J. COBO: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to initiate rulemaking proceedings in accordance with the Administrative Procedure Act to amend School Board Rule 6Gx13-8C-1.17, Citizen Appearances--Board Meetings.

D-1 AUTHORIZATION TO EXECUTE A JOINT USE AGREEMENT WITH THE CITY OF MIAMI BEACH FOR BISCAYNE ELEMENTARY SCHOOL AND DEVELOP AND EXECUTE A TEMPORARY USE AGREEMENT WITH THE CITY OF MIAMI BEACH FOR TEMPORARY USE OF THE SERVICE ROAD AT MIAMI BEACH SENIOR HIGH SCHOOL

Since 1972, the School Board (Board) and the City of Miami Beach (City) have jointly owned a parcel of real property (Land) located adjacent to Biscayne Elementary School (School).

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1authorize the Superintendent or his designee to execute a Joint Use Agreement with the City of Miami Beach for Biscayne Elementary School, under the terms and conditions set forth above; and

E-14 ACCEPTANCE OF RESIGNATION

At the September 6, 2001 meeting held in the Office of Professional Standards prior to Board Action, Mr. Vaughn R. Marshall, through his Bargaining Agent Representative, was advised that the Superintendent of Schools would be recommending dismissal on September 12, 2001, for: immorality; misconduct in office; incompetency; gross insubordination; and willful neglect of duty. Mr. Marshall submitted a resignation from the Miami-Dade County Public Schools, effective September 7, 2001.

RECOMMENDED: That effective September 7, 2001, at the close of the workday, the School Board of Miami-Dade County, Florida accept the resignation of Vaughn R. Marshall, Teacher, Alternative Outreach Education.

E-15  1.  AUTHORIZE THE 2001-2002 SALARY SCHEDULE IO
2.  AUTHORIZE SALARY INCREASE

Salary Schedule IO consists of several positions which are not included in the 2001-2002 salary improvements previously authorized by the Board. Included are part-time, substitute and hourly positions that are not in any bargaining unit.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, effective October 12, 200l.

1. authorize the recommended 2001-2002 Salary Schedule IO; and

2.. authorize incumbents to receive a 3.0% increase in salary.

G-2 ADOPTION OF FIVE-YEAR FACILITIES WORK PROGRAM REQUIRED BY S.235.185, FLORIDA STATUTES

During the October 1997 Special Session, the Florida Legislature created section 235.185, Florida Statutes, which requires each district to adopt a five-year facilities work program. The format of the work program has been prescribed by the Smart Schools Clearinghouse, which was also established by the Legislature.

RECOMMENDED: That The School Board of Miami-Dade County, Florida adopt the Five-Year Facilities Work Program as required by s.235.185, Florida Statutes.

G-3 FINAL ADOPTION OF THE 2001-02 BUDGET

On July 23, 2001, the Board tentatively adopted the 2001-02 budget following the first public hearing on the budget prescribed by Chapter 200, Florida Statutes. That tentative adopted budget included proposed millage rates, projected revenues and recommended appropriations for 2001-02 for the General Fund, Debt Service Funds, Capital Outlay Funds, Special Revenue Funds and Trust & Agency Funds.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, adopt the 2001-02 Annual Budget by approving changes from the Tentative Adopted Budget enumerated on pages 2 through 23 and the revenues and appropriations delineated on the official state budget forms and including any amendments approved by the Board following the public hearing on September 12, 2001.

G-4 RESOLUTION NO. 3, 2000-01 GENERAL FUND FINAL BUDGET REVIEW

The Office of Budget Management has completed its review of actual receipts and expenditures through June 30, 2001, and updated entitlement notices from the Department of Education. Based on that review, the following changes to the budget are recommended for approval.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

a)  Adopt Resolution No. 3, 2000-01 General Fund Final Budget Review;

b)  Adopt the Summary of Revenues & Appropriations (page 4) and the Summary of Appropriations by Function (page 10).

