Pursuant to Board Rule 6Gx13-8C-1.17, a person not scheduled in advance to speak on a non-agenda topic must submit, either before or during the regularly scheduled meeting, a written request to the Chair. The School Board of Miami-Dade County, Florida, seeks public input and participation. However, the public purpose is not served when citizens become disorderly or disrupt the meeting. Accordingly, the Chair may order the removal from any School Board meeting of any person interfering with the expeditious or orderly process of the meeting provided the Chair has first issued a warning that continued interference with the orderly processes of the meeting will result in removal. Any law enforcement authority or a sergeant-at-arms designated by Chair shall remove any person ordered removed pursuant to this section §1001.372 (3), Fla.Stat.

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into a consultant agreement with Mr.Howard S. Tames, at a daily rate of $619.50 from June 21, 2004 through September 1, 2004.

B. EDUCATION

B-1 REQUEST SCHOOL BOARD APPROVAL OF THE FIRST AMENDMENT TO THE CHARTER SCHOOL CONTRACTUAL AGREEMENT WITH THE CITY OF AVENTURA, FLORIDA, ON BEHALF OF AVENTURA CHARTER ELEMENTARY SCHOOL

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the first amendment to the charter school contractual agreement with the City of Aventura, Florida, on behalf of Aventura Charter Elementary School to:

1. change the name of the school to Aventura City of Excellence Charter School;

2. increase the grade level configuration from kindergarten through five to kindergarten through eight; and

3. increase the enrollment capacity from a maximum of 600 students to a maximum of 900 students, commencing with the 2005-2006 school year and continuing throughout the term of the contract which ends on June 30, 2018.

B-2 REQUEST SCHOOL BOARD APPROVAL OF THE FIRST AMENDMENT TO THE CHARTER SCHOOL CONTRACTUAL AGREEMENT WITH BALERE, INC., ON BEHALF OF BALERE LANGUAGE ACADEMY

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the first amendment to the charter school contractual agreement with Balere, Inc., on behalf of Balere Language Academy, to open the school at a facility at 10600 Caribbean Boulevard, Miami, Florida 33189, commencing with the 2004-2005 school year and continuing throughout the term of the contract which ends on June 30, 2014.

B-3 REQUEST SCHOOL BOARD APPROVAL OF THE FIRST AMENDMENT TO THE CHARTER SCHOOL CONTRACTUAL AGREEMENT WITH THE UNITED PROPERTY OWNERS OF THE 8.5 SQUARE MILE AREA, INC., ON BEHALF OF LAS PALMAS CHARTER SCHOOL

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the first amendment to the charter school contractual agreement with The United Property Owners of the 8.5 Square Mile Area, Inc., on behalf of Las Palmas Charter School, to open the school at a facility located at 14250 SW 202 Avenue, Miami, Florida 33196, commencing with the 2004-2005 school year and continuing throughout the term of the contract which ends on June 30, 2009.

B-4 REQUEST SCHOOL BOARD APPROVAL OF THE FIRST AMENDMENT TO THE CHARTER SCHOOL CONTRACTUAL AGREEMENT WITH MIAMI COMMUNITY CHARTER SCHOOL, INC., ON BEHALF OF MIAMI COMMUNITY CHARTER SCHOOL

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the first amendment to the charter school contractual agreement with Miami Community Charter School, Inc., on behalf of Miami Community Charter School, to open the school at a facility located at 101 SW Redland Road, Florida City, Florida 33034 commencing with the 2004-2005 school year and continuing throughout the term of the contract which ends on June 30, 2009.

B-5 REQUEST SCHOOL BOARD APPROVAL OF THE SECOND AMENDMENT TO THE CHARTER SCHOOL CONTRACTUAL AGREEMENT WITH MIAMI CHILDREN’S MUSEUM CHARTER SCHOOL, INC., ON BEHALF OF MIAMI CHILDREN’S MUSEUM CHARTER SCHOOL

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the second amendment to the charter school contractual agreement with Miami Children’s Museum Charter School, Inc., on behalf of Miami Children’s Museum Charter School to open at a facility located at 450 SW 4 Street, Miami, Florida 33130, commencing with the 2004-2005 school year and continuing until a permanent facility is ready for occupancy.

B-6 REQUEST SCHOOL BOARD APPROVAL OF THE FIFTH AMENDMENT TO THE CHARTER SCHOOL CONTRACTUAL AGREEMENT WITH PINECREST ACADEMY, INC., ON BEHALF OF PINECREST PREPARATORY ACADEMY

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the fifth amendment to the charter school contractual agreement with Pinecrest Academy, Inc., on behalf of Pinecrest Preparatory Academy to operate a third campus located at 12425 SW 72 Street, Miami, Florida 33183, commencing with the 2004-2005 school year and continuing throughout the term of the contract which ends on June 30, 2005.

