Pursuant to Board Rule 6Gx13-8C-1.17, a person not scheduled in advance to speak on a non-agenda topic must submit a written request to the Superintendent of Schools not later than 10:00 a.m. on the day of a regular Wednesday Board Meeting. The request must state the person’s name, address, subject and reason for asking emergency handling of the request, reason demonstrating good cause why the 4:30 p.m. Monday deadline was not met, and Board action requested. Board members present at the meeting must vote by a two-thirds (2/3) majority, for the person to be heard.

Speakers List / Supplemental List will generally be posted on Tuesday PM or Wednesday AM prior to the meeting.

The School Board of Miami-Dade County, Florida, seeks public input and participation. However, the public purpose is not served when citizens become disorderly or disrupt the meeting. Accordingly, the Chair may order the removal from any School Board meeting of any person interfering with the expeditious or orderly process of the meeting provided the Chair has first issued a warning that continued interference with the orderly processes of the meeting will result in removal. §230.173, Fla. 1. authorize the Superintendent to issue a Request for Proposals to select one or more professional mental health agency(ies) to provide weekly group and/or individual counseling to limited English proficient and immigrant students and their families who have been affected by traumatic experiences; and

2. approve the establishment of a selection committee to evaluate proposals submitted.

B-2 REQUEST FOR SCHOOL BOARD APPROVAL OF THE CHARTER SCHOOL CONTRACTUAL AGREEMENT WITH SWEET HOME COMMUNITY BUILDERS, INC., ON BEHALF OF SWEET HOME CHARTER SCHOOL

RECOMMENDED: Recognizing that The School Board of Miami-Dade County, Florida, has previously approved this application, it is recommended that the Board grant approval of the:

1. proposed site; and

2. charter school contractual agreement with Sweet Home Community Builders, Inc., on behalf of Sweet Home Charter School, for a term of ten years, commencing with the 2003-2004 school year.

B-3 REQUEST FOR SCHOOL BOARD APPROVAL OF THE FIRST AMENDMENT TO THE CHARTER SCHOOL CONTRACTUAL AGREEMENT WITH SANDOR WIENER SCHOOL OF OPPORTUNITY, INC.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the first amendment to the Charter School Contractual Agreement with Sandor Wiener School of Opportunity, Inc., to:

B-60 REQUEST FOR AUTHORIZATION TO ACCEPT AN AMENDED GRANT AWARD FROM THE FLORIDA DEPARTMENT OF EDUCATION FOR FUNDING UNDER THE PUBLIC CHARTER SCHOOLS FEDERAL GRANT PROGRAM AND ENTER INTO A SEPARATE CONTRACTUAL AGREEMENT WITH NORTH DADE COMMUNITY CHARTER, INC., ON BEHALF OF NORTH DADE COMMUNITY CHARTER SCHOOL; PROJECT CYCLE: JUNE 21, 2002 THROUGH JUNE 30, 2003

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. accept the amended grant award from the Florida Department of Education, in the total amount of $201,650, for funding under the Public Charter Schools Federal Grant Program and enter into a separate contractual agreement with North Dade Community Charter, Inc., on behalf of North Dade Community Charter School, in an amount not to exceed $194,492; Project Cycle: June 21, 2002 through June 30, 2003;

2. approve acceptance of this amended grant award in accordance with Section 1002.33, Florida Statutes, Charter Schools. This action is not an endorsement of the activities undertaken by charter schools;

3. extend the use of this amended grant award and contractual agreement, at no additional cost, for a maximum of one year, as authorized through official notification from the granting agency, if deemed necessary in order to fully expend the grant award and thus complete the scope of the project; and

4. direct Financial Affairs to establish appropriations in the amended amount approved by the granting agency; such appropriation to be reported periodically to the Board.

B-61 REQUEST FOR AUTHORIZATION TO ENTER INTO A CONTRACTUAL AGREEMENT WITH THE NORTH EAST FLORIDA EDUCATIONAL CONSORTIUM (NEFEC) REGION II TECHNICAL ASSISTANCE CENTER TO PROVIDE TECHNICAL SUPPORT AND SERVICES TO TITLE I ADMINISTRATION AND SELECTED TITLE I SCHOOLS, IN AN AMOUNT NOT TO EXCEED $20,000, FROM JANUARY 16, 2003 THROUGH JUNE 30, 2003

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into a contractual agreement with the North East Florida Educational Consortium (NEFEC) Region II Title I Technical Assistance Center to provide technical support and services to Title I Administration and selected Title I Schools, in an amount not to exceed $20,000, from January 16, 2003 through June 30, 2003.

B-62 REQUEST FOR AUTHORIZATION TO ENTER INTO CONTRACTUAL AGREEMENTS WITH THE SOUTH FLORIDA BOYS CHOIR, INC. AND THE FLORIDA MEMORIAL COLLEGE MALE EXPLORERS PROGRAM TO PROVIDE FUNDS FOR PROGRAM SERVICES TO IMPROVE ACADEMIC, SOCIAL, AND CULTURAL ACHIEVEMENT FOR AT-RISK STUDENTS, PROJECT CYCLE: JANUARY 16, 2003 THROUGH JUNE 30, 2003

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. enter into contractual agreements with the South Florida Boys Choir Inc., in the amount of $19,000, and the Florida Memorial College Male Explorers Program, in the amount of $19,000, to provide funds for program services to improve the academic, social and cultural achievement for at-risk students, Project Cycle: January 16, 2003 through June 30, 2003;

2. extend these contractual agreements, at no additional cost, for a maximum of one year, as authorized through official notification from the granting agency, if deemed necessary, in order to fully expend the grant awards and complete the scope of the projects; and

3. direct Financial Affairs to establish appropriations in the amounts approved by the granting agency; such appropriations to be reported periodically to the Board.