G-5 RESOLUTION NO. 2,2000-01 DEBT SERVICE FUNDS FINAL BUDGET REVIEW

G-6 RESOLUTION NO. 2, 2000-01 CAPITAL OUTLAY BUDGET FUNDS FINAL BUDGET REVIEW 

This Capital Outlay Resolution will recognize new revenues, changes to appropriations, and various changes among object codes since Resolution No.1.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1.  Approve Resolution No. 2, 2000-01 Capital Outlay Budget Funds Final Budget Review, (a) recognizing new revenues and other sources, (b) amending appropriations, and (c) documenting changes in object codes, as described above and summarized on page 5 of 5.

2.  Authorize changes to the Five-Year Facilities Work Program which result from Resolution No. 2, 2000-01 Capital Outlay Funds Final Budget Review.

G-7 RESOLUTION NO. 3, 2000-01 CONTRACTED PROGRAMS FUNDS FINAL BUDGET REVIEW

The Special Revenue Funds include the Contracted Programs Fund and the School Food Service Fund. The purpose of this resolution is to make various technical budgeted amendments to the Contracted Programs Fund budget which are required to fully comply with grant terms and/or good accounting practices, as follows:

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

a.  adopt resolution No. 3, 2000-01 Contracted Programs Fund Final Budget Review, increasing revenues and appropriations by $20,113,084;

b.  adopt the Summary of Revenues and Appropriations (page 2) and the Summary of Appropriations by Function (page 4).

G-8 RESOLUTION NO. 1, 2000-01 FOOD SERVICE FUND FINAL BUDGET REVIEW

The Office of Budget Management and the Office of the Controller have completed a review of food service operations through June 30, 2001.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve Resolution No. 1, 2000-01 Food Service Fund Final Budget Review, increasing appropriations by $1,207,471 and increase ending fund balance by $881,448.

G-61 AWARD REQUEST FOR PROPOSALS NO. 003-BB10 - APPLICANT -OUTSIDE AGENCIES QUALIFIED TO OPERATE ALTERNATIVE PROGRAMS FOR M-DCPS AT-RISK STUDENTS

The purpose of this Request For Proposals, opened on September 4, 2001, is to establish a partnership, with a qualified agency, to seek a grant award available under Appropriations 131-A, to provide educational services for students in at-risk alternative education programs, for the Bureau of Adult/Vocational, Alternative and Dropout Prevention Programs.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1.  ACCEPT Community Education Partners, Inc., as a partner to apply for grant funds provided under Appropriation 131-A, in response to Request For Proposals No. 003-BB10;

2.  AUTHORIZE the Superintendent to apply for grant funds available under Appropriation 131-A, in partnership with Community Education Partners, Inc.;

The purpose of this Request For Proposals, opened on July 31, 2001, is to establish a contract, at a firm price, to operate applied technology (vocational education) programs for low-income adults and/or incarcerated youth, for the Bureau of Adult/Vocational, Alternative and Dropout Prevention Programs.

K-7 THAT THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA PARTICIPATE IN THE 2002 FAST TRACK INITIAL MASTER BOARD PROGRAM OFFERED BY THE FLORIDA SCHOOL BOARDS ASSOCIATION 

This year, the Florida legislature passed the "2001 Sharpening The Pencil Act" (HB 269) to improve school district management and use of resources, and identify cost savings. The legislation requires all Florida school districts to undergo a Best Financial Management Practices Review once every five years. Miami-Dade County was selected to undergo the review this year.

ACTION PROPOSED BY DR. MARTA PÉREZ: That The School Board of Miami-Dade County, Florida, participate in the 2002 Fast Track initial Master Board Program offered by the Florida School Boards Association.

This year, the Florida legislature passed the "2001 Sharpening The Pencil Act" with the goal of improving student achievement and increasing school district accountability. As part of this legislation, a 2-year "best practices" review cycle, conducted by the Office of Program Policy Analysis and Government Accountability (OPPAGA), was scheduled.  Miami-Dade County Public Schools was chosen as the first recipient of this review.

ACTION PROPOSED BY DR. MARTA PÉREZ: That The School Board of Miami-Dade County, Florida, participate in the 2002 Fast Track Initial Master Board Program offered by the Florida School Boards Association.