B-7 REQUEST SCHOOL BOARD APPROVAL OF THE SECOND AMENDMENT TO THE CHARTER SCHOOL CONTRACTUAL AGREEMENT WITH PINECREST ACADEMY, INC., ON BEHALF OF PINECREST PREPARATORY ACADEMY CHARTER MIDDLE SCHOOL

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the second amendment to the charter school contractual agreement with Pinecrest Academy, Inc., on behalf of Pinecrest Preparatory Academy Charter Middle School to operate a third campus located at 12425 SW 72 Street, Miami, Florida 33183, commencing with the 2004-2005 school year and continuing throughout the term of the contract which ends on June 30, 2013.

B-8 REQUEST SCHOOL BOARD APPROVAL OF THE CHARTER SCHOOL CONTRACTUAL AGREEMENT WITH THE CITY OF NORTH MIAMI ON BEHALF OF NORTH MIAMI/FLORIDA INTERNATIONAL UNIVERSITY CHARTER SENIOR HIGH SCHOOL

RECOMMENDED: Recognizing that The School Board of Miami-Dade County, Florida, has previously approved the charter school application, it is recommended that the Board grant approval of the charter school contractual agreement with The City of North Miami on behalf of North Miami/Florida International University Charter Senior High School, for a term of fifteen years, commencing with the 2005-2006 school year and ending on June 30, 2020.

B-9 REQUEST SCHOOL BOARD APPROVAL OF THE FIRST AMENDMENT TO THE CHARTER SCHOOL CONTRACTUAL AGREEMENT WITH NORTH DADE COMMUNITY CHARTER SCHOOL, INC., ON BEHALF OF NORTH DADE COMMUNITY CHARTER SCHOOL

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the first amendment to the charter school contractual agreement with North Dade Community Charter School, Inc., on behalf of North Dade Community Charter School to:

1. implement the Probation and Intervention Plan effective immediately and throughout the 2004-2005 school year;

2. terminate the charter school contractual agreement by June 30, 2005 if the school fails to meet all provisions of the Probation and Intervention Plan, waiving all rights to appeal under Section 1002.33(7)(c), Florida Statutes; and

3. relocate the school to a facility at 13301 NW 24 Avenue, Miami Florida 33054, commencing with the 2004-2005 school year and continuing throughout the term of the contract.

B-10 REQUEST AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO A CONTRACTUAL AGREEMENT WITH MIAMI-DADE COUNTY HEALTH DEPARTMENT FOR THE CONTINUATION OF FULL SERVICE SCHOOLS IN MIAMI-DADE COUNTY PUBLIC SCHOOLS

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. enter into a contractual agreement with Miami-Dade County Health Department to utilize funds appropriated by the state to that agency for the continuation of Full Service Schools in Miami-Dade County Public Schools, effective August 12, 2004 through June 10, 2005; and

2. direct Financial Affairs to establish revenues and appropriations in the amount of $800,000; such appropriations to be reported periodically to the Board.

B-11 REQUEST FOR APPROVAL OF OUT-OF-COUNTY/OUT-OF-STATE TRIPS FOR THE 2004-2005 SCHOOL YEAR

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve the list of out-of-county/out-of-state trips for the 2004-2005 school year for use in conjunction with School Board Rule 6Gx13-6A-1.22, Field Trips.

B-22 REQUEST AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO A CONTRACTUAL AGREEMENT WITH CITRUS HEALTH NETWORK, INC., TO PROVIDE EDUCATIONAL AND RELATED SERVICES FOR 60 SEVERELY EMOTIONALLY DISTURBED AND EMOTIONALLY HANDICAPPED STUDENTS

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into a contractual agreement with Citrus Health Network, Inc., in an amount not to exceed $247,358.40, to provide educational and related services for 60 severely emotionally disturbed (SED) and emotionally handicapped (EH) students, effective August 1, 2004, through June 30, 2005.

The appropriation for this item will be included in the General Fund of the 2004-2005 Tentative Budget to be recommended for adoption in July 2004.

B-23 RECEIVE PLAN FOR PUBLIC RELATIONS CAMPAIGN TO EDUCATE STUDENTS AND PARENTS ON THE ADVANTAGES OF BEING BILINGUAL AND BILITERATE

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. receive the plan to increase public awareness of the necessity to educate students, parents, and the community at large of the advantages of being bilingual and biliterate in an amount not to exceed $3,000 for the 2004-2005 school year; and

2. direct the Superintendent to seek business partners that are willing to assist in the implementation of the plan.

The appropriation for this item will be included in the General Fund of the 2004-2005 Tentative Budget to be recommended for adoption in July 2004.
