A-1 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO HOST THE NINTH ANNUAL INSTRUCTIONAL TECHNOLOGY CONFERENCE AND CAREER EXPOSITION ENTITLED PREPARING FOR THE eFUTURE―NOW, OCTOBER 9-11, 2001; AND TO ENTER INTO CONTRACTUAL AGREEMENTS WITH THE MIAMI BEACH CONVENTION CENTER AND ITS REQUIRED SUBCONTRACTORS WITH AN ESTIMATED COST OF $100,000 BASED ON THE 2000-2001 EXPENDITURES

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. host the Ninth Annual Instructional Technology Conference and Career Exposition entitled Preparing for the eFuture―Now; and
2. enter into contractual agreements with the Miami Beach Convention Center and its required subcontractors for October 9-11, 2001, to provide facilities and services for the conference with an estimated cost of $100,000 based on the 2000-2001 expenditures.

The appropriation for this item will be included in the Trust and Agency Fund of the 2001-2002 Tentative Budget to be recommended for adoption in July 2001. No local funds are required.

A-2 REQUEST FOR APPROVAL OF RESOLUTION NO. 01-07 OF THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, PROCLAIMING APRIL 2001 AS SCHOOL LIBRARY MEDIA MONTH IN MIAMI-DADE COUNTY PUBLIC SCHOOLS

ACTION PROPOSED BY DR. PÉREZ: That The School Board of Miami-Dade County, Florida, approve Resolution No. 01-12 of The School Board of Miami-Dade County, Florida, designating March 2001 as Celtic-American Heritage Month to be celebrated in all of Miami-Dade County's public schools.

C-1 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO A CONTRACTUAL AGREEMENT WITH RANDSTAD USLP (UNITED STATES LIMITED PARTNERSHIP), BY WHICH THEIR STAFFING AGENCY WILL PROVIDE MAJOR APPLIANCE TECHNICIAN SERVICES AT ROBERT MORGAN TECHNICAL ARTS HIGH SCHOOL, IN AN AMOUNT NOT TO EXCEED $13,920, FROM MARCH 15, 2001 THROUGH AUGUST 9, 2001

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. authorize the Superintendent to enter into a contractual agreement with Randstad USLP (United States Limited Partnership), by which their staffing agency will provide major appliance technician services at Robert Morgan Technical Arts High School, in an amount not to exceed $13,920, from March 15, 2001 through August 9, 2001; and
2. grant an exception to School Board Rule 6Gx13- 3F-1021.

The appropriation for this item is derived from revenue generated by the repair and sale of equipment donated by Maytag.

C-2 REQUEST FOR APPROVAL OF RESOLUTION NO. 01-09 OF THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, ENDORSING MARCH 12-16, 2001, AS SCHOOL SOCIAL WORK WEEK IN MIAMI-DADE COUNTY PUBLIC SCHOOLS

RECOMMENDED: That The School Board of Miami-Dade County, Florida, approve Resolution No. 01-09 of The School Board of Miami-Dade County, Florida, endorsing March 12-16, 2001, as School Social Work Week in Miami-Dade County Public Schools.

C-3 SUBMISSION OF A CHARTER SCHOOL APPLICATION FOR DORAL ACADEMY CHARTER HIGH SCHOOL WITH RECOMMENDATION FOR APPROVAL AND AUTHORIZATION FOR THE SUPERINTENDENT TO NEGOTIATE A TEN-YEAR CHARTER SCHOOL CONTRACTUAL AGREEMENT BEGINNING WITH THE 2001-2002 SCHOOL YEAR

RECOMMENDED: That The School Board of Miami-Dade County, Florida:

1. approve the Doral Academy Charter High School application and authorize the negotiation of a ten-year charter school contractual agreement for the 2001-2002 through 2010-2011 school years; and
2. authorize the Superintendent to negotiate with the approved applicant the charter school contractual agreement which reflects the contents of the application, as approved by the School Board. Such charter school contractual agreement will be submitted for School Board consideration at a subsequent meeting at which time there will be a public hearing to provide for community input.

