Pursuant to Board Rule 6Gx13-8C-1.17, a person not scheduled in advance to speak on a non-agenda topic must submit a written request to the Superintendent of Schools not later than 10:00 a.m. on the day of a regular Wednesday Board Meeting. The request must state the person’s name, address, subject and reason for asking emergency handling of the request, reason demonstrating good cause why the 4:30 p.m. Monday deadline was not met, and Board action requested. Board members present at the meeting must vote by a two-thirds (2/3) majority, for the person to be heard.

Speakers List / Supplemental List will generally be posted on Tuesday PM or Wednesday AM prior to the meeting.

The School Board of Miami-Dade County, Florida, seeks public input and participation. However, the public purpose is not served when citizens become disorderly or disrupt the meeting. Accordingly, the Chair may order the removal from any School Board meeting of any person interfering with the expeditious or orderly process of the meeting provided the Chair has first issued a warning that continued interference with the orderly processes of the meeting will result in removal. Any law enforcement authority or a sergeant-at-arms designated by Chair shall remove any person ordered removed pursuant to this section §1001.372 (3), Fla.Stat.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into cooperative agreements with CWK Network Inc., WFOR Channel 4 television, and Wachovia Bank to initiate and implement a life skills/character education program in 30 schools, effective December 11, 2003 through June 30, 2004.

There are no local funds required.

B-2 REQUEST FOR SCHOOL BOARD APPROVAL OF THE SUPPLEMENTAL ACADEMIC INSTRUCTION (SAI) DISTRICT PLAN FOR 2003–2004

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the Supplemental Academic Instruction (SAI) District Plan 2003 – 2004, submitted to the Florida Department of Education.

B-24 REQUEST AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO A COOPERATIVE AGREEMENT BETWEEN THE CITY OF MIAMI AND MIAMI-DADE COUNTY PUBLIC SCHOOLS TO PROVIDE SUPPORT TO HOLMES ELEMENTARY SCHOOL THROUGH THE CITY OF MIAMI’S COMMUNITY SUPPORT PLAN

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into a cooperative agreement between The City of Miami and Miami-Dade County Public Schools to provide support to Holmes Elementary School through The City of Miami’s Community Support Plan.

No local funds are required.

B-25 REQUEST AUTHORIZATION FOR THE SUPERINTENDENT TO ACCEPT A DONATION OF $10,000 FROM THE R. KIRK LANDON FOUNDATION FOR FUNDING THE NEXT GEN. INTERNATIONAL CHILDREN’S FILM FESTIVAL

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to accept a donation of $10,000 from the R. Kirk Landon Foundation for funding the NEXT GEN. International Children’s Film Festival, to be held December 10 - 13, 2003 at the Cocowalk A.M.C. Theater.

2. provide educational services in an opportunity school or alternative program during the term of the expulsion; and

3. following the term of the expulsion, permit the student to be returned to a regular school program in Miami-Dade County Public Schools, if approved by the Office of Adult/Vocational, Alternative and Community Education.

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. expel the student specified in the supplemental material SM-24 (2003-2004), furnished under separate cover to Board members, from the regular and adult programs of Miami-Dade County Public Schools for the maximum time permitted under law, which is the 2003-2004 school year, the 2004 summer session, and the 2004-2005 school year;

2. provide educational services in an opportunity school or alternative program during the term of the expulsion; and

3. following the term of the expulsion, permit the student to be returned to a regular school program in Miami-Dade County Public Schools, if approved by the Office of Adult/Vocational, Alternative and Community Education.

GRANTS ADMINISTRATION

B-60 REQUEST AUTHORIZATION TO ACCEPT A GRANT AWARD FROM THE FLORIDA DEPARTMENT OF EDUCATION FOR FUNDING UNDER THE PUBLIC CHARTER SCHOOL FEDERAL GRANT PROGRAM AND ENTER INTO A CONTRACTUAL AGREEMENT WITH MATER ACADEMY CHARTER HIGH SCHOOL

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. accept a grant award from the Florida Department of Education in the amount of $200,000, for funding under the Public Charter School Federal Grant Program for the grant period of October 6, 2003 through September 30, 2004;

2. enter into a contractual agreement with Mater Academy, Inc., on behalf of Mater Academy Charter High School, in an amount not to exceed $193,330;

3. approve acceptance of this grant award in accordance with Florida Statutes, Section 1002.33, Charter Schools. This action is not an endorsement of the activities undertaken by charter schools;

4. extend this program and contractual agreement as authorized through official notification from the granting agency, in order to complete the goals of the program; and

5. direct Financial Affairs to establish appropriations in the amounts approved or as amended by the granting agency; such appropriations to be reported periodically to the Board.

