Purpose

The purpose of the proposed Board Rule is to establish a formal process for submission of proposals for telecommunications facilities on Board-Owned sites. In the past, the School Board (Board) approved lease agreements for wireless telecommunications towers (towers) and granted easements for controlled environment vaults (CEVs) and fiber optic cabinets (FOCs) with various telecommunications service providers (service
providers), on an as requested basis.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to initiate rulemaking proceedings in accordance with the Administrative Procedures Act to promulgate new School Board Rule
6Gx13-2C-1.121, Submission of Proposals for Telecommunications Facilities on Board-Owned sites.

D-4 REVIEW AND AMEND BOARD RULE 6Gx13-6A-1.47, CHARTER SCHOOLS (K-12), TO REFLECT NEW STRATEGIC OBJECTIVES AND CHANGES IN FLORIDA STATUTE

Miami-Dade County Public Schools (M-DCPS) has concluded its successful 2001 United Way campaign, with total contributions reaching $3,124,978, which is $422,721 more than was raised in the year 2000.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, receive the Miami-Dade Countv Public Schools 2001 United Way Campaign Final Report, presented by the Bureau of Community Services.

The Miami-Dade County School Board has had a tradition of developing and forwarding its own legislative program in the legislative process.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1) enter into a contractual agreement with Florida School Services Inc. begjnning July 1, 2002 through October 31, 2002 at a -cost not to exceed $40,000 or $10,000 per month: and

The purpose of this bid, opened on April 30, 2002, is to establish a contract, to furnish and install a complete uninterruptible power supply system, including all materials, labor and equipment for WLRN. A recommendation will be presented to the Board prior to its meeting of May 15, 2002.

The School Board approved the charter school application submitted for North Dade Community Charter School by Chancellor Beacon Academies, on December 12, 2001, and authorized the Superintendent to negotiate a charter school contractual agreement for a term of ten (10) years beginning with the 2002-2003 school year.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve: 

1. the amended application for North Dade Community Charter School application; and

B-21 REQUEST FOR APPROVAL OF AN ECONOMY OF SCALE MODEL FOR FUTURE CHARTER SCHOOLS REQUESTING A REDUCTION OF THE 5% STATUTORILY-PERMITTED ADMINISTRATIVE FEE

Pursuant to Section 228.056 (14)(e) Florida Statutes, the School District may impose a maximum 5% administrative fee to charter schools for certain administrative and educational services that minimally include: contract management services, FTE and data reporting, exceptional student education administration, test administration, processing of
teacher certificate data, and information services. In addition, the District also monitors all charter schools to ensure full compliance with statutory and contractual requirements.

RECOMMENDED:
That The School Board of Miami-Dade County, Florida, approve an economy of scale model for future charter schools requesting a reduction of the 5% statutorily-permitted administrative fee in exchange for compliance with the five required conditions and stated levels of capacity as reflected below:

B-67 REQUEST FOR AUTHORIZATION TO ACCEPT A GRANT AWARD FROM THE FLORIDA DEPARTMENT OF EDUCATION FOR FUNDING UNDER THE FLORIDA MENTOR TEACHER SCHOOL PILOT PROGRAM AND ENTER INTO A CONTRACTUAL AGREEMENT WITH RYDER ELEMENTARY CHARTER SCHOOL TO IMPLEMENT THE FLORIDA MENTOR TEACHER SCHOOL PILOT PROGRAM, PROJECT CYCLE: JULY 1, 2001 THROUGH JUNE 30, 2002

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. accept a grant award from the Florida Department of Education, in the amount of $142,500, for funding under the Florida Mentor Teacher School Pilot Program and enter into a contractual agreement with Ryder Elementary Charter School, in the amount of $142,500, to implement the Florida Mentor Teacher School Pilot Program, Project Cycle: July 1, 2001 through June 30, 2002. This grant award is accepted in accordance with Florida Statutes 228.056, Charter Schools. This action is not an endorsement of the activities undertaken by charter schools;