C-4 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO A CONTRACTUAL AGREEMENT WITH THE RADISSON MART PLAZA HOTEL TO PROVIDE FACILITIES AND SERVICES FOR THE 2001 SOCIAL STUDIES CONFERENCE, MAY 1, 2001, AT A COST NOT TO EXCEED $20,000

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into a contractual agreement with the Radisson Mart Plaza Hotel to provide facilities and services for the 2001 Social Studies Conference, May 1, 2001, at a cost not to exceed $20,000. The appropriation for this item is included in the Trust and Agency Special Events Fund of the 2000-2001 Adopted Budget.

C-5 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO A CONTRACTUAL AGREEMENT FOR SERVICES RENDERED BY JOBS FOR MIAMI TRAINING ACADEMY, TO OFFER APPLIED TECHNOLOGY PROGRAMS AND BASIC SKILLS TRAINING, IN AN AMOUNT NOT TO EXCEED $312,000, FROM JANUARY 3, 2001 THROUGH JUNE 30, 2001

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into a contractual agreement for services rendered by Jobs for Miami Training Academy, to offer applied technology programs and basic skills training, in an amount not to exceed $312,000, from January 3, 2001 through June 30, 2001. The appropriation for this item is included in the General Fund of the 2000-2001 Adopted Budget.

C-6 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO CONTRACTUAL AGREEMENTS WITH FAMILY CHRISTIAN ASSOCIATION OF AMERICA, IN AN AMOUNT NOT TO EXCEED $35,152, YOUNG MEN'S CHRISTIAN ASSOCIATION, IN AN AMOUNT NOT TO EXCEED $64,428, AND YOUNG WOMEN'S CHRISTIAN ASSOCIATION, IN AN AMOUNT NOT TO EXCEED $10,920, FOR A TOTAL COST NOT TO EXCEED $110,500, TO PROVIDE AFTER-SCHOOL CARE SERVICES FOR PREKINDERGARTEN EARLY INTERVENTION STUDENTS, FROM MARCH 15, 2001 THROUGH JUNE 13, 2001

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to:

1. enter into contractual agreements with Family Christian Association of America, in an amount not to exceed $35,152; Young Men's Christian Association, in an amount not to exceed $64,428; and Young Women's Christian Association, in an amount not to exceed $10,920, for a total cost not to exceed $110,500, to provide after-school care for prekindergarten children, from March 15, 2001 through June 13, 2001; and 
2. grant an exception to School Board Rule 6Gx13- 3F-1.021.

The appropriation for this item is included in the General Fund of the 2000-2001 Adopted Budget.

C-7 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO A CONTRACTUAL AGREEMENT WITH THE SOUTH FLORIDA EMPLOYMENT AND TRAINING CONSORTIUM, WHEREBY MIAMI-DADE COUNTY PUBLIC SCHOOLS WILL PROVIDE EDUCATIONAL TESTING SERVICES TO SUMMER YOUTH AND EMPLOYMENT TRAINING PROGRAM PARTICIPANTS, IN AN AMOUNT NOT TO EXCEED $17,000, FROM MARCH 15, 2001 THROUGH JUNE 30, 2001

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into a contractual agreement with the South Florida Employment and Training Consortium, whereby Miami-Dade County Public Schools (M-DCPS) will provide educational testing services to Summer Youth Employment and Training Program participants, in an amount not to exceed $17,000, from March 15, 2001 through June 30, 2001. No local funds are required.