B-61 REQUEST AUTHORIZATION TO ACCEPT A GRANT AWARD FROM THE FLORIDA DEPARTMENT OF EDUCATION FOR FUNDING UNDER THE SECONDARY READING COACH MODEL GRANT PROGRAM

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. accept a grant award from the Florida Department of Education in the amount of $272,918 for funding under the Secondary Reading Coach Model Grant Program for the grant period of July 1, 2003 through June 30, 2004;

2. extend this program as authorized through official notification from the granting agency, in order to complete the goals of the program; and

3. direct Financial Affairs to establish appropriations in the amounts approved or as amended by the granting agency; such appropriations to be reported periodically to the Board.

B-62 REQUEST AUTHORIZATION TO ACCEPT A GRANT AWARD FROM THE FLORIDA DEPARTMENT OF EDUCATION FOR FUNDING THE LEARNING FOR LIFE CHARACTER EDUCATION PROGRAM AND ENTER INTO A CONTRACTUAL AGREEMENT WITH LEARNING FOR LIFE, INC.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. accept a grant award from the Florida Department of Education for funding the Learning for Life Character Education Program in the amount of $158,000 for the grant period of July 1, 2003 through June 30, 2004;

2. enter into a contractual agreement with the Learning for Life, Inc., in the amount of $158,000 for the contract period of July 1, 2003 through June 30, 2004;

3. extend this grant award and contractual agreement as authorized through official notification from the granting agency, in order to complete the goals of the program; and

4. direct Financial Affairs to establish appropriations in the amounts approved or as amended by granting agency; such appropriations to be reported periodically to The Board.

B-63 REQUEST AUTHORIZATION TO ACCEPT A GRANT AWARD FROM MIAMI-DADE COUNTY DEPARTMENT OF CULTURAL AFFAIRS AND A GRANT AWARD FROM THE FLORIDA DEPARTMENT OF STATE, DIVISION OF CULTURAL AFFAIRS

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. accept a grant award from Miami-Dade County Department of Cultural Affairs and a grant award from the Florida Department of State, Division of Cultural Affairs, for funding under the NEXT GEN. International Children’s Film Festival for a total amount of $8,467 for the grant period July 1, 2003 through June 30,2004;

2. extend this program as authorized through official notification from the granting agencies, in order to complete the goals of the program; and

3. direct Financial Affairs to establish appropriations in the amounts approved or as amended by granting agency; such appropriations to be reported periodically to The Board.

B-64 REQUEST AUTHORIZATION TO ACCEPT AN AMENDMENT TO A CONTRACT FOR A GRANT AWARD FROM THE STATE OF FLORIDA, DEPARTMENT OF JUVENILE JUSTICE, AND TO ENTER INTO A CONTRACTUAL AGREEMENT WITH THE ICARE BAY POINT SCHOOLS TO PROVIDE A RESIDENTIAL AFTERCARE PROGRAM

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. accept an amendment to a contract for a grant award from The State of Florida, Department of Juvenile Justice, to increase the amount from $1,971,000 to $2,323,800 for the full program period from September 15, 2001 through September 14, 2004;

2. amend the contractual agreement with the ICARE Bay Point Schools from $622,691 annually to an amount not to exceed $972,663.84 for the period from July 1, 2003 through September 14, 2004;

3. extend this grant award and contractual agreement at no additional cost, as authorized through official notification from the granting agency, if deemed necessary, in order to fully expend the grant award and complete the scope of the project; and

4. Financial Affairs to establish appropriations in the amounts approved by the granting agency; such appropriations to be reported periodically to the Board.