B-68 REQUEST FOR AUTHORIZATION TO RENEW A CONTRACTUAL AGREEMENT WITH MIAMI-DADE COUNTY TO CONTINUE PROVIDING COUNTYWIDE EDUCATIONAL CABLE TELEVISION SERVICES AND ACCEPT A GRANT AWARD FROM MIAMI-DADE COUNTY TO UPGRADE EQUIPMENT, PROJECT CYCLE: OCTOBER 1, 2001 THROUGH SEPTEMBER 30, 2002

In 1983, the Miami-Dade County School Board and Miami-Dade County government entered into a contractual agreement to use WLRN-TV Channel 17 production facilities and personnel to provide technical and programming support to an educational cable television service project.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. renew a contractual agreement with Miami-Dade County Government, in the amount of $522,000, to continue providing countywide educational cable television services; Project Cycle: October 1, 2001 through September 30, 2002;

C-23 PROPOSED AMENDMENT OF SCHOOL BOARD RULE: INITIAL READING 6Gx13-4A-1.12, ASSIGNMENT, TRANSFER, AND APPOINTMENT

Board Rule 6Gx13-4A-1.12, Assignment, Transfer, and Appointment, sets forth policy and procedures for appointment and assignment of School Board employees, citing as authority federal court orders on desegregation. On June 21, 2001, Judge William P. Dimitrouleas, United States District Court for the Southern District of Florida, granted unitary status to Miami-Dade County Public Schools, effective June 30, 2002. Consequently, this rule requires revisions to delete the reliance on desegregation orders. The revision is reflected on the proposed amended rule.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to initiate - rulemaking proceedings in accordance with the Administrative Procedure Act to amend School Board Rule 6Gx13-4A-1.12, Assignment, Transfer, and Appointment.

C-26 PROPOSED AMENDMENT OF SCHOOL BOARD RULE: INITIAL READING 6Gx13-2C-1.083, EDUCATIONAL FACILITIES PLANNING, SITE SELECTION AND ACQUISITION, AND CONSTRUCTION

E-24 AUTHORITY TO AMEND THE CAPITAL CONSTRUCTION BUDGET

The capital construction budget is being amended to provide additional funding for completion of ongoing projects, to closeout accounts and to transfer unused amounts to central reserves to provide contingencies for future use. Due to extensive termite damage discovered in a project in progress, funding was included for North Beach Elementary window replacement.

RECOMMENDED: That The School Board of Miami-Dade County, Florida: (1) authorize staff to adjust the capital budget as detailed above, and in the event there are, at the time of transfer, insufficient available funds in a structure from which to transfer the indicated amount, the difference will be provided from Central Contingencies, reserves or other accounts; arid (2) authorize staff to make the changes to the five year facilities work program resulting from these budget adjustments.

1) extend the existing agreement, due to expire on June 20, 2002, with MIA Consultants until a new consultant(s) is commissioned, for a maximum period of ninety (90) days, with no increase in the not-to-exceed fee established in the agreement;

School Board Rule 6Gx13-8C-1.21 - Lobbyist - defines lobbying and establishes a registration requirement as a prerequisite to lobbying. As currently stated, there is no requirement for lobbyists to report expenditures in connection with lobbying and there is no explicit ban on charging contingency fees. Many state and local governments and school districts have more comprehensive policies regulating lobbyist activities.

A-6 THAT THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, DIRECT THE SCHOOL BOARD ATTORNEY TO RECOMMEND LANGUAGE RESTRICTING BUSINESS RELATIONSHIPS BETWEEN FORMER M-DCPS SENIOR EXECUTIVES AND THE SCHOOL DISTRICT

Currently, School Board Rule 6Gx13-8A1.041 - Conflict of Interest - restricts business relationships between School Board members and the school district upon the vacating of their position. Section II, subsection F, states that:

RECOMMENDATION: That The School Board of Miami-Dade County, Florida, direct the School Board Attorney to recommend language restricting business relationships between former M-DCPS senior executives and the school district.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the execution of the Contract of Purchase and Sale to sell the property known as Sandman Nursery to Rebuilding Our Community Inc., for $850,000.00, in connection with the subject litigation.