C-8 SCHOOL-TO-CAREER CONFERENCE

C-11 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO A COOPERATIVE AGREEMENT WITH METROPOLITAN MIAMI-DADE COUNTY, FLORIDA, DEPARTMENT OF HUMAN SERVICES, OFFICE OF YOUTH AND FAMILY DEVELOPMENT, TO JOINTLY OPERATE NON-SCHOOL-BASED DAY-TREATMENT PROGRAMS FOR SEVERELY EMOTIONALLY DISTURBED STUDENTS, FROM JULY 1, 2001 THROUGH JUNE 30, 2002

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into a cooperative agreement with Metropolitan Miami-Dade County, Florida, Department of Human Services, Office of Youth and Family Development, to jointly operate non-school-based day-treatment programs for severely emotionally disturbed students, from July 1, 2001 through June 30, 2002. There is no exchange of funds.

C-12 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO COOPERATIVE AGREEMENTS WITH STATE AND PRIVATE COLLEGES, UNIVERSITIES, AND COMMUNITY COLLEGES TO PLACE STUDENT PHYSICAL AND OCCUPATIONAL THERAPISTS AND STUDENT PHYSICAL AND OCCUPATIONAL THERAPIST ASSISTANTS WITH THERAPISTS SERVING AS CLINICAL INSTRUCTORS, FROM JULY 1, 2001 THROUGH JUNE 30, 2002

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into cooperative agreements with state and private colleges, universities, and community colleges to place student physical and occupational therapists and student physical occupational therapist assistants, with therapists serving as clinical instructors, from July 1, 2001 through June 30, 2002. No local Funds are required.

C-13 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO COOPERATIVE AGREEMENTS WITH REDLANDS CHRISTIAN MIGRANT ASSOCIATION HEAD START, THE HEAD START DIVISION OF THE MIAMI-DADE COUNTY COMMUNITY ACTION AGENCY, AND THE HEAD START DIVISION OF THE MICCOSUKEE CORPORATION TO SERVE PREKINDERGARTEN CHILDREN WITH DISABILITIES, FROM JULY 1, 2001 THROUGH JUNE 30, 2002

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into cooperative agreements with Redlands Christian Migrant Association Head Start, the Head Start Division of the Miami-Dade County Community Action Agency, and the Head Start Division of the Miccosukee Corporation to serve preschool children with disabilities, from July 1, 2001 through June 30, 2002. There is no exchange of funds.

C-14 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO A COOPERATIVE AGREEMENT WITH THE PUBLIC HEALTH TRUST/JACKSON MEMORIAL HOSPITAL TO OPERATE A SHORT-TERM TRANSITIONAL EDUCATION PROGRAM FOR SEVERELY EMOTIONALLY DISTURBED STUDENTS AT JACKSON MEMORIAL HOSPITAL/HIGHLAND PARK, FROM JULY 1, 2001 THROUGH JUNE 30, 2002

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into a cooperative agreement with the Public Health Trust/Jackson Memorial Hospital to operate a short-term transitional educational program for severely emotionally disturbed students, from July 1, 2001 through June 30, 2002. There is no exchange of funds.

C-15 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO COOPERATIVE AGREEMENTS WITH CHILDREN'S REHAB NETWORK AND JACKSON INFANT TODDLER CENTER TO PROVIDE SERVICES TO CHILDREN WITH DISABILITIES IN PRESCRIBED PEDIATRIC EXTENDED CARE FACILITIES, FROM JULY 1, 2001 THROUGH JUNE 30, 2002

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into cooperative agreements with the Children's Rehab Network and Jackson Infant Toddler Center to provide services to children with disabilities in Prescribed Pediatric Extended Care Facilities, from July 1, 2001 through June 30, 2002.

C-16 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO A COOPERATIVE AGREEMENT WITH THE BERTHA ABESS CHILDREN'S CENTER INC., TO PROVIDE SERVICES TO EMOTIONALLY HANDICAPPED AND SEVERELY EMOTIONALLY DISTURBED STUDENTS, FROM JULY 1, 2001 THROUGH JUNE 30, 2002

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into a cooperative agreement with the Bertha Abess Children's Center, Inc., to provide services to emotionally handicapped and severely emotionally disturbed students, from July 1, 2001 through June 30, 2002. There is no exchange of funds.