B-63 REQUEST AUTHORIZATION FOR THE SUPERINTENDENT TO RENEW A CONTRACTUAL AGREEMENT WITH MIAMI-DADE COUNTY TO RECEIVE FUNDING TO CONTINUE COUNTYWIDE EDUCATIONAL CABLE TELEVISION SERVICES, PROJECT CYCLE: OCTOBER 1, 2002 THROUGH SEPTEMBER 30, 2003

RECOMMENDED: That The School Board of Miami-Dade County, Florida authorize the Superintendent to:

1. renew a contractual agreement with Miami-Dade County, in the amount of $707,000, to receive funding to continue countywide educational cable television services, Project Cycle: October 1, 2002 through September 30, 2003; and

2. direct Financial Affairs to establish appropriations in the amounts approved by the granting agency; such appropriations to be reported periodically to the Board.

RECOMMENDED: That The School Board of Miami-Dade County, Florida enter a final order in the case of The School Board of Miami-Dade County, Florida v. Joanne T. Stern, DOAH Case No. 01-3991, adopting the Administrative Law Judge's Recommended Order sustaining the suspension without pay of Joanne T. Stern and terminating her employment with The School Board of Miami-Dade County, Florida, as of October 24, 2001, or accepting the exceptions set forth in “Respondent’s Exceptions to Recommendations of Hearing Officer”.

C-2 THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA v. PATRICIA A. HOLMES - DOAH CASE NO. 02-2820

RECOMMENDED: That The School Board of Miami-Dade County, Florida enter a final order in the case of The School Board of Miami-Dade County, Florida v. Patricia A. Holmes, DOAH Case No. 02-2820, adopting the Administrative Law Judge's Recommended Order sustaining the suspension without pay of Patricia A. Holmes and terminating her employment with The School Board of Miami-Dade County, Florida, as of June 19, 2002.

C-3 UNITED TEACHERS OF DADE, a labor organization, and ANNETTE KATZ v. MERRETT R. STIERHEIM, in his official capacity as Superintendent of Miami-Dade County Public Schools, and THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA - UNITED STATES DISTRICT COURT CASE NO. 02-21932 CIV-UNGARO-BENAGES

RECOMMENDED: That The School Board of Miami‑Dade County, Florida, authorize the settlement of the pending Motion for Award of Attorney’s Fees and Costs in the case of United Teachers of Dade and Annette Katz v. Merrett R. Stierheim and the School Board of Miami-Dade County, U.S.D.C. Case No. 02-21932-CIV-UNGARO-BENAGES, for the sum of $19,500. The settlement will release the School Board from all claims including future damages, and for any additional claims for attorney's fees and costs.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, adopt amended School Board Rule 6Gx13-5B-1.07, Student Records, and the document, Student Educational Records, which is incorporated by reference and a part of this rule, and authorize the Superintendent to file the rule with The School Board of Miami-Dade County, Florida, to be effective January 15, 2003.

ACTION PROPOSED BY MR. FRANK J. COBO: That The School Board of Miami-Dade, Florida, authorize the Superintendent to Amend The Federal Legislative Program for the first year of the 108th Congress.

D-6 REQUEST THAT THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, DIRECT THE SUPERINTENDENT TO CONDUCT AN ANALYSIS OF THE IMPACT OF THE NO CHILD LEFT BEHIND ACT ON LIMITED ENGLISH PROFICIENT STUDENTS

ACTION PROPOSED BY MS. PERLA TABARES HANTMAN: Request that The School Board of Miami-Dade County, Florida, direct the Superintendent to:

1. conduct an analysis of the impact of the No Child Left Behind Act on LEP students; and

2. present a report of the findings and recommendations of the study no later than July 2003.

E-1 RENEWAL OF LEASE AGREEMENT WITH JACK THOMAS, INC., REALTORS, AS AGENTS FOR OMNI PARTNERSHIP, FOR USE OF A PARKING LOT LOCATED AT 235 N.E. 16 STREET, FOR THE SCHOOL BOARD ADMINISTRATION BUILDING

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the renewal of the lease agreement with Jack Thomas, Inc., Realtors, as agents for Omni Partnership, for parking space for the School Board Administration Building, at an annual rental rate of $31,500. The term of the renewal option period will commence April 26, 2003, and will end April 25, 2004. All other terms and conditions of the lease agreement will remain unchanged.

E-2 AUTHORIZATION TO EXECUTE A LEASE AMENDMENT WITH HOSANNA COMMUNITY BAPTIST CHURCH FOR USE OF PARKING FACILITIES AT OLINDA ELEMENTARY SCHOOL

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent or his designee to execute a lease amendment with Hosanna Community Baptist Church for the use of parking facilities at Olinda Elementary School, in order to change the date by which the Church must secure a CO from February 13, 2003 to December 13, 2004. All other terms and conditions of the lease agreement will remain unchanged.

E-3 AUTHORIZATION TO EXECUTE A LEASE AMENDMENT WITH THE SOUTH FLORIDA EDUCATIONAL FEDERAL CREDIT UNION FOR THE USE OF BOARD-OWNED LAND LOCATED AT 5780 N.W. 158 STREET, FOR THE OPERATION OF ITS MIAMI LAKES BRANCH