School Board rule 6Gx13-5A-1.081, Opportunity Scholarship Program Student Transfers, outlines the policy and procedures when a public school students parent or guardian request and receive an Opportunity Scholarship Program transfer, in accordance with Section 229.0537, Florida Statutes.

The formation of the Republic of Cuba on May 20, 1902 formally recognized the independence of that island nation after thirty years of political and armed struggle.

G-2 RESOLUTION NO. 2, 2001.02 CAPITAL OUTLAY FUNDS SPRING BUDGET REVIEW

This Capital Outlay Resolution recognizes new revenues, changes to appropriations,
and various changes in object codes made since Resolution No. 1.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. Approve Resolution No. 2, 2001-02 Capital Outlay Funds Spring Budget Review, (a) recognizing new revenues and other sources, (b) amending appropriations, (c) authorizing staff to adjust the capital budget as detailed above, and in the event there are, at the time of transfer, insufficient available funds in a structure from which to transfer the indicated amount, the difference will be provided from Central Contingencies and (d) documenting changes in object codes, as described above and summarized on
page 6 of 7.

G-48 RENEWAL OF BOARD’S COMPREHENSIVE FIDELITY BONDS AND RELATED
COVERAGES


At the Board meeting of March 13, 2002, the Board authorized the Superintendent to enter into negotiations for renewal of its current comprehensive fidelity bond and related coverages program, through Arthur J. Gallagher & Co., pursuant to the authority granted in State Board Rule 6A-1.012(1I), whereby the Board is authorized to directly negotiate and enter into contracts for insurance, risk management programs, or third party administrators. The procurement of fidelity bonds for school board employees is required, pursuant to the provisions of Section 230.23 (IO)(h). The current program expires May 31, 2002.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. authorize purchase of its Public Official Blanket Bond coverage, covering all employees, except those covered by the Public Official Position Bond coverage, subject to a $50,000 per occurrence deductible, with limits of $25 million per occurrence, with an annual premium of $100,524, to Zurich/Fidelity and Deposit Insurance Company (A.M. Best A+ XV), through Arthur J. Gallagher & Co., for a three-year term, effective June 1, 2002, with premiums for the second and third years (June 1, 2003 - June 1, 2004, and June 1, 2004 - June 1, 2005) to remain at the same annual premium of $100,524, subject to terms and conditions as provided in their quotation:

G-49 RENEWAL OF BOARD’S PROPERTY INSURANCE PROGRAM

At the Board meeting of March 13,2002, the Board authorized Arthur J. Gallagher & Co. to secure and bind maximum available limits of property insurance coverage, with annual premiums for catastrophic, all risk, replacement cost coverage not to exceed $15 million, effective May 1, 2002.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. confirm renewal of its excess all risk, replacement cost property insurance program, through Arthur J. Gallagher & Co., effective May 1, 2002 to May 1, 2003, for total insurance limits of $120,000,000 per occurrence with the following insurance companies and annual premiums:

G-102 RENEW BALANCE IBID NO. 078-AA03 - VENDING MACHINE SERVICE - ACCESS FEE BASED

The purpose of this bid, opened on January 11, 2001, was to establish a contract, at a firm annual access fee per senior high school location, paid to Miami-Dade County Public Schools, to provide vending machine service at thirty-five (35) senior high and vocational schools.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, RENEW BALANCE Bid No. 078-AA03 - VENDING MACHINE SERVICE -ACCESS FEE BASED, to establish a contract, at a firm annual access fee per senior high school location, paid to Miami-Dade County Public Schools, to provide vending machine service at

G-106 AWARD BID NO. 079-8605 - FM, DTV TRANSMITTERS, SYSTEMS EQUIPMENT, FURNISH AND INSTALL (TURNKEY)

The purpose of this bid, opened on April 30, 2002, is to establish a contract, to furnish and install, FM and DTV transmitters, and all systems equipment, including all necessary labor, material and equipment, for the Anna Brenner Meyers Educational WLRN Channel 17 transmission tower.