C-17 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO A CONTRACTUAL AGREEMENT WITH THE ASSOCIATION FOR THE DEVELOPMENT OF THE EXCEPTIONAL TO PROVIDE EDUCATIONAL AND RELATED SERVICES FOR EXCEPTIONAL STUDENTS, IN AN AMOUNT NOT TO EXCEED $68,721, FROM MARCH 15, 2001 THROUGH JUNE 30, 2001

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into a contractual agreement with the Association for the Development of the Exceptional, to provide educational and related services for exceptional students, in an amount not to exceed $68,721, from March 15, 2001 through June 30, 2001. C-18 REQUEST FOR AUTHORIZATION FOR THE SUPERINTENDENT TO ENTER INTO A COOPERATIVE AGREEMENT WITH CHILDREN'S PSYCHIATRIC CENTER, INC., TO OPERATE A DAY-TREATMENT PROGRAM FOR EMOTIONALLY HANDICAPPED ADOLESCENTS, FROM JULY 1, 2001 THROUGH JUNE 30, 2002

RECOMMENDED: That The School Board of Miami-Dade County , Florida commission the firm of Zyscovich, Inc. to perform the first phase of the architectural/engineering services for Miami Beach Senior High for the following considerations:

1. lump sum fee of $49,850 for developing a final scope definition program; and
2. the provisional multiplier for hourly compensation was limited to 2.45 for extra work previously approved by staff.

J-40 COMMISSIONING OF KVH ARCHITECTS, P.A., TO PERFORM ARCHITECTURAL/ENGINEERING SERVICES FOR THE RE-ROOFING PROJECT AT REDLAND MIDDLE SCHOOL

RECOMMENDED: That The School Board of Miami-Dade County, Florida commission the firm of KVH Architects, P.A. to perform architectural/engineering services for the re-roofing project at Redland Middle School, with a construction cost of $1,449,500, for the following considerations:

1. lump sum fee of $76,788, which represents approximately 5.3% of the construction cost:
2. the multiplier for hourly compensation was limited to 2.45 for extra work; and
3. the Project Architect will maintain at least a $500,000 Professional Liability Insurance Policy.

K-1 THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA v. JOHN A. BENSON, CASE NO. DH 98-018-SPATZ

RECOMMENDED: That The School Board of Miami-Dade County, Florida, adopt the Recommended Order of the Hearing Officer in Case No. DH98-018-SPATZ, affirming the suspension of John A. Benson, dismissing him from all employment with The School Board of Miami-Dade County, Florida, as of May 12, 1999, and denying him any claim for back pay.

K-2 RECOMMENDATION FOR INCREASE IN HOURLY LEGAL FEES FOR CONSTRUCTION LITIGATION COUNSEL

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize an increase in hourly legal fees for construction litigation counsel as follows: up to $200 per hour for lead counsel, up to $120 for second year associates, and up to $70 per hour for paralegals, effective March 15, 2001.

K-3 HILL-KIRLIN, INC. v. THE SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, Case No. 99-01729 CA 06 (Biscayne Gardens Elementary School) SETTLEMENT AGREEMENT

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to enter into the Settlement and Release Agreement with Hill-Kirlin, Inc., in the amount of $155,000, for the settlement of all claims in the case of Hill-Kirlin, Inc. v. The School Board of Miami-Dade County, Florida, Case No. 99-01729 CA 06.

K-20 PROPOSED AMENDMENT OF BOARD RULE: INITIAL READING 6Gx13- 8D-1.01, COMPREHENSIVE DISTRICTWIDE PLANNING

RECOMMENDED: That The School Board of Miami-Dade County, Florida, authorize the Superintendent to initiate rulemaking proceedings in accordance with the Administrative Procedure Act to amend School Board Rule 6Gx13- 8D-1.01, Comprehensive Districtwide Planning, by revising the document, Promoting Continuous School Quality Improvement 2000-2001, A Manual for Implementing Florida's High-Quality Education System in Miami-Dade County Public Schools, which is incorporated by reference and is a part of this rule.