B-75 REQUEST AUTHORIZATION FOR THE SUPERINTENDENT TO ACCEPT A DONATION OF $28,275 FROM AVOCADO ELEMENTARY SCHOOL PARENT TEACHER ASSOCIATION (PTA) FOR THE CONSTRUCTION OF TWO COVERED EXTENSIONS OVER EXISTING WALKWAYS AT AVOCADO ELEMENTARY SCHOOL

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to

1. accept the donation of $28,275 from Avocado Elementary School PTA for the construction of two covered extensions over walkways at the school; and

2. approve the allocation of $6,000 from the Department of Safety and amend the five-year work program to include this project.

RECOMMENDED: That The School Board of Miami-Dade County, Florida enter its final order in the case of The School Board of Miami-Dade County, Florida v. Marc S. Morgan, DOAH Case No. 03-1334, adopting the Administrative Law Judge’s Recommended Order affirming the suspension and dismissal of Marc S. Morgan as its final order.

C-2 THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA v. HAROLD MCKINNEY - DOAH CASE NO.: 03-1761

RECOMMENDED: That The School Board of Miami-Dade County, Florida enter its final order in the case of The School Board of Miami-Dade County, Florida v. Harold McKinney, DOAH Case No. 03-1761, adopting the Administrative Law Judge’s Recommended Order affirming the suspension of Harold McKinney as its final order.

C-3 THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA v. BENITA A. ROBERTS - DOAH CASE NO. 02-0835

RECOMMENDED: That The School Board of Miami-Dade County, Florida enter a final order in the case of The School Board of Miami-Dade County, Florida v. Benita A. Roberts, DOAH Case No. 02-0835, adopting the Administrative Law Judge’s Recommended Order sustaining the suspension without pay of Benita Roberts and terminating her employment with The School Board of Miami-Dade County, Florida, as of February 13, 2002, and denying any claim for back pay.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, adopt amended School Board Rule 6Gx13-3C-1.10, Purchase Approval, and authorize the Superintendent to file the rule with The School Board of Miami-Dade County, Florida, to be effective December 10, 2003.

C-22 PROPOSED AMENDMENT OF SCHOOL BOARD RULE: FINAL READING 6Gx13-7B-1.02, ARCHITECTURAL, ENGINEERING, AND INSPECTION SERVICES –AUTHORITY OF SUPERINTENDENT OF SCHOOLS TO EMPLOY

RECOMMENDED: That The School Board of Miami-Dade County, Florida, adopt amended School Board Rule 6Gx13-7B-1.02, Architectural, Engineering, and Inspection Services – Authority of Superintendent to Employ, and the documents, Procedures for the Selection of Construction Management Services, which is incorporated by reference and is a part of this rule, and authorize the Superintendent to file the rule with The School Board of Miami-Dade, Florida, to be effective December 10, 2003.

C-23 PROPOSED AMENDMENT OF SCHOOL BOARD RULE: INITIAL READING 6Gx13-6A-1.331, PROCEDURES FOR PROVIDING SPECIAL EDUCATION FOR EXCEPTIONAL STUDENTS

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to initiate rulemaking proceedings in accordance with the Administrative Procedure Act to amend School Board Rule 6Gx13-6A-1.331, Procedures for Providing Special Education for Exceptional Students, and the document, Special Programs and Procedures for Exceptional Students, Effective Dates: 2000-2001 through 2002-2003, which is incorporated and a part of this rule.

After consideration of the D agenda items at the School Board Meeting on December 10, 2003, the School Board will recess temporarily. During the recess, the Board members will convene in the School Board Auditorium (1450 N.E. 2nd Avenue) to conduct a meeting of the Miami-Dade County School Board Foundation, Inc. It is expected that the Board of Directors will take action with respect to the following:

E-1 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO ISSUE A REQUEST FOR PROPOSAL FOR THE COMMERCIAL DEVELOPMENT OF A BOARD-OWNED PARKING FACILITY LOCATED AT 1302 N.E. 2 AVENUE, MIAMI, FLORIDA

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. finalize a Request for Proposal for the commercial development of a Board-owned parking facility located at 1302 NE 2nd Avenue, Miami, Florida, with RFP criteria to conform, substantially, to the terms noted above, and issue same without further Board action;

2. bring the results of the RFP, along with a recommendation for further action, to the Board at a future Board meeting for comment and direction; and

3. approve the selection committee listed above to evaluate proposals submitted.
